She was doing a sale on sketches so I thought I'd get a few, if I recall she was having money issues. I contacted her a little bit after her sale, on July 11th by note, and she accepted. I sent her payment a few days later, and she got to work. Not too long after, I got the first sketch from her, and was very pleased with it. She said she'd work on the next ones soon, so I waited. I didn't use MSN much, which was one of the only ways to contact her, but I tried to sign on every once in awhile to see if she had anything new. I never managed to get online at the same time she did, so I dropped her a DA note to see if she would see it and reply. It took her awhile, but she got back to me, saying she had 2 more sketches, and would give them to me that night when she scanned them. I got online and poked her, and she gave me 2 sketches, I was pleased with them. I trusted she was going to finish the others at this point, so I gave her some time. I tried to pop on MSN now and then, to see if she had anything for me. I never saw her online again after that. I had just figured she wasn't around when I was, so I tried to shoot her a DA note. No reply. Eventually, she made a journal saying that anyone who commissioned her should note her to remind her of what they had gotten so she could finish it ASAP. Alright. I noted her again. No reply. Pretty sure she at least read it. I was kinda upset at this point, still popped on MSN now and then to see if she was there, nothing. I eventually found out she had moved accounts, and didn't even tell me, as well as I assume anyone else who commissioned her. Turns out she had become a pony artist, and had her own ask blog on Tumblr, AskPalette-Swap. I was pretty upset, it's probably one of the worst things a commissioner can do is change accounts and not tell people who paid you. Doing that just seems like you're fleeing. After I found out who she was, saw she had been posting quite a bit to her ask blog, I noticed her name pop up on Skype, in which I promptly IMed her, asking about things. She took awhile to reply, but she finally did, and apologised. She said she had the rough sketches, and that she would even draw some pictures, full color, of my pony to make up for the wait. I was pleased to hear this. She said she was sick, but would show me the pics later in the night after she woke up from a nap. Later that night, I got no message. I waited for a week or so, I figure I'd give her time to heal from being sick. But I heard nothing from her, at all. But I noticed one thing, she kept posting to her ask blog just fine. Drawing or streaming every day. I was incredibly upset at this point. I tried so hard to get to her, I even consider her a friend, I know her from a long time ago. And she just treats me like this. It doesn't seem like she cared at all about getting things done, which is weird. She had worked so fast before. I ended up sending her a few messages on skype again, one asking for an update. Sent it at around 5 PM, no reply. Noticed at around 1 AM she posted a picture to her pony blog. IMed her again. No reply, so I sent her a message letting her know how I feel. Took her forever to reply, but she did, saying she was sorry and would work on the pics soon. I eventually got 2 of the last promised pics, but I'm still waiting on one, which apaprently just needs some color. I keep waiting, trying to contact her on skype, and on tumblr, no replies, ever. I'm pretty sure she's ignoring me, since I see her change her skype icon quite a bit. To add to the frustration, she opened up MORE commissions on her pony blog, and even finishes them before mine. She even draws things for 4chan. It's frustrating, this honestly has to be the most frustrating commissioner I have ever had to deal with. I try my hardest to keep in contact, and be polite, but I just can't deal with this anymore. Is it really that hard to just finish the work? She said she just had to color it. And refuses to stay in contact with me or reply to me. So I'm posting this here. It's just upset me so much, especially since she used to be so good at delivering art. I tried to be nice since she's a friend, but I don't want to be treated like this. u_u I wouldn't have been so bothered if I just got an update. I've waited pretty long for commissions but it doesn't bug me as much as long as the person stays in contact so I know they don't just run off. I'll probably get the last pic eventually, but I feel this attitude towards commissioners is uncalled for.-

Feeling worried that I was being blown off, I sent a second poke that night, this time voicing my concerns, this is where the situation escalates; 1.) Despite being taken back, and a bit insulted, I tried to approach the situation as civil as possible. I decided there, by her attitude and failure to deliver initially, that I wanted a full refund, as I had not even used the character anyways. She accused me of shorting her on an (unrelated) refund issued recently. I tried to explain a bit of why the payments ere either cents or a few dollars short (paypal fee.) She refunded me in full (17 usd) then on the note of "Fine I sent it back now leave me alone." Although I was refunded in full after a bit of negotiating, I feel her behavior and attitude alone warrants a beware here. Very off putting in a transaction. PROOF: (See above section.) EXPLAIN: A year ago maoria posted the commission journal shown above. I decided to commission some pictures and noted her on FA. She was friendly and responsive at first, as this note with history shows, and was even willing to ship from the UK to the US: After I sent her payment, she abruptly cut off communication. After a few weeks, I noted her again about the commissions and received this bizarre response. After some time with no further communication, I messaged her several times but received no response (even though the FA note system indicated they had been read or at least deleted). Finally, I told her that I'd open a trouble ticket on her if she did not respond. Naturally, she didn't, so I did, though that got me nowhere. Her account was fairly inactive for many months. Recently, however, she has made a return and has even started taking commissions again. I noted her about mine. When the first few were ignored, I noted her again and found she had blocked my account. She's posted a "to-do" list of commissions, which I am of course not on. Emails to the accounts she has listed on her FA account yield no response either.

