About Me

  1. It always seems so much worse when its a friend that takes advantage of us and our patience, i'm so sorry OP
  2. midderoo (midderoo) wrote in artists_beware, @ 2018-12-23 22:03 Xhybora WHO: Xhybora WHERE: Furaffinity ( http://www.furaffinity.net/user/xhybora/ ) and Discord WHAT: Single character short looping animation WHEN: First payment made December 30th Second payment made January 12th. EXPLAIN: This'll be a bit all over the place because of how FA's notes work. And I want to get every single screenshot so it shows everything. (It reads from bottom to top when it comes to the back and forth, in case it looks a bit confusing to read.) Note: Some of the conversations via discord are NSFW. 29/8/2017 I was first approached by Xhybora on the 29th of October where they expressed interest in doing an animation for me. [1] I of course responded, not having had many people actually express interest in me and my OC's so much they actually come to me. I try to keep it buisiness like but friendly at the same time. [2] 30/8/2017 The next day he replies telling me how much the base price normally is. [3] I respond to them, telling them where it's easier to talk to me and how to keep in contact with me as well as telling them which characters would be good for the animation they had in mind. [4] They then ask for my Discord. [5] I give them said Discord. [6] Through Discord we discuss the idea. [7] [8] [9] [10] [11] 11/12/2017 He messages me to check up on if I'm still on board with the commission and when I will be able to pay. [12] I suggest a payment plan since my PC had kicked the bucket and I had to spend any money I'd been saving on a laptop. He also reiiterates the idea he had in mind as well as which OC he wanted to use, which was my Fursona. [13] He tells me how much it will cost and what it will come with. I also express interest that if the animation turns out well I'll return for more. I think you can tell how that went. [14] I work out roughly about how much I can pay for and when I'd be able to. As I always like to give explanations on how/when I get the money and when it'll be in Paypal. As being transparent with the artist and explaining everything to them is something that I find they like. [15] We continue talking about the commission and not much else. [16] 28/12/2017 - 29/12/2017 He messages me again to make sure I'm still interested. [17] 30/12/2017 I pay the first payment. 30/100 USD. [18] The Invoice. [19] Him and I discuss when I'll be able to pay it all off/make another payment. [20] 12/1/2018 He asks for the rest of the commission payment, which I pay in full. [21] The Second Invoice. [22] 25/5/2018 - 23/12/2018 I ask how the commission is doing. To which he says he'll get me a wip soon almost a week later. I wait a few months, ask for the update he said he'd give me months prior. I wait 12 days before giving up waiting any longer. [23] I make a payment request through PayPal since I don't know what else to do. [24] Overall I kinda just feel crappy. I got a bad feeling once or twice around the time I was paying him. But I didn't listen to it because I always feel bad saying no and/or making people upset. I was just too naive and gullible. I am not sure if it'll get solved. If it does that's a plus. But I'd like this to be here as a warning. Do not commission someone if you get any sliver of a bad feeling. And please, be wary of people that come to you for a commission.
  3. I had almost the exact same interaction with them. Its always a sob story or an emergency.

Pseudo was kind enough to sketch a couple of examples for me to choose from, as I had no image references, and they even checked in with me after so long to ensure that my artwork had reached me safe and sound. I ordered a full-body traditional piece of a friend of mine. I asked her to tackle a subject she hadn't tried before (inflatable/shiny look). She sent several preliminary sketches and was more than happy to make minor corrections. The work was finished much quicker than most smaller pieces I have ever ordered, and it is in the mail on its way to me! I had an extremely pleasant experience with Korrok, and I would love to do business with her again. torikonero Jun. 18th, 2011 05:56 am (local) Zenithfoxie 2. http://www.furaffinity.net/user/zenithfoxie 3. 2-ish Weeks 4. I ordered a full-body portrait of a friend of mine, of his inflatable/pooltoy character (a subject I do not believe Zenithfoxie has much experience with). I gave her several pose options and let her pick what she was the most comfortable with. She sent me several preliminary sketches, and the final piece was finished very quickly. Zenithfoxie is quick, businesslike, and extremely pleasant to deal with! straychowchow Jun. 23rd, 2011 03:15 am (local) Re: Zenithfoxie Seconding this. I've commissioned zenithfoxie more times than any other artists (I have around 13 or 14 portraits, a reference sheet, and an icon by her) and every time she is sweet, pleasant, and just plain fantastic to work with. notorious_hunty Jun. 18th, 2011 07:03 am (local) Zambi 1. Zambi/Zambicandy 2. http://zambi.deviantart.com/ 3. About two weeks ago. 4. I waited so long to commission her! She happened to have still been open! I had her draw me a full-body color image of my OC, Mena Mynxxx. I explained her that I'd pay on payday, gave her references and details. Paid on Payday as promised! She sent me a sketch that wasn't quite right so I pointed them out and she fixed it no problem! She got the final piece done just yesterday! I love her portrayal of Mynxxx! When she was done, she had asked if she needed me to change her skin color, and would be willing to fix, but I told her it was fine! Her style is amazing, so I recommend commissioning her <3 http://img.photobucket.com/albums/v327/notorious_hunty/Mynxxxfinal.jpg notorious_hunty Jun. 18th, 2011 07:12 am (local) Wave-chan! 1. Wave/Irene Lee 2. http://suzuran.deviantart.com 3. 