Up to 25 July 2017, we made small talk and discussed design details. After that point, nothing until September. (Proof 5.) During this period of silence between July and September, the artist continues outputting adopts and YCH sales. 19 September 2017: I update the artist's reference links to a neater folder. (Proof 6.) The artist replies, but there is still no visual WIP update. September 2017 - November 2017: No further updates. Artist continues uploading adopts and YCH sales. 26 November 2017: There is still no update. I request an update or, alternatively, a refund. The artist finally shows a visual WIP, but cannot provide a refund at the moment. (Proof 7. Proof 8. Proof 9.) 27 November 2017 - 1 December 2017: The artist seems genuinely apologetic during our conversation. I relent and agree to wait for the finished product. This is a mistake. (Proof 10. (Proof 13.) 22 January 2018: The artist posts another completed adopt. 22 January 2018: The artist replies with an update message. No visual updates. This is the last time this artist has contacted me since. (Proof 14.) 24 January 2018: The artist posts another completed adopt. 4 February 2018: The artist posts another completed adopt. This is the latest activity on the DA page. But not the Tumblr page. Will detail below. 25 February 2018: I ask for another update. (Proof 15.) No response. Unread. (Proof 16. [Bottom note.]) March 2018: While the artist remains inactive and unresponsive on DA, the Tumblr page notes a recently liked post from another user. (Proof 17. [NSFW has been blurred out. Safe to click.]) This recently liked post was made on 3 March 2018. The artist has been able to access the internet sometime after 3 March 2018. (A more thorough search through recent likes on the Tumblr page show liked posts from as recent as 2 April 2018. I did not notice this until recently, but will add it chronologically for easier following. 12 March 2018: I ask for another update. No response. Unread. (Proof 18. Proof 19. [Middle note.]) 29 March 2018: I leave a comment on the original deviation of the custom sale. No response. (Proof 20.) 31 March 2018: I message the artist on DA again. (Proof 21. Proof 22. [Top note.]) Unread. 3 May 2018: I leave the artist a courtesy message on the artist's DA profile stating my intentions to write a PSA on Artists Beware. (Proof 23.) There is still no response. I also have not seen any of the YCH sales completed and posted, but cannot verify that they were never done. Given the circumstances, I am aware that if the artist's main income is through art, then regular output of sales and adopts is to be expected while the artist works on a commission. This was never the problem. The problem was the lack of communication and continued lack of communication. As it stands, I have no finished product and the artist either refuses to get in touch or has neglected to for whatever reason. The real lesson here is to never let an artist drag you past PayPal's 6-month buyer protection period, regardless of their reasoning, unless they have solid communication and steady visual updates. Don't make my mistake. 12 May 2018: I managed to open a dispute with PayPal through their phone line. 17 May 2018: PayPal opens the case and awaits a response from the artist. Myself (and a friend of mine) bought the chibi plushie badges. With quick excitement the arrangement was made and everything went fine. I do not have the details of the transaction occurring due to a personal issue and deleting everything. However, I did receive a digital copy of my work completed before that and had approved the image as the image itself is not an issue. In fact, I deeply love the image (link 1). Once I received the badge in the mail I was to preoccupied with personal life so it took me a few days to be able to actually look it over. At this time I hadn't been online and disabled my main account to keep myself from going on and stressing myself. I noticed there were two (animal) hairs in the lamination. One near the front-most ear and on her dress (link 2 and link 3). So, I logged into my OLD account and proceeded to message them at my earliest convenience that I have received the badge but displeased with the fact there was two hairs inside my badge that were noticeable to the point of unable to enjoy my badge (link 4). They asked to see the images which I happily obliged. An issue occurred and imgur didn't want to link the two images together to be sent. There I sent them separately for them to be able to see (link 5). They acknowledge the first hair and apologized for it. However, what next threw me for a loop. They only offered a $4 USD refund or a $5 OFF next commission purchase. I was shocked and a bit almost upset as I didn't want a refund or a discount. Just wanted my badge fixed (link 6). I sent another image with the second hair with a zoom (link 7). So, understanding that markers cost money I offered with a bit more of a discount to have them just re-draw the image or if they could re-do the lamination. I