  1. This has been my first bad experience in the world of commissions and I hope this will be the last beware I will have to share here. Everything began on 17th April 2018; I had started taking commissions some months before, so I was reeeeally naive about it and my English skills were terrible as well, so I apologize for the horrible grammar in my messages. At that time I didn't have any Terms of Service yet, but I had already started working with FyreDraygg (we are two artists working together. I keep public relations) I was in a Telegram Network made up of several channels where artists can show their price sheets and find clients; buyers can send requests in order to find the right artist for their needs. I saw this user requesting a couple of dragon designs (that's my field of specialty), so I contacted them. We started chatting and they seemed quite interested, so I asked them all the information I required to give them an initial quote to see if it was fine for them. They accepted and explicitly stated they were fine with the price; they sent me a lot of references and details about how they wanted the two pictures. Important for later: they asked us to complete this work very quickly. I told them that payment must be fulfilled after seeing the sketch. Initially I made a sketch, but wasn't very convinced about how it turned out: when I work with the kind of buyers I call "yes-men", meaning people who accept everything you show them without ever having any critique or preference to share, I try to use my personal taste to improve the quality of the work to a level I find at least acceptable. Thus, after talking to FyreDraygg, we made a second design and showed it to them. They (unsurprisingly) liked it and everything was still fine. After that, I pointed out that payment was then due. It was a very big order for me at the time and my queue was full, so I decided to proceed with lineart and coloring even if payment hadn't been received yet. (That was my fault, I know, and I've learned to avoid doing this, but this is besides the point of my beware) Then we asked for an email address to send the invoice to, they provided it and sent the invoice. After some days we kindly pushed them for payment, especially since they had asked us to be quick at the beginning and we wanted to complete this order asap. As I explained in a previous post, I believe that when a commission is placed, the buyer is responsible for setting the required funds aside so as to be always ready for payment, especially after confirming they can afford it. I was very annoyed, but kept this to myself. Eventually, no payment was received and we had to canceled the commission. I wasn't as professional as I'm trying to be now and I didn't have a lot of patience, I know, but this was already the umpteenth person who thought it's ok to be paying late for a commission they themselves rushed, because apparently it's fine to push the artist for work but heaven forbid having to pay on time. After all of this went down, this person sent another request on the market channel I first found them in, asking for another kind of work. Thus, I sent these screenshots to the admins of the channel and the user vanished from Telegram, deleting their account; so I don't have any information besides the old username and the Telegram id (I use Plus Messenger and ids are public) Username: @What_even_0 id: 429774297 
  2. Glad to see that you know your rights! They could *try* to take you to court, but they would not be successful. For one, their TOS does not supersede copyright law. For two, you can't sue someone for breaching a contract they were never even told about. Technically, if you want to get into it, he still owes you for the sketch, since he was the one that cancelled, but it ain't worth the hassle. Hopefully you can find someone to resell it to, since it's a pretty generic "fluffly dragon" design.

Hi there~ This is my first post on here, so sorry if I don't do everything right ;0; Just had a pretty intense interaction with a buyer, so I'd like to warn anyone who may come into contact with him. I contacted EylonFerrousa on Telegram after he had made several posts in a few chats we shared looking for an artist to draw his dragon character. His budget was $40 and I was willing to work with that. I generally do commissions differently than most (this experience has made me change my methods, however); I usually try to complete the sketch before requiring payment, so after receiving a text description of the dragon he wanted drawn, I got to work and made a few sketches with minimal tweaking. Once I had gotten it to a point that I thought would be good enough to go forward with, I sent it to him but didn't receive any response for well over a week. I sent a quick "hey just checking in" message, and he informed me that some things had come up and he needed to cancel the commission. No biggie, life happens, and I totally understand ? I said as much, but mentioned that because I had spent quite a long time on that sketch, I would probably recycle the pose to fit one of my dragon characters that I had been meaning to draw (I would not be stealing his character, just using the pose and anatomy that I had spent around an hour perfecting on his dragon to make drawing mine go quicker) He was irked by this, saying that he'd rather I not reuse it, since he would be using the sketch. After I insisted that he did not own that sketch since he had not paid for it, he responded, saying that in his ToS (apparently commissioners have ToS's? I haven't heard of this) he claims that all art drawn for him belongs exclusively to him, whether he's paid for it or not. This alone is something you can't enforce, as artists own the art that they draw, especially art that hasn't been paid for, but prior to this, the idea of him having a ToS was never brought up, mentioned, or linked to. If he really did have such a ridiculous condition in his ToS, this should have been the first thing brought up. He then proceeded to go on a bit of a tirade, claiming that if I did anything to that piece, he would have full grounds to sue me, and he ensured me that I "didn't want a lawsuit on my hands." I responded, practically refuting everything he said, and I promptly blocked him. I have the entire chat screenshotted (good thing too, because he nuked the chat as soon as I replied to his lawsuit threats), but the only truly important parts are the end where things got heated, and I'll put my response in there as well just for a little closure. I'll include them below, but if any more info is requested, I'd be more than happy to provide it. I'll also put in the original message he had sent when looking for artists to draw his dragon, as well as the sketch of the dragon I completed as proof that I had done the work in the first place. Unfortunately, I seem to have missed the text he sent me after his long tirade about suing me; he made sure to mention that he had business to attend to with the CEO of Hasbro (an obvious scare tactic, and a poor one at that).