1-2 days 4. She had opened some cheap commissions including some chibis! I loved her meovel vs. catcom and Megaman Chibis so I just had to get one from her! ^_^ Communication was flawless and even got the sketch for me before I paid! Since it was a chibi, I didn't add too much detail, but forgot to ask what my character's relationship is with the canon character for a pose. I had explained it, but had no clue for a pose in particular, so I gave her some artistic freedom. There was a small error I pointed out, and she fixed it, no problem! And having done that.... http://img.photobucket.com/albums/v327/notorious_hunty/axlmynxx_col.jpg I'm really pleased with this piece, and so was she! ^_^ She had a lot of fun with it, which is what's the best part as a commissioning customer! Ordered earlier in the month, and waited in a queue. It was very short, considering how much work she had, and she was so polite and sweet by apologizing for the wait, when it really wasn't bad in any manner. 4. My frist ref sheet~ :D Based on a picture or two that I gave her, and maybe a short written description, she nailed Aunburian's look perfectly. I was taken aback by how perfectly she'd gotten my gryphonchica to look! So fast too, perhaps literally over night and it was done. And the artist is an absolute sweetheart to boot. Ive never had fun having quick, tiny chats with an artist like I did with her. Especially from such an incredibly talented artist, as they can come across as a bit intimidating at times, she was just amazing, and by the end I just wanted to give her a hug. haha http://www.furaffinity.net/view/5949168 unicorn_magic Jun. 21st, 2011 04:47 pm (local) hunter_san/weavermage 1. hunter_san/weavermage 2. I rarely commission other artists, because usually when I want something panned out on a canvas, I do it myself. However, I'm too busy with commissions atm to really produce something nice for myself. So I asked PurpleKecleon to do a Pokemon-themed picture for me. Waited for about a month, but the wait was worth it (I think she had a fairly large list anyway). Anywho, the picture she made for me was just eye-candy in all aspects. I actually found myself drawn towards the fire and the water more in the image then the characters themselves. Expensive commission, but worth every penny. Plus, she's very nice to boot. :) Picture can be found here(WARNING: NSFW): http://www.furaffinity.net/view/5910646/ straychowchow Jun. 23rd, 2011 03:21 am (local) SoulsPoison 1. (Deleted comment) tech_rex May. 31st, 2011 12:21 am (local) I checked through his gallery and my email account, sadly nothing. astralabortion May. 31st, 2011 12:52 am (local) Man, you are bloody lucky I checked LJ after stumbling home tonight. XD Here's the thing: I popped open FA after a near-three-month hiatus back on the 25th and poured through my notes, found yours - I do have your commission, inked, lying around here somewhere, but it's anyone's guess as to which pile of artwork it's in. I thought I'd have some spare time this weekend to sift around and find it, but that proved not to be the case. You've got a few options: 1). Give me a bit of time to sort through my paperwork and find the inked item; I'll scan it and pass it off to you to see if you feel it's worth me moving forward with completion. 2). I do recall this image not being something I was terribly happy with and had a much better idea a while after I first got to work on it. Another option is to give me a little while to whip out that other idea and go from there, though it seems we're well past the point of discussing revisions. 3). Take the full refund. Ball's in your court. I'll be cool with whatever you decide to do. ? fenrirs_child May. 31st, 2011 01:33 am (local) no offense, and i know this has nothing to do with me, but what's with the attitude? bloody lucky? it seems as if you're the one who's not been good with communication, so i think the hostility is far from warranted... astralabortion May. 31st, 2011 01:34 am (local) Would you like to commission me to draw you a custom infographic outlining how little I care about your opinion of my attitude? ? fenrirs_child May. 31st, 2011 01:40 am (local) no, but i'll enjoy the fact that your sarcasm and general abrasiveness will lose you many customers, as i'm sure i won't be the only one reading this here ;3 astralabortion May. 31st, 2011 01:46 am (local) ...you mean, I won't get to draw MORE contrived amalgams of some teenager's anguish over enduring a middle American suburbanite lifestyle? SAY IT AIN'T SO fenrirs_child May. 31st, 2011 01:50 am (local) hey man, your loss. you chose to take these commissions in the first place. if you didn't like the subject matter/commissioners/general audience of your work, perhaps you should have pursued a different hobby and source of income astralabortion May. 31st, 2011 01:56 am (local) Like what? Insider trading? ? fenrirs_child May. 31st, 2011 01:57 am (local) preferably something not customer service oriented. insider trading works fine for me ^^ astralabortion May. 31st, 2011 01:58 am (local) Then I'll see you at the height of the next investment banking scandal on CNN~ 8D oceandezignz May. 31st, 2011 02:07 am (local) I know you originally meant well, but please do not bite the bait next time. oceandezignz May. 31st, 2011 02:06 am (local) Be a little nicer while in this comm please. ducttapeninja May. 31st, 2011 05:47 am (local) Yeah, wow. At first glance of Astral's post I didn't see any attitude at all and thought that maybe Fenrir was overreacting. Then Astral kept replying... Thanks for posting this aware, Tech, and I really hope you get everything straightened out! sbneko May. 31st, 2011 11:23 am (local) Same here, I thought it was just a, how to explain, very buddy buddy way of talking rather then being rude, but then I saw the rest. conigliomannaro May. 31st, 2011 06:55 am (local) Funny, I didn't see any bad attitude in the first answer from the artist, and I briefly thought fenrirs_child was being too touchy, but the rest of the thread proved me wrong. If I was to say who took the bait, I'd say it wasn't the commissioner, but mostly the commissioner. By acting so rude he made clear his true colors. Good job in getting yourself a bad name, dude. Anyway, being things at this stage, I'd ask for a refund and be done with it. God knows I wouldn't want a picture from this person, not even for free. kadaria May. 31st, 2011 07:15 am (local) Checking the tags, it looks like nothing has changed about this artist be it the inability to deliver a product, communicate or type civilly. Notes and email should be enough to get someone's attention. Not hoping that they stumble upon an LJ post. ducttapeninja May. 31st, 2011 08:32 am (local) Yeah, that threw me off. The way Astral was like "Boy, you're lucky I logged onto my LJ and saw this! XD" it was like... What about emails and notes and stuff? You know, the stuff they really should be checking? Not exactly a brilliant idea to imply that the OP is "lucky" they logged onto LJ and saw the post, or they might have never tried to regain touch with them. ? (at least, that's how it came off to me, anyway) draken_art May. 31st, 2011 07:39 am (local) Hrmmn. See this is where knowing Exo personally comes in handy, as I read something entirely different in the text. Remember, what may /seem/ rude or not is how we read into it. Personally I thought that it was his normal sarcasm and wit coming through, and it can be can be sharp but humorous. Inside trader. HA! However, there is a time and place for such things, and often the internet is not one of them due to lack on context. *chuckles* *sighs* spdora May. 31st, 2011 07:44 am (local) Especially with a client, when money is involved, and professionalism is needed. That is certainly the place to drop the act. draken_art May. 31st, 2011 07:46 am (local) Agreed. Even when it is between friends, a little professionalism and tact can go a long way. likeshine May. 31st, 2011 10:09 am (local) i LOLed at the insider trading thing as well, actually nambroth May. 31st, 2011 05:09 pm (local) Yeah pretty much this comment is spot on. I know Exo to some extent and I read that as him being witty, but at the same time I recognize that society (agree or disagree, it is what it is) demands professionalism when dealing in business venues so, yes. There is a time and place. kairi_koitra May. 31st, 2011 08:58 am (local) Same I know exo personally. He isn't trying to come off as rude it's just his sarcastic way of doing things. Many times I think commissioners tend to neglect to look at artists journals and posts reading the normal way the communicate. Sometimes you'll often see commissioners complain about rude or nasty artists but yet at the same time this is how the artist has always been and acts. You can't fault a person for the way they normally are. He's like this with everyone this is exo being exo. He doesn't hide it nor does he try to sho it under the rug. While I can agree he took awhile to get back with the commissioner things happen. It's not an excuse nor does it mean I'm shaking his responcibility to do the work he was paid to do but artists are human to sometimes they forget things and sometimes life just gets in the way. Personally he owes me two works as well but i'm not sweating it he'll get to it when he gets to it. He's probably one of the most critical artists I know he critizies everything he does and redoes things twenty times and still isn't happy with it. But thats how he works he doesn't want to give a commissioner a steaming hot pile of penciled out *crap* but to give them something worth what they paid him to do. Which both he and the commissioner both will be happy. Thats the sign of a good artist and not just a wham bam thank ya mam artist. You get what you pay for. Yes this would entirely be better if he kept in contact more and he isn't even arguing that point but you guys are hanging him out to dry for an attitude that he's always had. That if the orignal commissioner would have read his journal posts or looked at his other ways of reacting to things should have been aware of as well. I'm not saying he's right in the way he act's Im saying he's acting in the way he always has. Tact and professionalism sometimes gets lost in a pile of paperwork. kadaria May. 31st, 2011 09:21 am (local) >Im saying he's acting in the way he always has< And it really hasn't done much for him in the past either if you check the tags where he uses the same attitude and even lies to a customer about a shipping date. Put aside for a moment that this artist is your friend and think about any other customer service job. -Do you think you would last in any of them if you were nasty and sarcastic to your customers? How would your manager respond when you were called on your bad attitude and you told her "That's just the person I am take it or leave it."? -What about if when customers paid you, instead of giving them what they bought you "forgot" about it and kept the money? Would they think you were a good, trustworthy person or a scammer? -How happy are customers when orders are lost, calls not returned or they feel "stiffed" from a deal? How does this look to other people who may be interested in commissioning you? If this keeps happening to him: >Tact and professionalism sometimes gets lost in a pile of paperwork< Then he really shouldn't be in any kind of customer service job, let alone art commissions which require discipline as well as good customer service to thrive. kairi_koitra May. 31st, 2011 09:43 am (local) Again your quoting the same thing he has other posts on here as well. did I in any way shape or form deny that he was wrong in his actions? No. I simply stated that its not only the artists responcibility to complete a piece of work it is also a responcibilty onto a commissioner to do research on an artist before giving them their hard earned money. A lot of commissioners would save themeselves a huge headache and ending up in this situation if they would research an artist before paying them. A friends word is great but using tools such as A_B is even better. Exo has more then one post on here about his habits and manners if people would take the time to read up before paying an artist to do a piece of work things like this wouldn't happen. They would know about his lack of emailing his bad attitude etc. Heck if they would have thumbbed through his journals etc on FA or LJ they would see he has an attitude problem. The point is that his bad attitude is everywhere all people have to do is do a bit of research and they can see it. If I'm going to go to a fancy resturant and spend hard earned money on a meal. I think I'm going to research where i'm going a bit to see if they live up to what i'm paying for. Everyone blames the artists for things but in the same light the commissioners should be held for lack of doing research as well. synatri May. 31st, 2011 09:52 am (local) ... What? So you're saying it's the commissioner's fault that they didn't realize that the artist is a douche before they commissioned him, so it's okay for him to be a douche? Really? hamburger May. 31st, 2011 09:57 am (local) No name-calling, please.
