  • Beware: Dumas

    takane
    • Who: Dumas
      Where: https://www.furaffinity.net/user/dumas~/
      When: 04/25/2019
      What: Commission
      NSFW Content Resolved

The incident happened shortly after I joined furaffinity. I was very naive and decided to unconditionally trust my first ever commissioner...
All the attached files must be read from the bottom. Pay attention to dates. Also sorry I'm not good at expressing my thoughts in english (。・・。)

Proof that the 1st commission was done:

Proof that the 2nd commission was done:

    Discussing the 3rd commission:

proof that the 3rd commission was done
Before drawing it I asked about payment for the first 2 arts but Dumas wasn't very willing to pay

    hnn4.thumb.png.8ac649322e02f08bb1981261d76bc427.png

And this is me trying to get my money but constantly being ignored...

    hnn5.thumb.png.30627babfc483298bfb5665c3d69d6bb.png

In the next image all the white is too personal where Dumas is yet again writes excuses why he can't pay
This is the last ever note he sent me claiming that I harass!!! him for demanding payment and threatening to contact paypal.
If you're just planning to start taking commissions please don't make my mistake of working without being paid first

That is absolutely awful, I'm sorry that was your first commissioning experience. I'm not saying stoop to their level but maybe slightly editing each piece and calling them orginal pieces with your orginal characters, in case they post it as well you could say you remade the piece because they stole money from you and don't own the art, hence it's art theft. It might make you feel you feel a bit better. That client is definitely deserving of such behaviour for how they treated you.

I agree with this; you should consider repurposing the art you have done to reduce losses on your end ♥

You would not be stooping to their level by doing this though, because you are the artist and thus retain all rights to your artwork. If they have not paid for your services rendered, they forfeit that art entirely and you are more than within your rights to repurpose it. Either as a personal thing or turn it into a YCH you can sell on ♥ I personally would do the latter to help with the lost time and money.

On their overall behaviour though -- I don't even know what to say? I want to say life happens, but their attitude and excuses put a sour taste in my mouth. Their unwillingness to pay you for your work done, their attitude towards you, as well as their threat to report you to Paypal for wanting to be paid is beyond disgusting and have earned them a preemptive block from me.

My only advice would be what you have already said though - up front or at least a half & half system is much safer. I wish you the very best, and thank you for this beware ♥

Threatening to inform PayPal of NSFW content. That is one of, if not the, biggest no-no for a commissioner to do. We need PayPal in order to run our livelihood as there is currently no competitors willing to fund adult businesses.

This earns a rare preemptive block.

Also if he did actually do that, and that happened to you. This would spread so fast that the commissioner would end up getting blacklisted by so many artists as well as have his name in the mud.

Something does seem a bit off about their 'threat'. If they threaten you with reporting NSFW content, then they would end up putting their own account in jeopardy as well (as Dumas~ is the one who ordered the NSFW content).

Also, posting the situation here is well-warranted (not wanting to pay, threats, ect).

PayPal only punishes merchant accounts for selling stuff against TOS as far as we've seen.

Wow, that's absolutely awful. Going to also preemptively block them and warn my NSFW artist friends about this user. Sorry that happened, I hope you're able to repurpose the art or recoup your losses somehow.

Then that means it's a real possibility a commissioner could use that as a threat for anything. Are there any other alternatives to paypal that actually allows adult artwork?

Quoting from https://www.paypal.com/us/smarthelp/article/what-is-paypal’s-policy-on-transactions-that-involve-sexually-oriented-goods-and-services-faq569 (since it is in their FAQ's)

    Quote

We don’t permit PayPal account holders to buy or sell:

Sexually oriented digital goods or content delivered through a digital medium. Downloadable pictures or videos and website subscriptions are examples of digital goods.

If this holds true, then Dumas~ puts himself at risk as well for trying to buy it. Whether or not Paypal enforces it is a different matter, but I'm just specifying this because of Paypal could just as easily use this mention against both of them if Dumas~ ever reported it and takane brought the evidence forward that Dumas~ was intending to buy such material.

I honestly would just re purpose the art as YCHs/etc. to recoup loss and forbid them from using the art in any way.

This just screams the impression that even if they DO get around to paying, they're just going to turn around and chargeback it at some point.