  4. If it adds to it any... someone I know had been in contact with him for two years. He promised to promote them and ended up getting free NSFW art from them. Everything mentioned above about him pushing for more things than what was originally asked for was what he did to them. So in defense of this person, I called him out on it, and from that point he said he could use the chat as proof and ruin me and my business in the fandom. Followed up with how my "Dutch Angel Dragon" was almost a copy of his character because 'ear tufts' {My character had black ear tips, not tufts}. Then he said without his help, or any other 'popufur', that my friend and I would never amount to anything or get any recognition in the fandom.

Kwallie was eager to accept the commission, and $20 was sent to her Paypal and received on February 16, 2012. Upon payment, I asked her to have it done within the following week (week of Feb. 16-23). After the note had been sent on FA, I received no further word from her, both on FA and DA. No notes were opened on either site. Since she provided her real name, I found her Facebook and politely asked for updates on my commission, since there was no communication on either site, and her Facebook is active (see updated Facebook). To this date, I have received no communication from her at all, and she continues to update her Facebook status and page frequently.

My mate Zaelgolin had previously gotten a badge from this artist a year before through an FA commission and liked it a lot, so he recommended I get one as well. I agreed, and requested a half-body double-sided digital badge of my dragon character Sabre. Onnanoko quoted the price as being ($140.00 USD), which I agreed to, and paid for at her table using Paypal using a Square reader extension on her cellphone. I mentioned that I did not know exactly what I wanted at the time of purchase, and asked if I was able to view her FA gallery once I got home from the con to try to formulate my idea. Onnanoko said this was OK, and recommended I contact her on Telegram once I was ready. I grabbed a business card from her, saw the Paypal receipt come through on my iPhone mail, and I was on my way. Here is a picture of the business card I have from Onnanoko placed with original items I am the only owner of (artist's email address redacted). On March 9th, 2017, I first established contact with Onnanoko on Telegram after creating a Telegram account and installing the desktop program. I confirmed the purchase details and explained that I would like to view all her posted art first while I thought of an idea, which she was OK with. On May 22nd, 2017, I re-established contact with Onnanoko on Telegram after viewing all of her posted art on FA and really enjoying it. The conversation with friendly and cordial, but unfortunately this would be the last time she would ever contact me (unbeknownst to me). There was a lot of friendly chit-chat about her artwork that I was complimenting in the middle of this conversation, so I have only supplied the beginning and end of the conversation in my screenshots. This is where I officially provided my detailed request. In all fairness, since I took a while to do this, I consider the clock starting from May 22, 2017, and not January 13, 2017 when my payment was made. This was just due to me being busy with work, life, and other things. I was in no rush to get the commission and was willing to wait patiently. Onnanoko explained that she would be busy with BLFC2017 upcoming, and to contact her after the convention sometime. On August 13, 2017, I sent Onnanoko another message on Telegram asking for a friendly timeline update. Unlike my last message, Onnanoko never read the message and no response was ever received. On September 25, 2017, I sent Onnanoko another message on Telegram after not hearing anything for 6 weeks. Again, Onnanoko never read the message and no response was ever received. On December 30, 2017, I had visited Onnanoko's FA page again and noticed that several previous commissioners all had posted "Shouts" on her page all asking for status updates from years prior, as they were not getting any communication back from her despite having their commissions paid-in-full. I then sent Onnanoko an email to her posted Commissions/Paypal email on her FA page stating with the final warning that I intend to open a Artist Beware post and Paypal Dispute if I do not receive some type of response within 1 week. A week came and passed with no response given. This was really disappointing, as I really did not want to have to resort to going through with this. This is likely the reason why I took an extra 363 days to follow through on my threat, because I really didn't want to have to go through the effort to do so, as well as all the negativity surrounding it. However, with Further Confusion 2019 less than 2 weeks away, I felt it was my moral obligation to warn others about the risk of giving this artist any money. Admittedly, I did not yet perform the official Paypal dispute that I threatened to do in my final email. This I feel is a bit drastic, and I would first like to try the Artist_Beware route in the search for a resolution. On September 4, 2018, Onnanoko updated her Trello page and fraudulently claimed my commission was finished by moving my commission from a "Queue" status to "Completed" status. It was actually a friend of mine that first noticed the status change, and asked me if they could see what she did. The truth is that I received no contact of any sort from Onnanoko since May 22, 2017. The fact that Onnanoko was starting to fabricate work completions that were never even started was particularly disturbing. And today, January 5, 2019, I finally followed through on my Artist_Beware