The artist is one that Dante harassed in the past, and they saw through the new account right away. He has left his FA account and has promised not to contact me since July 3rd. PROOF: I will put with the explanation, to hopefully help you follow better. EXPLAIN: For the past few months, Dante has been annoying me. He was a bit annoying during my pantsu icon raffle, where he kept mentioning that his birthday was soon after the raffle ended. I just assume most people wouldn't mention it at all if they didn't want to put pressure on the artist. May 31st, after the raffle had ended, he noted me. I was completely confused at first at what he was asking for, but after clarification, he was breaking one of the rules of my TOS: I must be paid before work. Here he's trying to order a commission and promising to pay later because right now he doesn't have a paypal: http://i296.photobucket.com/albums/mm177/Loveless_Neko3/attemptatfreecommission.png I don't have screen shots of this because the shout got bumped off my page (I only felt the need to make this article after tonight, so all caps are recent), but in it he asked if he could commission me for a pantsu icon, even though they were journal only. The fact that he was aware of it, and wanted one even though he had no paypal, really stung me bad. July 19th, after I had answered someone else's question about my future pricing on reference sheets, he comes to the deluxe reference sheet I did for my fursona and commented: http://i296.photobucket.com/albums/mm177/Loveless_Neko3/reffsheetalltogether.jpg I put him on my blacklist then. He's the first and hopefully the last. June 22nd, he came to my page and apologized. But at this point I was more than fed up with his whining. Today, July 3rd, I posted a journal opening up my pantsu icons again. He came in, whining about how he wanted one but he was on the blacklist. But I was unaware of weather I had to have actual, money exchanging business to post him on here (I couldn't really find anything about it on here, sorry if it was somewhere and I didn't realize) so I made a journal on FA asking for advice. Here's how the journal basically went (black boxes used to hide screenames and conversations not relevant to the situation, also screenshot thanks to someone on FA. He wiped his account, and I'm making this post. I hope people can watch out for him, because this was not the best experience.

No refund clauses before the art is 100% finished are unenforcable so long as the client is able to file a chargeback. It's a huge red flag, because it implies that their queue is a mile long, and clients demanding refunds may be common. It's a beware well warranted.

I've been doing commissions since 2008, and have never had a "price sheet". ¯\_(ツ)_/¯ I'm just so confused about how this client has treated you. They've blatantly misunderstood you, admitted to being impaired (high), but followed through with the chargeback anyway?

For clarification purposes this was an Iron Artist slot. We ended up finding the ad for it on our own. https://www.furaffinity.net/view/35115002/ Also link 1 is what the client provided as references. So this was a situation where the character was made anthro by the artist on their own.

I'm sure another mod will leave a better, more detailed comment. I'll just say that if you're dealing with anyone who is ESL, the worst thing you can do is use slang and long messages. It's clear in some of the messages the artist was struggling to comprehend what you wanted, and they even requested time to have someone help them. Also, your prompt doesn't match up from what the similar image you handed over as a reference was. Was the original image closer to this? The fixed sketches were very nice, and fairly close to the ref image. (The third one is my favorite.)

Have they said anything since? If you wanted to chase it up you can say that you please need them to respond so you can finish the commission, otherwise you'll take their silence as acceptance as the image as is. "Hello! I'm just following up since I've noticed you've seen the changes but haven't responded. Is everything looking good? I'm afraid that if these long lapses in contact continue I'm going to have to consider the commission completed."

Venmo is not for business purposes as per their Terms of Service. Cashapp doesn't have buyer protection, however if you're using it for adoptables only it's fairly low risk for your customers. Technically Venmo is too, but I'm personally unaware of any repercussions for using Venmo's services for business. Neither option works internationally as a heads up. (Though you didn't ask. Many don't know this.)

Yea, refunding would be best for both parties in this instance. No, we wouldn't accept a post that's about a personal disagreement. Choosing to block someone is a personal choice. If they somehow try and escalate the situation then we would review it. -
Oh yikes. Nothing is more stress inducing than getting a response like that. My instincts would also lean towards something being wrong. You can either deliver those links, or if you're willing to make changes or hear out the client you could open the door for them to talk to you. Something like "Hey! I've noticed my messages keep being read. I just want to check in and ensure everything is ok before I drop in the links?"

Am I fair for denying use of my intellectual property?

I have no advice on the legalities, but I do have thoughts on the usage of your character: Without context it can be difficult to assess how out of the blue this was, but going strictly off of your text, I'd be hurt too. I've had a single long term RP partner since I was 14 years old. (I'm 34 now, and said RP partner is my husband.) I'd be deeply hurt if he considered using my main OC for such a public project without talking to me. Just in a general level that kind of a project would bring all sorts of levels of excitement. This is seeing your characters come to life! This is seeing a story that's previously existed in a private(ish?) setting come to a public setting. Whether or not you choose to license the use of your character or not, take into account what might happen to them if this project takes off. Would you be ok with that? Some comic creators hated seeing some shipping art of their characters, but had to give up because of the sheer amount of it and the tenacity of the fans. Can you handle that? -

Sounds like a typical reuse for a YCH, which isn't bad. Moat of us would recoup losses in this way.

How old is this individual? I'm concerned that you almost got into contract with a minor. An adult should understand the difference between reposting work that doesnt belong to them and archiving their continued harassment.

It might be time to get in contact with Instagram's abuse team. It's pretty obnoxious as a whole that they don't have the ability to report block evasion outright, but you can file a report with them.

Just as an aside, the OP's main language isn't English. It was an artistic liberty commission where the studio would be given a loose prompt to follow, and the resulting character they made would be made into the suit. In this case, they were handed a mood board and the rest was up to the studio to design. Technically, the character was made by them with limited input from the client. Kind of like if you or me were handed a colourlovers swatch guide and "dog" as a prompt and the rest was left up to us to design. Hopefully that helps clear up any confusion about what the commission was!

Also, yes, we've seen the journal on Aisha's page. She's welcome to call us whatever names she wants in her own personal space. There's no need to send us any more messages about it. 🙂 The lying, however, is not appreciated. We have not censored you, and have allowed you to come and speak your side as well as accuse your client of withholding information to make himself look better. Even though you've conveniently done the same in your own space. The exact same conversation that you submitted to us is submitted here. When you contacted me privately about the contents of this post, I offered to you to comment anything that you'd like to contest publicly. So long as you followed our rules. You can be as petulant as you want in your personal space, but I will not tolerate lying. If you want to claim we've censored you, that's your business. But I assure you the same response you got now would have been the same regardless if your post made it through or not. The server admins of the Discord that originally kicked you out even agreed, and we have no idea who these people are. I hope you reflect on how you've behaved in the future, and take something out of this.