  6. I haven't gone to the bank, no. I have a very unhelpful one (even in cases of outright proven fraud) so i just have always dealt with paypal since they have always been reasonable. ive never had an issue with charge backs over the 180 days as long as i could prove i was owed what i was owed. but they had a new change i guess to their system so that essentially means im only getting it back if she sends it back unless i want to put more effort into it. and honestly as much as 40 dollars is a decent amount and i believe i should get it back, at this point i just want to have it closed and move on, because i'm kind of a pick your battles person and this just isnt worth expending more energy on fighting. i only made this post after finding out about several other things so i felt that it warranted bringing attention to this situation, in the hope that it can be a learning experience for others about keeping clear deadlines and expectations, and being aware of paypal policies, as well as hopefully a learning experience about managing expectations and responsibility for the artist because she does do lovely work I just think that she could be better in regard to her wait times and things like communication with individuals on deadlines, wips, that kinda thing.
  7. Foreword The Beware is labelled NSFW since some attached external links contain NSFW material, but no NSFW pictures will be directly embedded in the post itself. This Beware will be very long, so I decided to organize it into paragraphs to make it easier to understand what happened and how I uncovered the culprit since it's a crucial part of the required proof. Summary One of my Patrons has been re-uploading exclusive content from my Patreon page to the pirate site https://kemono.party/. He didn't have my consent, ne never asked for it nor did he ever tell me. When confronted he declared his act was deliberate. I am writing down this Beware to show, with all evidence I have, what happened to protect other artists like me from this user. Background I've been working with Castore93 for almost three years between Patreon rewards and commissions; I can say we've always been in good terms. He began supporting me through Patreon in November 2019 and as far as I know we never had any issue. (Proof screenshot below.) Kemono.party On January 13th, 2022 I came to know through a friend of mine the existance of kemono.party, an infamous pirate site collecting exclusive material from Patreon and other pay-to-view platforms like SubscribeStar. I sadly discovered my Patreon material was uploaded there too. I was determined to uncover who re-uploaded the material, but to do so I first needed to understand how kemono.party works and how they were able to get it in the first place. Kemono.party works by using a scraper, a piece of software which automatically parses webpages to collect data from them. In order to access protected content, the scraper needs some kind of access key. In the case of kemono.party, the scraper uses the session key from a Patreon account. This means that the user either volountarely gives the scraper access to their account's session key or the account is compromised. The upload happens automatically. Thus, the person responsible must have a Patreon account with access to my exclusive posts; either my account has been hacked or one of my Patrons has, volountarily or not, shared their session key. Finding the culprit My account couldn't have been hacked since I was able to see posts which weren't uploaded to kemono.party. I was fortunate enough to have exaclty three Patrons, all belonging to different tiers. The only way to identify the culprit would be posting a series of artworks limiting access to some specific tiers and seeing which of them would get reposted on kemono.party. I have three different tiers called "A precious gift", "Treasure" and "Jewel's waterfall". When posting a content on Patreon you can choose between some visibility options: You can make your post public so everyone can see it. You can make your post visible to "All patrons" regardless of their tier. You can make a post visible to one or more specific tiers. Selecting a lower tier only does not make the post visible to higher tiers. My three Patrons are Patron 1, Castore93 (Castore Devon on Patreon) and Patron 2. Patron 1 didn't join any tier, so they can only see "Public" and "All patrons" posts. Castore93 (Castore Devon) would be able to see "Public", "All patrons" and "Treasure" tier's posts. Patron 2 can see "Public", "All Patrons" and "Jewel's Waterfall" posts. After uploading each bait post I waited until I saw some of them appear on kemono.party. I made four bait posts: All Patron: it was a check to see if my content was stil being stolen. Selecting "A precious gift", "Treasure" and "Jewel's waterfall" tiers altogether. "Treasure" tier. "Jewel's waterfall" tier. Since nobody was part of the "A precious gift" tier it was no use testing it separately. Test no.1: all Patrons. It has been re-posted. My content was indeed still being stolen. Kemono.party post: https://kemono.party/patreon/user/14947257/post/60897241 Test no.2: All tiers altogether. It has been re-posted. This excludes Patron 1 since they weren't part of any tier, thus unable to see the post. Kemono.party post: https://kemono.party/patreon/user/14947257/post/61104826 Doublecheck. Kemono.party post: https://kemono.party/patreon/user/14947257/post/61286834 3. Selected tiers only: "Treasure" tier. It has been reposted. Kemono.party post: https://kemono.party/patreon/user/14947257/post/61287322 Doublecheck. Kemono.party post: https://kemono.party/patreon/user/14947257/post/61287443 4. Selected tiers only: "Jewel's waterfall". It hasn't been reposted. Check & doublecheck. This excludes Patron 2. Notice how the posts from the "Jewel's waterfall" tier were shared in between "Treasure" posts in order to exclude any time factor. The confrontation It was clear from all the data collected the culprit was the Patron from the "Treasure" tier, Catore93 aka Castore Devon. It was still possible his account had been hacked and he wasn't aware of the situation. So I opted for a neutral approach and he himself confirmed this wasn't the case... On January 20th, 2022 I confronted him. Translation from Italian: Me: Do you know this site? https://kemono.party/ Castore93: I go there sometimes. Me: You do realize this material comes from your account, right? Castore93: But theoretically I think the site uploads content only when you add it, not by itself. I did add some stuff in the past. Me: Do you knwo this is copyright infringment and illegal, right? Castore93: I am curious to understand how it shows it has taken the material without me uploading it. About uploading stuff from Patreon (when I did it some time ago) about that I would have a certain personal point of view, you're not wrong obviously. (SIC) Me: The site connects to your account's session cookie, uploading does not depend from you. In any case you can keep whatever point of view you want as long as my pay-to-view material remains visible only to those who paid for it. Castore93: Ok so one time is all it takes. Later that day I posted a public Patreon journal explaining the situation and how I will be sharing my contents from now on to avoid similar theft. This post too appeared on kemono.party (as you can see from the previous screenshots), meaning Castore93's session cookie was still active on kemono.party. Taking down the material I wish to add this part to show what kind of assholes arise from such events. After contacting Patreon to ask for advice, they suggested me to send a DMCA takedown request to the site which is the typical course of action. However, the criminals running the site ever so smugly responded with... excuses... even if the site has a "DMCA" page with instructios on how to send a DMCA takedown notice. I don't feel like letting them win. I am now in the process of researching my options to deal with the situation. I will try to give updates in the comments about this if I find anything which might be useful to everyone. Conclusion I lost a considerable amout of time dealing with the whole situation, which is amounted to a lot of frustration not to mention the damage of having copyrighted material posted around without authorization. Please be aware of this user.