posting, just 1-day short of a full calendar year after my communicated deadline. The artist has ruined the working relationship with me so much that a full refund of the ($140.00 USD) I paid her is the only resolution I will accept at this point. EXPLAIN: I will say in advanced I do not have as much proof of all of this as I'd like, we used to talk over notes for previous commissions but after she invited me to her Discord server we talked over Discord DM's. I never had her added as a friend on there since I could just DM her because I was in her server. While this was going on I had closed our DM conversation by accident as I close ones I am not currently using and only found out about her jumping ship after I went to message her and noticed she removed me from her server (or just deleted it all together.) I cannot open our DM's unless she is a friend or I know her ID which I do not. Everything below is mostly written from memory with rough date estimates. I used to commission Under a lot and didn't have that many issues outside of her being very slow with commissions (From personal experience and dates I had noticed on her public Trello from other people commissioning her). Recently I had commissioned her for a reference of my persona and she did a really amazing job (I did end up paying her extra money to rush it though as I wanted it done soon) so when I saw she was steadily posting journals talking about how she was desperate for money and opening for emergency commissions I felt bad and had messaged her asking her if I could commission her to do a dragon-taur rendition of my persona. She said she had never drawn one before but she could try. I told her that if it was too hard for her and she ended up not liking it she could scrap it and chose another one of my characters to draw instead. She agreed, I linked her my characters to chose from if stuff went wrong and we exchanged details. She had been posting a lot of journals still talking about how she needed money and posting YCH's. She was having a hard time selling this one YCH commission I liked a lot but I didn't have the money for. She had reduced it from 100 down to 80 before removing it later, and I ended up messaging her to ask if it sold. She told me no that she didn't think anyone was interested so she just removed her. I asked her if she could hold it till next pay period and she agreed. She told me I could either pay the reduced price or more but it was my choice and I met her in the middle and sent 90$ About a month later she gives me an extremely rough sketch (basically just the body roughly sketched and the top half being the anatomy skeleton shapes) I approved it and she went quiet. I didn't hear much from her but kept an eye on her journals. She majorly had journals over the next few months talking about breaking up with her ex, losing her job, getting a new job, family problems etc. She kept taking on more commissions, even doing in-stream ones and not really working on her others. Sometime in October I noticed the chargeback date was coming close and given her history with being slow on commissions and noticing how bad she "needed money" I was worried that she wouldn't get my commission done for a while and messaged her telling her I was sorry and I felt like an asshole but that I had to put my foot down despite knowing everything she was going through but I was going to be needed a refund. She messaged me telling me that she understood and that I wasn't an asshole but that since she had no money it would be a while, but if I gave her another month she would get the art done. I told her I loved her artwork and wouldn't mind waiting but if it went further than that I would have to go down the refund route, she said she understood and we went on. (My mistake as I should have started the dispute then) Occasionally she'd send me a message telling me she would work on my comm soon, and halfway through the time she started working on the YCH and sent me a sketch. It barely had any work added to it, basically just went over the already drawn outlines and reduced the characters breast size (something I had asked as my character is supposed to have small breast and the YCH by default had large ones) I approved it and she went silent once again. The date for a month had come and gone, I even gave her a few days longer just in case before I went to Paypal to open a case, I knew I was already too late for the first commission but thought I still had a day or two for the second one (I opened both anyways) and Paypal automatically declined them because of them being outside the date. I knew the only hope I'd get my money back was if I messaged her so I went and messaged her telling her I would need a refund. She said that she thought I would at least give her "till the end of the month" (when I asked for a refund the month before it was midway through the month, not at the end) and that she didn't have the funds but would give me a refund when she could. Not too soon later I saw she had uploaded a journal saying she would be refunding EVERYONE on her queue and that she was depressed and no longer felt like drawing so she felt this would be easier. She said she would be looking at how much she owed everyone and would post how much she owed everyone on a public list. She also started "spamming" her TH trying to sell her characters for refunds. A few days later she posted a journal stating that someone had forced chargebacked her and she was in the negative so refunds would take longer. Halfway through December, she sent me a message saying she would be able to give me at least a partial refund in January and I told her I was happy she was keeping me updated and thanked her. She had also moved her refund list to her profile info. 12/30/2018: I was going through my Discord servers and noticed that hers was no longer on my list. I had a sinking feeling and went to check her FA and sure enough, it's disabled. I tried all kinds of methods to try to find our closed chat to no avail, I remembered a user that used to be a friend of hers/ on the refund list so I decided to message them and see if they knew anything/ at least knew her Discord ID so I find our messages. 