She accepted and not long after she sent me a link to a partially completed portion of the picture I had requested. The picture she sent me showed the torso and legs of one character, and just a scrap of the other one, though she explained that she had been busy and had not had time to work on the art that much. Some months passed, and I sent her a note on Fur Affinity, asking about the status of my commission. When she did not answer, I succeeded in locating her DeviantArt account and I sent her a note there, again asking after the status of my commission. She answered me back and explained the circumstances behind her absence. In the note, she offered to give me a refund, and I refused, preferring that she should finish my commission instead. This was in February of 2012. I have not heard from her since, and there has been no visible activity on either her FA account or her DeviantArt account since I commissioned her. I have sent her two more notes on DeviantArt, one at the start of May and one at the start of June, and neither have been answered or, so far as I can see, even read.

No refund clauses before the art is 100% finished are unenforcable so long as the client is able to file a chargeback. It's a huge red flag, because it implies that their queue is a mile long, and clients demanding refunds may be common. It's a beware well warranted.

I've been doing commissions since 2008, and have never had a "price sheet". ¯\_(ツ)_/¯ I'm just so confused about how this client has treated you. They've blatantly misunderstood you, admitted to being impaired (high), but followed through with the chargeback anyway?

For clarification purposes this was an Iron Artist slot. We ended up finding the ad for it on our own. https://www.furaffinity.net/view/35115002/ Also link 1 is what the client provided as references. So this was a situation where the character was made anthro by the artist on their own.

I'm sure another mod will leave a better, more detailed comment. I'll just say that if you're dealing with anyone who is ESL, the worst thing you can do is use slang and long messages. It's clear in some of the messages the artist was struggling to comprehend what you wanted, and they even requested time to have someone help them. Also, your prompt doesn't match up from what the similar image you handed over as a reference was. Was the original image closer to this? The fixed sketches were very nice, and fairly close to the ref image. (The third one is my favorite.)

Have they said anything since? If you wanted to chase it up you can say that you please need them to respond so you can finish the commission, otherwise you'll take their silence as acceptance as the image as is. "Hello! I'm just following up since I've noticed you've seen the changes but haven't responded. Is everything looking good? I'm afraid that if these long lapses in contact continue I'm going to have to consider the commission completed."

Venmo is not for business purposes as per their Terms of Service. Cashapp doesn't have buyer protection, however if you're using it for adoptables only it's fairly low risk for your customers. Technically Venmo is too, but I'm personally unaware of any repercussions for using Venmo's services for business. Neither option works internationally as a heads up. (Though you didn't ask. Many don't know this.)

Yea, refunding would be best for both parties in this instance. No, we wouldn't accept a post that's about a personal disagreement. Choosing to block someone is a personal choice. If they somehow try and escalate the situation then we would review it. -
Oh yikes. Nothing is more stress inducing than getting a response like that. My instincts would also lean towards something being wrong. You can either deliver those links, or if you're willing to make changes or hear out the client you could open the door for them to talk to you. Something like "Hey! I've noticed my messages keep being read. I just want to check in and ensure everything is ok before I drop in the links?"

Am I fair for denying use of my intellectual property?

I have no advice on the legalities, but I do have thoughts on the usage of your character: Without context it can be difficult to assess how out of the blue this was, but going strictly off of your text, I'd be hurt too. I've had a single long term RP partner since I was 14 years old. (I'm 34 now, and said RP partner is my husband.) I'd be deeply hurt if he considered using my main OC for such a public project without talking to me. Just in a general level that kind of a project would bring all sorts of levels of excitement. This is seeing your characters come to life! This is seeing a story that's previously existed in a private(ish?) setting come to a public setting. Whether or not you choose to license the use of your character or not, take into account what might happen to them if this project takes off. Would you be ok with that? Some comic creators hated seeing some shipping art of their characters, but had to give up because of the sheer amount of it and the tenacity of the fans. Can you handle that? -

Sounds like a typical reuse for a YCH, which isn't bad. Moat of us would recoup losses in this way.

How old is this individual? I'm concerned that you almost got into contract with a minor. An adult should understand the difference between reposting work that doesnt belong to them and archiving their continued harassment.