  8. I commissioned Fen for a Vtuber bust model with Live2D rigging and 4 "emotions." I was originally quoted for $350, but I tipped enough to make it $500 because they'd just raised their prices after my initial sketch and I was impressed. After I paid the $100 deposit, it took more than the one week promised to get a sketch back, but progress was coming along in a relatively timely manner. Fen was initially good at getting back to me on Discord with WIPs and letting me know they were working on my model. The turnaround from sketch to full-color was surprisingly quick, but I was extremely happy with how everything was looking. My commission was essentially ready for Live2D rigging by the end of May, so I figured the whole thing could be ready at some point later that summer. Unfortunately, that quick pace did not carry over to the rest of the commission. After that May 31st WIP, I didn't get a single update for nearly 5 months. I knew they took commissions on other types of art and streaming assets, so I didn't mind at first. Eventually though, things just didn't seem right. I'd check their Trello regularly to see if gears were turning in the commission queue, and while there'd be new sketched here and there, the Finished Rigs list went stagnant through this whole time. The next update I got from Fen was at the end of October. I was afraid to ask for updates through Discord because their status was always Do Not Disturb, but I decided it had been more than long enough and I sucked it up. About a week and a half after I sent my message, I got WIPs back of the expressions I asked for. I actually hadn't noticed that the expression designs hadn't been done yet, but I was still pleased to get an update and know that my commission was still on the table. After that, it was back to radio silence for a month. By then, it had been 6 months since I paid off my invoice and I was still in "Ready to Rig" status. Especially being a Twitch streamer trying to plan overlays et al to fit with the model, I was growing even more impatient. I consulted a few friends on the matter and decided to ask for an estimated completion date. I was told December 15th at the latest. That didn't happen. In the meantime, it was apparent that Fen was doing Live2D work, just on other "quick completion" commissions that seemed to pop up out of nowhere. What added insult to injury was that they were promoting these simpler rigs with very little wait while I was still actively waiting for what I paid off in June. Then, when December 15th rolled around, they tweeted out that they were finishing a rig in just 24 hours. The next day, they were showing off a brand new rig for their partner. I lost my patience and asked to just take their PSD/CSP file so I could get someone else to rig it. No response. What happened after was a sticky situation. On December 21st, Fen's cat suddenly got sick and they had to take him to the emergency vet. The bill was steep and they said they couldn't afford it, so they needed donations and emergency commissions to cover the necessary treatments. Between this and the holidays, I knew I was in no position to ask for a refund, full or partial, even if I was still out $500 with nothing to show on my end. I again offered to just take my file as it was and go, eating my extra cost, but still no reply. Around New Year's, while all this was going on, Fen suddenly announced on Twitter that they'd finished two standard rigs that had been in the queue behind me. If it wasn't already, the writing was on the wall that I was being ghosted, so I gave them an ultimatum. As much as I didn't want to be the villain, if I couldn't get at least a basic reply, I threatened to file a chargeback. Within hours that same day, I finally got the CSP file with a lengthy apology. I thanked them and that was the last contact we've had with each other. I've since been in contact with a different artist who does Live2D rigging and I commissioned them to finish the model. They've been able to work the the Clip Studio file just fine. While I'm still happy with the design Fen was able to make for me, but between the uneven progress, lack of communication, confusing management of the commission queue, broken promises, and uncertainty that I'd get what I paid for, I certainly won't be working with them again and I can't recommend them to another streamer in good faith.
  9. To address concerns like this, the best action to take is to call Paypal directly and speak to a live representative. It is always in your best interests to be proactive and speak with them directly versus going through the automated systems.