12/31/2018: I woke up to a message from the said friend and they said they were pretty sure she deleted her discord as it no longer showed them as friends anymore and that she wasn't answering her text but if they found out anything they'd let me know. Before I could respond they then sent me another one saying that Under had blocked them on everything, including Twitter and Instagram and that it was heartbreaking as they were best friends. So I'm pretty sure Under has completely jumped ship. (I have these notes still if screencaps are needed but since it was kinda personal I didn't feel comfortable/ thinking it would be allowed) I saw that her TH was still active so I left a shout telling her I was appalled and that I would be writing an AB/ trying to go through my bank. I'm very upset with her and myself as I knew better than to let it go outside the chargeback date but I did it anyway. I'm thinking about contacting my bank to see if there is anything that can be done from other transactions I've had with her but even then it won't add up to the amount she owes me.

After the first pic was completed on Feb. 16th, Ideas were given for the backgrounds of the second, third, and fourth pics. The second pic was proposed finished on March 30th and a small edit was requested added to the pic. The second and third pics were completed and delivered on April 2nd. After that I received no contact from Sarcatsic at all, despite sending her one note a month asking for an update on the final pic. She received and read my notes and comments but never answered me back. By July I was beginning to get a bit aggravated at being completely ignored so I left a shout on her page, as well as a comment in a journal she posted advertising commissions. Still no word came from Sarcatsic until October 9th where she claimed that the receipt she has only shows that I paid for three pics, so three was all she did. I was surprised that she replied at all, but to have such a blatant lie told annoyed me to no end. So I posted a screen shot of my own receipt, showing that I had paid her in full for all four pics, and told her that just because she “believed” me to have only paid for three pics, it doesn’t explain why I’ve been ignored all these months. She replies simply “That's not what mine say, but whatever, here. Take it.” Now in truth I could have left it alone there, but I did not like the pic I was given. As patient as I had been. I did not feel I deserved a half assed pic thrown at me to get me off of her case. But instead of complaining further, I ask for a simple edit. I asked that the eyes and grin of the shadow be added into the pic. She doesn’t respond, and after four days I send her a polite thank you for honoring the arrangement and doing the pic for me. But I also tell her that the wait and being ignored for months was unacceptable and that I’d be posting an A_B against her for these things. She responds with a spiteful note telling me how ungrateful and unprofessional a person and commissioner I am, how I never treated her with any respect, and how I asked for edit after edit to the pics she did for me. She was very understanding and even let me buy it for $20 instead of $25 since I had inquired to her about one before she even started selling custom tags publicly so I was super grateful for that. I gave him the choice betwen two characters I'd like to see his take on, and he chose a character named Lazarus. He said the commission would be done at the end of December, and though it was not completed by then, I was not irked. In January I receieved a phonecall from a friend who was visiting Exo, asking a question about my character's breasts (they're prostetics) as a sketch was being worked on with my friend helping, my response was they could be anything, including weapons. I could hear Exo inthe background saying he loved the character design, so still I had no worries. Friend updated me later through AIM saying that I'll really like the finished product. I have yet to see the sketch. From mid to end 2010 I had several RL issues pop up so that commission in paticular was one of the last things on my mind, as well as working on several commissions of my own having difficulties finishing them, I felt it would be hyprocrisy poking Exo. In February 2011 I felt things been straightened out enough, so I emailed Exodite on the 27th with an inquiry seeing if he still remembered my commission. He has since taken commissions in the form of ACEO cards and had a list of people whose commissions he was working on, but I was not included in the list and progess being made on these commissions, but not mine. At this point all I wanted to know was that he had not forgotten about my commission. At the time he appeared to have had steady internet connection (enough to have a livestream on the 4th of March), but I still did not recieve a response. He has mentioned he is slow to respond to emails, so I waited before finally noting him on FA on March 24th wanting to see either the sketch and be placed on his list or recieve a refund. At this point I was a little irked. I realized he had not been active since the 15th of March, checking his LJ (on his FA profile) showed that the last time he was active on LJ was also the 15th of March. So I felt I like jumped the gun, and decided I'll wait, since