Someone pointed me to this on Twitter, and what's more likely is that they used a CC they didn't have authorization to use or spent a lot of money and have buyer's remorse. Either way various banks have ways of filing chargebacks, and all of them require you to either fill out a form or contact someone. So it's definitely not out of nowhere, a "glitch", or an "accident".

Please don't! We only accept character theft posts if it is the exact same character, and aren't here to judge how similar characters are to each other.

Caution: Voregence - unprofessional conduct
James commented on Rionquosue's record in Artist Cautions
It was asked to be excluded by us because the telegram chat in question had a lot of third parties in it, and we were unsure of the level of privacy this chat had or has. It isn't anything different than the journal other than other users and the artist calling the OP names. OP was never directly named. The artist called OP an "idiot". The artist was frustrated that the PayPal dispute could put their account in jeopardy due to the no adult rule for paypal. Edit: refreshed myself on the chat, so it's more accurate now. -

I'm curious what part of what the artist said was false, and when did they publicly name you? Slander (in this case libel as it"s written) is not "someone said things I don't like about me". It's specifically "someone said something directly about me that is false to specifically financially harm me." As a moderator it's our job to be as impartial as possible, but nothing the artist has said is libel. You attempted to gain the entirety of the amount back, and you most certainly are not entitled to that. Also 26 hours is still a short amount of time. She's right. Not everyone is available constantly or consistently. I've easily pulled 16 hr shifts at work and can take longer than 26 hours to respond. -

Yes it was originally submitted as a beware, but we downgraded it. There's no way this qualifies for a beware. The like feature is disabled for mods, but I'm in full agreement with Armaina. -

This is one of those weird ones where I personally see what you indicated in your reference sheet, but can also see how the second fix would be debatable. I would definitely suggest making a close up detail shot of those as a quick go through of your gallery shows that it's done in a variety of different ways. -
Should I create a new topic for each customer? And "when"?
James replied to BlackRoom's topic in Site Questions
Howdy! 1. Yes you should make a new post for every customer. Their name will go in the Topic Title, and all of their working names will go in the tags section. See the artist section for examples: https://artistsbeware.info/forums/forum/18-artist-positive-reviews/ Now that your client has a thread, anyone else who has had a good experience with them can come in and "second" your post with their own positive review. 2. There is no time frame! Each positive review is going to be unique to you. The purpose of this site is for users to make informed choices on who to do business with. So if a client has had numerous good reviews, but maybe earned one bad one later, people can read and decide for themselves if this person is someone they want to work with. If ever you feel like you need to retract a positive review you've made because of a chargeback scenario, that's ok! Contact any member of staff, and we will pull it. -

What you've already mentioned throws up a number of red flags. If you want to wait more, I don't suggest waiting much longer. I'd say you're well within your right to request a refund (and force if needed) if the deadline is very close to approaching.
-
Worried... should I just wait more?
James replied to wickchlorite's topic in Advice for Commissioners
They've delivered two personal deadlines and let it slide twice. At this point an ultimatum of a time limit for delivery should be considered. If they don't deliver in the time frame (two weeks?) then a refund should be warranted. -

Hiya. It's stated in multiple places that we do not delete posts ever. It would defeat the purpose of our archives. Posts are marked as resolved.

A post has been hidden because it appears to contain personal information. As a note we do not allow irl names. If there is definite proof the artist goes under different names, feel free to contact one (1) moderator with absolute proof it's the same person. Proof includes: - Same images - Same public emails - A public notice the account is a side account. Unacceptable proof is: - "Same style"

Hiya this is something only staff can answer when looking at it in the queue with your proof supplied. If you feel it is something others should know about please submit.
-
Ultimately it's their right to block whoever they want, and choose not to do business with whoever they want. I don't see it as unnecessary personally.

This comment is being approved so we can publicly state that we do have internal proof via our rejected archives that you two are the same individual. Trunch submitted it, but it was asked to be withheld because the person you're commenting to can't consent to being included on a beware.

Cknsausage is correct. You can pull the character from them and resell it/ retrade it at any time. Especially if they're going to ignore you on this trade.

Are these ToS clauses red flags, or am I just overreacting?
James replied to BaronVonClop's topic in ToS Talks
I'd personally consider it a bit overkill to hand over something drastically lower res, but I'm assuming it's to prevent someone from swiping the image and printing it. I'm assuming they're not handling you something pixellated to the end of the world and back, and it's just... way tiny right? If it is full of JPG pixels and weird, then I'd call that an oddity. I work in 3000 x 4000 pixels and will hand over 900 x 1200 for uploading to FurAffinity. -
Are these ToS clauses red flags, or am I just overreacting?
James replied to BaronVonClop's topic in ToS Talks
I'll just go ahead and address them as bullet points: That's not necessarily wrong, but you're still within your right to cancel as per Paypal. There's nothing wrong with this on the surface. It really comes down to how they're applying this rush fee. Like if everyone is in indefinite limbo until you pay the rush fee, then it's unethical. If the rush fee is paid, and the artist works on your piece on what would otherwise be off hours to get it done sooner then that's fine. Red flag. All artists should have public queues. Nothing wrong with this. Distribution rights are held by the artist, and many folks ask the high res remain private. For the refunds section: That's a no, and unenforceable as per Paypal. That's also a no, and unenforceable as per Paypal. No, the art isn't "yours". You do not own any of the copyrights, nor are they transferred by default in a commission. However in the terms of this fandom is generally understood that if the client cancels they get a partial refund and get to "keep" the art for personal use. Maybe this part of their ToS is worded weird, but I would interpret this as you aren't allowed to take it to another artist for completion, aka it's not "yours" in a copyright sense. That's their prerogative, and there's nothing inherently wrong with carrying a blacklist. I personally blacklist individuals I see being rude to other artists. (If they're rude to someone else, they'll likely be rude to me too.) However, the lack of a definite break down of how partial refunds are dished out is also a red flag. Your question is something only a moderator can answer when we are looking at your post in queue with all of the proof. If nothing has been done so far simply file the claim (not dispute) and move on before you lose your money. -
Out of the Blue Creations / Finley the Turncoat
James commented on Alex Wright's record in Artist Bewares
The most recent comment was hidden simply because it's not particularly good advice legally. This situation is more of a civil matter than a criminal one, but Alex has privileges to see hidden comments so it's his decision to follow through.- 36 comments