  10. I'm a writer who is commissioned to write mostly growth/macro stories, and have been at it since 2013. In this time I've taken over 60 jobs which have all been read, approved and paid by every single client. My DeviantArt ToS: https://www.deviantart.com/blackspyro33/journal/Official-Terms-of-Service-for-Commissions-2021-485184088 I have always operated on an honor system with every single client. I don't set completion dates, I don't take advance payments. People read the final product, they tell me if they're happy with it or if they require alterations/additions, and then I get paid. I was first approached by Darkgai on September 10th, 2021, as the third slot in a queue of public commissions. Our correspondence was civil and well-mannered for the most part. Since Darkgai was the third in a queue of three and I don't work on multiple commissions at once, he was made to wait until I was done with the two before him. Unfortunately, circumstances forced me into my full-time job earlier in the year than I expected. All commissions were worked at at a slower pace. This led me to unusually higher waiting times, including Darkgai, who asked me about his commission. I decided to give him an update about why I was taking so long, since it's unusual for me to make a customer wait so long. Finally, at about 00:15 on December 31st, I sent the finished story to the client as explained in the ToS he had agreed to. Instructions were given, and I received critique and engaged in a minor dispute that I believed had reached a positive conclusion for us both. Thinking the issue resolved, I waited for three hours and found no evidence of the guy sending payment, and he has yet to reply to my last inquiry. As the (current) DeviantArt correspondence from earlier shows, visiting Darkgai's dA will show it as disabled. When I first saw it like that after 3 hours of radio silence I feared the worst. I made this person wait. I explained my situation. I delivered my agreed upon interpretation of his wishes. I saw dissatisfaction and attempted to find an alternative solution. We agreed on a price slash since he did not want modifications. He paid my time and effort with indifference and avoidance. I dedicated time and effort when I knew I couldn't instead of giving up to the pressure and finished a product that he allegedly found okay except for certain parts which I offered to touch up. Seeing as though our interpretations became irreconciliable, I decided to offer a hefty discount which is basically giving up my claim to time and effort I am not getting back to meet him somewhere I deemed appropriate. He told me he was going to pay me. He hasn't. He deleted his dA, and I take it as him avoiding me. I take it as him avoiding his responsibility to pay what he owes me for the story I wrote. I do not want anybody else to have to suffer through this annoyance ever again.
  11. from my experience on trying to get a refund from them, they always say next week or next paycheck but never send anything. every month I ask for a refund and everytime they respond its always "sorry I dont know what happened or ill send over the refund within the week" never happens though. Good luck with them I have been trying since last year all for just $34. its a matter of principle now
  12. Who: lrkcreations / NekkoMeneko When: November 25th, 2020 What: Plush commission ordered through Instagram of my character Baphomet Worth: 155$ Reason for Beware: Has gone a full year without giving me any wips, notifications, and keeps pushing back the turn around 'estimate' time of my order Proof of Purchase November 25th, 2020 I ordered a plushie on November 25th, 2020. This plush is a kuttari, something I have been interested in for a long time. I was excited to grab a slot for one of these as it's one of my favorite plush styles. We went through and discussed price, INCLUDING an estimated time frame. Which was late February. Everything got paid, except shipping, since that was in her tos. I also already knew she has a 1/3 deposit price, but was not aware that she considered the total price of my order as the full deposit. There was no confirmation that the $155 was going to be the deposit until after the transaction. February 6th, 2021 Throughout the time from November to February I received nothing. No hellos, check ins, notifications, nothing. During the time I had redrawn Baphs reference, changing only the art and not the design. So the design staid the same, there were no design changes. I decided to send a message back and notify them that there was a new, cleaner, reference sheet they could use since the old one was kinda ugly. It took them 10 days to respond to me, and after which I sent them the new reference. They messaged back 2 days later with a simple thank you. April 30th, 2021 I was kinda ancy and wanted to know a new time frame of when my order was going to be done. It was then she stated estimates were not set in stone. This was a shocker because all the plushies I have ordered from different artists all had due dates on when I would be receiving work in progress shots, and physical goods always have a turnaround time set. I thought I was going to get my plush in February since that was the original 'estimated' time. She also mentioned a list/queue, something that isn't public so I had no idea where I was in her queue, or if she even has a queue. I begrudgingly had to reply with a calm, great to hear, knowing I had to wait even longer for my order. September 25th, 2021 & Current I reached out again as a little nudge. To see if I could get things rolling, or even a wip. It takes them a good chunk of time to respond. Saying they have been late on their work, 'trying' to get caught up. There's nothing more I can say and just leave it at that. I decide to pop in a few weeks ago to see if I can get a glimpse of their 'queue', something that's apparently not public information for their clients. As of November 12th, 2021, I have received no reply. Radio silence. I decided to send a charge back dispute notice telling her she had until the 25th until I decided to take action and tell her about how this transaction was highly unprofessional. I have still yet to even hear back from her since November 12th / 21st. I do not plan to chase her around to her other accounts just to get a hold of her, she has shown me how unprofessional she is and it is not my responsibility to chase her around. They stopped being active on their instagram so I wanted to check and see if they were active on any of their other social medias they listed in their linktree on their profile. I began my little search their other social medias to see if they have been active anywhere else. I found they have been streaming on Twitch, as well as going under a new rebrand named, NekkoMeneko. Being incredibly active on Twitch, Twitter, and their Tictoc posting almost daily. As of now, I am waiting for the 25th to come around before I take action with Paypals buyer protection and file a dispute against her.