he has lost connection before but has had people contact his commissioners and the lack of internet may have just been temporary. I was working on a A_B article looking for a way to contact him when Exodite reappeared on FA. As of May 25th my note was read, but was not responded to. I emailed and noted Exodite a second time on May 27th. In both the email and note were effectively the same, except I pasted the paypal receipt (minus my name and address) in the note. I have recieved no response, but he appears to be active on FA. Proof: The Paypal Reciept: 1st email stating when he was aiming to get the commission done: 1st Email I sent him in February: Note sent on the 24th of March, I messed up the dates of the commission. The note was read, but no response. He did post a journal about a live stream and was responding to comments, and faving art so I noted/emailed him a second time. Note/Email2, sent on the 27th of May, the ony different being I included the paypal receipt in the note. I made a grammatical error, he did not respond to the first note, I left out "not". : EXPLAIN: I commissioned Exodite through suggestion of a friend who had done previous business with him, and he needed some help out and was selling lineart. At the time I was looking for a Christmas present for myself in the form of a traditional piece, and I was interested in coloring said lineart . I learned some huge lessons as a result of this. I gave Exodite the same treatment I have given previous artists I have commissioned. I should have spoken up and noted him when he started taking ACEO card commissions and ask to be put on his list then rather than waiting months down the road, reguardless of what I felt emotionally then. I tried contacting him through email since that is where the initial transaction took place, then tried notes, then notes and email. I felt two days was decent enough time for him to respond, especially given he had read one note and knew I was concerned about my commission status. I tried to be straightforward and let him know I wasn't happy. I held off repeatedly writing up an A_B article in some hope this could be settled privately. EDIT: Issue has been sorted out and refund has been recieved :B

May. 23rd, 2011 at 4:22 PM jakejynx It's ridiculous that I have to make this post over something so simple, but this person has stopped responding to my emails, and has ignored the Paypal claim that I filed. On May 5, I posted a journal asking if anyone had some sparkle furs on hand that they would be willing to sell. Evilalcarne responded saying she could sell me some lime green fur. I paid $10 for the half yard of fur and $10 for shipping on May 7. She responded the same day, saying the fur would be shipped out on Monday. On Tuesday, May 10, I sent an email asking for the tracking number. She told me that she had stopped by the post office that day, but that her mother had the tracking number, since she was the one who went to the post office. On May 13, I sent an email asking for the tracking number again so that I could be home to receive the package. I received no response. On Monday, May 16, I sent another email telling her I was getting worried. Shipping from FL to GA takes two days at most. Even parcel post is a quick ship. I once again asked for the tracking number. She responded with "it's around here somewhere." And that was the last message I received from her. I sent a final stern email on Friday, May 20 telling her that I expected either the tracking number or a refund by the end of the day on Saturday, or I would be filing a Paypal claim. I received no response. A Paypal claim was filed late Saturday night, and it was not responded to. Today I escalated it to a claim, and I'm fairly confident that I will receive a refund, given that she is apparently unable to show proof that the fur was shipped. Please avoid transactions with this person. Communication is spotty, and she apparently can't be bothered to give you the tracking code on packages. Update: The fur actually arrived today via UPS. However, according to the tracking number on the package, it wasn't mailed off until May 20. That's 10 days after she claimed it had been mailed. Though I sincerely doubt it was $10 to ship, considering it weighs only 11 ounces, the UPS shipping calculator is apparently down right now, so I'm unable to get a price estimate. As if that weren't bad enough, when I opened the box, I quickly realized that it was not the half yard that I had bought. She sent me an 18x18 piece of fur (a half yard would have been an 18x65" piece). That's something like 1/8 of a yard, not 1/2. I know it was not a misunderstanding, since she included a note in the box saying "here is the 1/2 yard of fur." I can't help but think that she purposely sent me ~1/8 yard, and just assumed I wouldn't know what 1/2 a yard looks like. ? Fur 1 Fur 2 And this may be nitpicky, but on her site she has a picture posted of her dog lying in the exact same fur that she sent to me. Though I'm not allergic to dogs, the fur was going to be used on tails that could be sold to people who are allergic. I don't use furs that have been used as animal beds. After discussion that I wanted a fursuit head, he told me to send him an email with exactly what I wanted, so he could have it on file. He told me in the voice chat that he realistically wouldn’t have time to work on it until October of that year, and told me to send him half of the payment to start work on the head, and half when it was completed. The emails linked previously then occurred, payment was sent. I then did not hear for a while. October came and went with no contact from him. He told me his email was acting up, and said that he sent me a few other emails, which I never received.