wasn't expecting anything free just a bit more in the way of compensation for artist error this can be seen in link 6 of our discussion. Instead they tell me that they cannot offer more and I have the scanned version and just to print it out myself and links of this discussion can be seen in link 6 and link 7 as well. I don't own a printer and if I printed it out I would have to pay for it via a store. I explained to them that not only would it cost me money to print it out but to laminate it. As well I wouldn't be able to get the holographic version as I do not have the means to do so. That a $4 refund was not enough for damages made to my card. As well the quality of a print out version was not what I paid $22 dollars for. I made it a note that I feel this is not fair to me (link 8). Their reply was more that beware worthy on my end. They told me I have the artwork (ruined by animal hair, mind you) and the digital file. That my $22 paid was enough to cover that and to be happy as it was a good deal. As well they just blew me off and says just not to work with them again. They also made a comment of "feel free to do the work I had to do to find the overlay and make the work to your own standards" (link 8). I was devastated and with that attitude I felt they were not going to give me any sort of compensation. Luckily, I was able to go to paypal and force a partial refund of $8 USD as my friend told me I should have pushed for half all I wanted was my picture redone. This was never about the money and in fact I offered more just to have it fixed properly. Explanation: I ordered a pair of feet from Fuzzworks. Its been damn near impossible to get a hold of them. They also jam pack their schedule and do a lot of trades with others and constantly travel to cons. After poking Darby a few times I made a beware on Facebook, which turned into a storm of white knights and Darby asking me to remove the post. I did, hoping I would finally get some process on my feet and nothing. I then asked Darby to make the feet for Furnal Equinox and then I can just pick them up there from her to make things easier on her part. I also ordered a Bandana from her, which she never shipped and I had to pick up from FE as well. I'm still currently waiting on a refund and it's been over 2 weeks since she said she would refund me. Fuzzworks has a history of bad customer service and not giving their clients updates. People were telling me its normal to wait almost a year for products from them or no communication. Do not commission these people. They are constantly asking for trades too, which they don't even have time to do with how stacked they are with commissions. They also made a post once they offered the refund that I "canceled" my slot. Explain: On December 17th, 2017, I purchased a piece of art from Adiago over voice in her Discord. The piece was supposed to be four other characters and myself. While I don't know how much the other people paid, I paid a lump sum of $195, which I know was the most out of the group. The money was for all of our characters to be in a Chinese New Years themed, cell shaded commission. Between purchasing my slot and writing this post, I have been blocked from all forms of communication by Adiago, and no WIPs or any updates have been given to me by her or any of her trusted contacts. The commission was added to her "To Do List" on February 1st, 2018. This is the only progress that has been made on it thus far. The date of writing this is March 14th, 2018. (Pictures below) A friend of mine went out of his way to contact Adiago directly, and the response I received in her Picarto stream was "tell Kat if he does a chargeback ill post him to artists beware. where thousands of people will see it." When someone in stream asked what this was about, she responded "someones trying to be a D-bag and if they do it ill ruin them and no one will ever draw for them again". These were posted publicly for all in her stream to see. (Pictures below) This is the first time I have ever decided to go through a charge back. I would have liked to work things out with the artist, but at this time the artist is refusing to speak with me. I have no way of contacting them myself, and at this point I just want to post this and be done with it. I am currently in the process of trying to get my money back, and writing this due to it being a bad experience. From my understanding, this is not the first time something like this has been written about the artist. I paid for work, the work was never finished, and now I want my money back. That's the short of it. Please note, all commission details were worked out in voice in Discord. Adiago and I had a good business relationship, and this is how most of our transactions took place. The only details of the commission are shown below in her "To Do List". In this situation, Adiago had not started my commission at this point, and had me blocked on all her places of contact. Adiago has taken this issue out of the realm of professionalism and made