  13. It sounds like you got a bad rep, which unfortunately happens. Especially if you get assigned an international rep, which aren't always as versed in the ToS. Which line did you call, but more importantly which country are you using? The US agreement for instance spells out clearly no fees may be charged. https://www.paypal.com/us/webapps/mpp/ua/useragreement-full#accepting-payments
  14. It's always a good idea to have it stated in a TOS whether or not you allow your work to be used commercially Also, not telling an artist you plan to use their work commercially is skeevy at best. An artist does not lose/give up the rights to their work just because you paid them to make it. That's not how copyright works lmao
  15. Honestly the "English or not that's your job" line REALLY got my goat and made me angry. I've worked with many artists who don't speak English well and I would have never said something like that. It comes off as incredibly rude. Beware I think is well warranted for BOTH artist and client. The artist had poor response times and it seems is a non native English Speaker and our language is one of the more difficult ones to learn so I understand a bit how they might have gotten confused but to put a paying client aside for so long isn't a good sign. However the client deserves a beware as well! Be blunt about what you want from the start especially on a pre-posed image or YCH. Never ever make assumptions. A LOT of this I feel could have been avoided had the client simply said "I would like to make sure you are able to do this with my character as a feral and ONLY feral". It wasn't posted anywhere in the first note. Yes the gallery is all feral and so poor assumptions were made that it was OK for the artist to change it but had it been there POINT BLANK at the beginning...? Always state important factors even if it feels redundant because it's always better to be safe then to be sorry. I feel silly telling people to please draw one of My OCs with ears instead of big fluffy spikes because his main image leaves a lot to be guessed upon. It's one picture in his many image gallery BUT I care that much about it so it is MY job to make sure those drawing him know it's important to me they be done that way.

By the end of October, she had completed the dolls and shipped them. When they hadn't arrived by the end of January (she is in Canada and I am in the US so we thought maybe they got stuck in customs) she offered to remake the dolls for me and reship them for me as long as I covered the shipping costs. Even though this was neither party's fault that they got lost in the mail, she rectified the situation and provided me with two gorgeous dolls! Not only is her craftsmanship worth the money but she provides the customer service to go with it! I've been commissioning Katibara for small purchases here and there for over a year now, the last two this past February being the most recent. I find it very appealing that she works so fast with the references given and always does an amazing job with the characters. Lately, she's only been taking small commissions here and there via stream, so if you're looking for something quick and pretty for a really, really good price, try keeping an eye out for her stream commission advertisements. She's very polite, and makes sure that what she's working on is satisfactory, even if it's something like a $3.00 sketch. I've seen her make several changes to a single sketch for someone else at their request without a fuss. She's a real peach to work with and her customer service skills are stellar. The solo pic of Sh'sthress is a prime example of where she applied her experience as an artist to achieve the feeling I wanted for a piece; she took the rather generic pose idea I had and turned it into something much, much more than I had envisioned. At the moment, Taasla is working out the preliminary sketch for a trade piece with me, and I'm looking forward to seeing it! I love the whimsical quality of his work, and he is another artist who keeps excellent communication and feedback with his commissioners. I'm proud and pleased to say I have another piece of work in progress; he's doing the reference sheet for my newest character, and I'm very much looking forward to seeing the draft. The commissions I can talk about are crazy old, so we had to check our Paypal history: she has one payment from me on the 14th of July 2009,and has posted my first commission the twelve of that month and the second around the end of August. 4. Kyuume draws very expressive characters. Back when I commissioned her she was taking a batch of low detail cheaper commissions, plus it was over two years ago, so now both prices and style have changed and the ones I paid don't apply anymore; anyway, as you will see in the examples, she improved a lot in her art, and she's one of the very few people I would recommend for commissions (I think they're, like, 3 in total? I've had bad luck in my days). We're good friends, but from what I know she's pretty easy going even with strangers, does her job and does it well. Her basic price list now gives Head to waist, more detail, colour, shading, simple bg included: ONE CHAR: £19, TWO CHAR: £23 + £4 every extra char; Examples of her current work are here (can't see without an y!gal account) and here; the old commissions from 2 years ago are this one and this one. She has never drawn anthro but she's eager to learn, so she told me she's willing to give a discount for any anthro commission she gets, but she doesn't feel ready to draw anything 18+ themed yet. gingerligress Nov. 2nd, 2011 09:15 pm (local) Sepp 1. First off, the organizer of the contest had forgotten to mention the prizes from this artist, so it was a pleasant surprise to receive a note from Nilalkar. I was wanting one so badly and I was so happy to be her first Certified dachshund for her custom batches. :3 I told her I wanted one badly and if she would be willing to wait if I saved up the funds for the tag. She was very understanding and even let me buy it for $20 instead of $25 since I had inquired to her about one before she even started selling custom tags publicly so I was super grateful for that. She finished it in no time, sent me the badge file, a high res file of my character only, and an icon file. That was so freaking nice of her to do that! ❤️ Not done. She asked for my mailing address and I gave it to her and she shipped out my tag the next day. Once I got it in the mail, I was surprised to see that not only was there a tag, but ANOTHER COPY as well, and they both were laminated and had clips! AND, and there is another and, she included the original paper sketch as well! I was so speechless and happy that I got so many nice things from her. That was a great deal. Not only that, but she is by far one of the best artists I have ever had the pleasure of working with. She queried me for details about my character that NO artist had ever asked about. She researched my species and made sure each and every line and marking was accounted for before starting the work. Then, less than a week later, she was done. Everything was perfect. I did not expect her to begin working until I was paid in full but she told me she would have it done by the time I had the second payment sent. Man was she right. I got to be her first commissioner for her needlefelt work and I hope other people will commission her in the future because she was amazing to work with. She showed me so many progress shots and really kept me informed and updated on the progress of my item. If I had money to give her for true commissions I would (I actually got her a gift over the weekend as a thanks, and we doodle each others' fursonas all the time). She's pretty fast with her art and does an excellent job; she's extremely pleasant to work with and tends to be casual with communication but still keeps it professional. She's also recently started taking more furry commissions through FA but I'm not sure if she'd want me to post the account publicly (she wants to keep her DA and FA accounts separate for personal reasons) so I'd be more than happy to link it to anyone who's interested via PM. She specializes in dragons and just about all things scaley, though she doesn't put herself in a box. I would recommend her time and time again to anyone who fancies her style. Did so, and I didn't wait long for it. It came out beautifully: http://www.furaffinity.net/full/6020576/ I watched her stream this briefly before she had to stop from technical difficulties, and she created a realism sketch in less than 10 mins and was already drawing the strands of hair. She made it look so easy! O.O Definitely commission this person, she is really nice to talk to and she puts a lot of effort into her art, even if it's just an icon. The amount of detail she uses is near that of photorealism! 22. I've always liked their work, but ghosting you like this is terrible. 😕
  23. I commissioned Raver back in June 2019 for a bodysuit with indoor feet. Prices were discussed and the total came to $1050. I later added on custom shoes to go with the feet paws which was $150. Totaling now $1200. I had ask if a deadline of late Oct/Start of Nov as I had a convention later in Nov. He said he would try but he had a convention in July he was attending and would try getting it started in Aug. Over the rest of 2019, I had messaged him multiple times asking for updates which I was always met with excuses about illness or family matters. Which I understand life sometimes gets in the way so I let it slide. See screenshots below of all excuses also excuses from 2020. Now into 2020 I had asked a few more times for updates to which I was met with more excuses(See above). Then in March world wide lockdowns started to occur. I asked him if he would be working from home during the lockdown and he said he wouldn't be able to so I waited. Come April he mentioned on social media that he would be going back to work. One of his excuses was that my DTD wasn't suitable for use. He had waited almost a full year(April 2020) to tell me my DTD wasn't useable even though he had opened the box when he first got it and would've seen the issue with it(issue was I used cling film instead of a painters suit) Proof he opened the box when he first got it He claims that is his TOS it states 50% would be nonrefundable once work had started. Not once were his TOS sent to me nor were they anywhere on his profile for me to access. Only a small message at the start did he say "when I start 50% is non refundable" After a lot of back and forth I sent him a new DTD and had asked that my feetpaws be worked on while he waited on the new DTD Feetpaws were not worked out while he waited for the DTD. He then also had a surgery coming up. That was all he had to show, for almost a year. There's no confirming those are even meant to be mine, could easily be someone else's. I then asked for more updates in April and May. More excuses(attached above with excuses from 2019). I was rather upset at this point that I had waited almost a full year and nothing had been done. He then posted that he was selling a commission slot for a head piece that would be started in June. I messaged him rather upset explaining my disappointment that someone would have their piece worked on before mine was even started. On 19th of May 2020 after informing him of my disapproval of the lack of work, he decided to cancel my order and was only offering me a 50% refund. I tried going to both PayPal and my bank to see if they could help but because it had been so long either could do anything to help me. I also tried to get a lawyer but because he's in a different country from me(Scotland and Norway) they said it would cost more to get my money back. He tried to send me 50% refund but I didn't accept until I had spoken with my bank and PayPal but because both too so long to get back to me PayPal refunded the money Raver had sent back to him. I later requested the 50%($600) from Raver on 26th Oct 2020. Luckily he sent me the money. Raver has since said in a Instagram Live that he does only 30% nonrefundable deposit. I have since emailed him regarding this and he has agreed to refund me. I am now waiting on the rest that I am owed.
  24. Note that when this happens, their partner always spams their shouts, and then they begin advertising commissions through their account. They both seem to be keen on advertising new work, but not addressing the backlog. As much as they want to claim its a minor issue with the mods, they continued to make accounts to skirt their suspensions. This is just blatant disregard for site policy and its astonishing how cavalier they both are when she's getting shut down like this.
  25. Personally, I am of the mind that this should not have been refunded in full. An edit with the addition of the horns, yes. Possibly a partial refund at most, but not a full refund. The quality is not that far off from the other images so there is no problem with the grievance there. The difference in style is deceptive and makes one assume that the quality is different but it's the same. The artist clearly favors more semi-realistic and real stylized looks. The hair in the image has the strongest indication of the artist usual rendering, which would not have worked if applied to the rest of the body. And the slight wispy lining you see in the two examples would also not have worked if applied to the very specific stylization present in the OP's character. There is also rendering on the chest floof which you can see if you don't have a washed out or otherwise too-bright monitor. If anything, it seems the artist may have had some difficulty adapting to the very stylized and over-large eyed look of the OP's character. At worst the artist misjudged their ability to pull off the look when agreeing to take on the commission. As I stated before, the worst of this boils down to not sending the OP any WIP or making any indication that the commission in question would not have any form of WIP. But even with that in mind, receiving a full refund over such minor errors feels more like robbery at this point. A note for future reference, not just in this case specifically, but any other, if you're about to commission an artist you see something very specific in an artist's gallery you would like them to emulate in a commission of yours, point out that specific piece to them and express this. You know your refs, you know what to look for, all artists do not have the same 'short hand' for rendering textures and render types and will not always interpret it the way you may have imagined it in your head. Pointing out something explicit 'This character's look is really close to how I'd like mine to look' or 'the way you did this short fur on this would be perfect', at the start of the commission can bridge some of gaps of misinterpretation. (and yes WIP will always fix a lot of this but, pointing out stuff like this can still help)