it into something personal. I would like to make the community aware of this unprofessional behavior, and ask to please take caution when considering purchasing art from Adiago. This is the first issue I have ever had with the artist when it comes to buying art, but the situation has quickly escalated into something I would like to be no part of. She told me right then on the spot she would have it done by MAY of the same year guaranteed. So here I am, a FULL YEAR later and haven't got even one image of at least a part of it done. I had her on telegram since the day I walked out of that DDen and I've messaged her many times asking for updates and I was always either told some story (Whether you choose to believe it or not isn't my problem, she had AMPLE time prior to that shit) or I was simply ignored. (The classic two checkmarks but no response) So here I am, finally making this post because any normal individual would. At this point I don't even care if I get it anymore. I ordered a pre-made head that came with a tail and custom paws, the maker was very eager for the sale and replied very quickly on FA notes until I payed via PayPal. [FA Notes screenshot] A couple of days later something happened in my personal life that meant I had a large bill to pay for, as things hadn’t been shipped yet and I hadn’t been told that the paws had started being made or received other notes so I tried to cancel the order. To which I didn’t receive a response for another few days, and was ultimately told that they had spent all of the money on new equipment as soon as they received it and don’t have any money to refund me. [FA Notes screenshots] We went back and forth in notes a few times before I was told that the paws couldn’t be refunded since they were custom and so was the tail, even though the tail was in the listing to begin with and there had been no photos of the paws sent to me to show they have been completed. [Telegram screenshots] I reminded them the tail was from stock and therefore not bespoke to me and then I still had the paws sent out to me since the quality of their work seemed excellent. There were no photos taken of paws that were sent to me at all, additionally I was told that they had been sent by priority mail. [Telegram screenshots] Up to this point I had been told a few times that they were having bad weather pretty much seemed to be on a daily basis that didn’t allow them to check emails/telegram/notes etc. I had also been told to contact them on Telegram as it was their preferred method and then after not replying to me for a long time they said they preferred email and would definitely respond within 48 hours which they didn’t unless it affected them monetarily later on in the year. [Telegram screenshots] I originally bought the partial, and ultimately just the paws, for CFZ17, but they never showed even after the delivery time frame was weeks in the past, remember it was supposed to be priority mail. I asked the maker to contact the delivery company about it and the maker waited weeks until they eventually did and told me that we had to wait until half way through July before a claim could be made for a lost parcel. [Telegram screenshots] July came and went after I sent a number of messages to no response, which is around about the time they changed their mind and said to email them since they no longer like Telegram. Time passes and I still hadn’t received a response from the maker so I filed a PayPal case on them since they wouldn’t refund me or respond to me after numerous attempts to reach out to them. [Telegram screenshots] I had an message effectively calling me a scammer and saying I was damaging the business and she couldn’t pay me anyways even if I won the case [Telegram screenshots] After a few messages they eventually agreed to pay part of the money owed to me, but not the full amount. [Telegram screenshots] I was however promised once more that they were going to sell some pre-made heads to be able to refund me the final amount due to me. On the same day that this was resolved Fuu had said they'd send me the completed laminated badge in the mail within the next week (https://imgur.com/a/bQYXUWH). Cool. It's almost June and I have NEVER received it. At this point, I give up. Not active on their art twitter. Highly active on their personal twitter. They uploaded everyone's finished badges on instagram except mine? Like okay, maybe I'm being petty, but maybe someone else gets me. It's not like there was only one of said badge, but the reason this is SO beyond annoying for me is that I'm so tired of asking Fuu to just. Get. It. Done. Get it done and we don't have to speak about it ever again. But now, I'm fed up, and Fuu get's a bad review from me. I was sympathetic, but now, I'm really not. UPDATE (1/18/18): Fuu has contacted me with the finished art and even offered me a full refund. I declined the full refund as I was just happy to have my art. Fuu is by no means a terrible person and has very humbly owned up to their mistakes with absolute grace. Lovely human being, but just a poor example of customer service, which I hope to see them improve on in the future. I remember clearly because I was not in the country when I contacted them. First signs of trouble appeared near the end of the year when they were taking on more commissions and not completing ones they had previously taken. EXPLAIN: I was under the impression the artist had an excellent work ethic as people were retweeting their completed commissions in a very timely manner. This set them up as someone who was excellent to commission because they had good prices and high quality work. I was very happy to receive a slot from them. I’m pretty sure that I was the last person they accepted in that batch/run of badges. I received an inked WIP ten days after the invoice was paid. They posted a coloured WIP in October of my badge flat-coloured with something like fifteen-odd other commissions in the same stage of completion. I thought it was excellent that they were getting so many done so fast. I was not at all concerned and was willing to wait 1-2 months because I knew they had lots to do. Come January 2017 they had a computer crash and their hard drive was toast. If anyone is sympathetic, it would be me; I was in a similar situation ages ago. I was under the assumption that my file was not recovered as I waited another 2-3 months for my commission with nothing. I was not informed whether or not my art was recovered (spoiler alert: it actually was recovered, but did I know that? Nope.), and while it may be my responsibility to ask, it’s also the artist’s responsibility as someone who is running a business to be upfront and clear with their customers, no matter how many people they owed art to. Over the course of 2017, I constantly saw Fuu finishing commissions that I was highly certain were taken long after I had paid for my own. They were opening commissions for convention pick-ups, completing them all in easily a week or less. At this point, I’m getting really irritated; they are obviously fully capable of completing commissions quickly, and I couldn’t understand what was taking so long. I was also thinking about other people that might be waiting alongside with me. I could easily go through the WIPs they have posted in the past, and tell you who has and who hasn’t gotten their art. MOST people have gotten their art, but for some odd reason, I feel as if I have been forgotten. I’m sure there are a handful of others who feel the same way, but are too afraid to assert themselves. Come July 2017, I finally messaged Fuu as the one year mark was coming up. I said to them I felt as if I was forgotten and they assured me I wasn’t. They said come mid-August and after Midwest FurFest, would be a good time to expect my commission to be completed. Come September 2017, and I had not heard anything. In all fairness to Fuu, I understand doing owed art and working at a job is very difficult to balance. And I was also very patient because I was sympathetic. But it’s not an excuse when you have already proven yourself to be very quick to finish commissions only to pull the rug under your customers. Come January 2018, I realize I have not seen Fuu on my newsfeed in sometime - turns out they have been inactive on their art account and main account for almost a month with no warning to commissioners. To wrap it all up I feel jerked around, lied to, and my patience has been taken advantage of. Regardless if the art is completed, this kind of customer service is unacceptable and disregards the integrity and loyalty of your commissioners. They were very polite and nice to chat with, so I didn't think there wold be any issues at all. Then the days went, the weeks went. I wondered why it took so long, as they opened up more complex commissions and YCH, which I thought was to bring in more money, as hey, 16 USD isn't that much really. They then posted journals about their current health and such, which, sure, it sucked, but wasn't really a reason for me to be angry. Now, about two months ago, they contact me and tells me that they can't do the commission as they constantly has to redraw the characters. At least they could've told me sooner ! I told them that I'd like a refund and that I'd return once I had gotten over the canceld commission. Haven't heard from them since then, my notes has been unread, comments ignored. They posted a journal about their current situation, but I've been patient with them and I've had enough! I've sent them a money request on Paypal, with a note telling who I am and why I'm sending it. which has also been ignored. I feel terrible about doing this, but I don't see any other option. I realize I may have been a bit nice about it since it was frustrating to see her pumping out personal and friend art constantly with commissions few and far between, especially when at one point I was 'second to last' in her queue. It was a $60 dollar commission and unfortunately I've changed banks so I don't have proof anymore. He was quick to respond, we exchanged details about the commission and I paid him the next day. He claimed it would take him 2 weeks to finish the piece. I am "free to request a WIP whenever" and contact him at any of his messengers. Sounds good to me. I didn't hear anything of him for 4 weeks, so I sent him a note on the 18th of August, asking if he forgot about me. Again, he was quick to respond, told me he was busy moving, admitted he was behind schedule. No problem to me. I responded with some kind of smalltalk, to which I didn't receive a response. Also, not a problem at all. September the 15th, another 4 weeks have passed. I'm asking for updates. Telling him I'm not intending to rush, telling him to take his time. Though I was giving an emphasis on the fact that 9 weeks have already passed. I asked about his queue, where I am placed at. I didn't receive a response. One week later I sent him another note, asking if he is going to answer me eventually. Slowly losing my patience. He responded the day after, saying he thought he responded to me already. He told me he "hit a pretty bad road bump, but we should be pretty square now." I should "keep an eye out", he'll "bump me an update soon". I responded ecstatically, telling him not to rush it. But I wished we would have a more active base of communication. Told him about a story of a previous bad experience with another artist (though resolved). He didn't respond to this. November the 3rd, another 6 weeks later, I ask him if he could start anytime soon. I didn't receive a response. I noticed he uploaded another artworks and YCHs especially. Apparently, he needed to make more money, while he couldn't finish anything else of his queue. November the 16th, another 2 weeks later, I told him he didn't respond to my note, and asked about the status of my commission. He responded the same day, saying he'll "dig it up today" and send me the "current version" of it. November the 24th, another week later, I asked about his progress. He responded the same day, saying he "found the work" (!?) and he "had done the dang pose wrong", telling me he was sorry about that. He included a link to a sketch, which didn't represent what I was asking for at all. I responded the next day, losing my patience, criticizing his work ethic, yet staying constructive and not being insulting (Even though I admitted, that "I am pissed right now"). I was in disbelief that it took him 4 months to work on my commission, while not even doing what I paid for. I told him about the times he didn't care to respond to me, how I expected him to come forward to me, instead of me having to poke and ask every few weeks, how I paid for this commission alredy, how he makes me belief he might have stolen my money. I questioned him about the other artworks and YCHs he kept posting, while he apparently could not bother to work on my commission. I told him his work ethic was insulting to me. I also told him that I'm sad it went this way. I had hoped it would've been better for us. "I sincerly hope you do understand." I made some demands to have him work with me more proactively and constructively. I gave him my contact data for Discord and Steam. I promised him to work professionally as possible with him. I would focus on the progress of the commission and I wouldn't complain to him about his work ethic any further, if he agreed. I told him the picture has to be finished within the next 2 weeks, as he originally promised, or I'll demand a refund. Which was due yesterday, which I didn't receive. His response was, I quote: "Ok we'll eat shit and take a refund on the 10th you pompous fuck." I was shocked at his response, to say the least. Yet I didn't respond back in any insulting manner. Again, I showed him how the situation was and how he tore my patience apart with that last piece. I criticized his work ethic again and told him I was appalled in which insulting manner he responed to me, a customer. His response: "No. Fuck you. I really don't care about you, or your views, or suffering to be polite to you. You do t deserve it. Fuck you." This only became more childish the more we went on. I told him he was taking my critique way too personal. Yet again, I criticized him. Especially pointing out, how he claims to be "overly social" with his customers and how he is "always seeking to improve", as it's stated on his profile page. I reinforced my previous statement, saying I never attacked him in person. I asked him to keep his dignity. I told him he can refund me at anytime, 10th of December being the deadline. He, again, responded with a lot of vulgarity. Later notes went a bit back and forth, so I won't explain the exact details of them here, yet I will post it in the screenshots below. It's interesting nontheless. - I warned him about carrying this issue towards artist beware, to which he said he didn't give a fuck, he would refund me eventually. He was still very abusive in his choice of words. - He claimed what he did could be done in a "quick edit", yet comparing the sketch to my instructions, it's obvious that it needs a complete redo. I wouldn't have complained if it was just a small error. - Admittedly, I lost a bit of my temper in between, though I didn't attack him personally. - He called me a liar and claimed he did respond to every single one of my notes. He prompted me to read his TOS (explained in the paragraph below). - I proofed him wrong and criticized his TOS. To which he "dares" me to make the Artist Beware post. - I asked him what his deal is. - He told me his personal opinion of me. - I responded and criticized him again. I told him that IF I personally insulted him in any way, I am sorry. - He told me I am delusional. Something about "stead pay"!? - After the last note he send me, to which I tried to respond, he blocked me. I wasn't able to contact him any further. It came to my attention that he claims in his TOS that he "will cancel the commission with no refund if you're abusive." And I believe he makes use of his own rule here, despite me not attacking him in person once. Besides, TOS rule or not, stealing money is stealing money. You can't make it legal by writing up a rule of your own, saying it is legal. Well then, the next 2 weeks until yesterday, I waited for my refund. He didn't do it, so now we're here. When: The auction was won on February 14, 2017, and lists a completion time of 5 weeks after full payment is received. Full payment was made on February 17, 2017, after some initial communication difficulties. Delivery of the head was delayed repeatedly. On July 12, after a disagreement about what features were included in the increased price, Mitha offered a full refund, then asked for a legal agreement to be signed as a pre-requisite for the refund. On July 13, Mitha refused to honor that offer, and said that only a 50% refund would be available. On July 17, after I had requested several days to decide what to do (which was also over a weekend), Mitha stated that she would be giving me a 50% refund in 14 days whether I wanted it or not. At that point, I filed a credit card dispute, which was resolved in my favor in September. Explanation & Evidence: The commission got off to a rough start when Mitha didn’t get my emails, but that’s on me. Eventually we made contact via Twitter, which is where we would do all of our subsequent communication. I sent Mitha a long explanation, including a web page with references and desired features. Screenshot 1 Mitha agreed to this, saying that she could “do everything I wanted” on my reference page. Screenshot 2 The features added $280 to the price of the head, which made the total with shipping $905. Screenshot 3 Payment was made immediately via credit card on her website, http://www.mithacal.com. Screenshot 4 Some additional discussion about fur kinds and colors followed, since I wanted to try making a body suit for the head and wanted to coordinate on the fur we were using. At the end of the discussion, I mentioned her move, something that she had been talking about on Twitter. No mention was made of it impacting the deadline. Screenshot 5 One month later, I check in. No progress, and we talk about fur choices, but don’t exit the conversation with an unambiguous decision. Screenshot 6 Another month goes by with no communication. It’s now April 23rd, with no WIPs. I check in again. Apparently Mitha thought that she was still waiting on fur choices, and after getting the go-ahead to use whatever she wanted, says that she’ll finish up the mask and will have updates in a week. Screenshot 7 At the time, she also asks me what color eyes I want. LED eyes weren’t part of my request list, but I had thought they were just something standard she did. Her last message says she needs to wait for them, but had said just before that she’d report progress in a week. Screenshot 7_1 Another month goes by, and it’s now May 30th. I have not yet heard anything from Mitha without me prompting her. She says she’s still waiting on the eyes from DVC. Screenshot 8 Amazingly, the eyes come in the same day! Or so she says. She also now says it will be another few weeks before there’s any progress to see. Screenshot 9 Screenshot 10 June 13th, and I finally get a communication from her asking me to choose eye backgrounds, and to say that the head is still a couple of weeks away from completion. Screenshot 11 June 21st , and I message her again for a status update, and to let her know that I was going to be out of town from July 1 – 10. She indicates that she’ll have the head shipped so that it arrives around July 10th. Screenshot 12 Screenshot 13 July 11th, and I haven’t heard anything from her, so I ping her again. Apparently there’s been a delay due to her wedding and honeymoon, which she didn’t mention anything about. I congratulate her, and ask for some WIPs, especially of the tear duct modifications. This is where things start to go very wrong. Screenshot 14 Mitha claims she never agreed to the modifications. I ask where she said that, because the last message I got from her about it, before I paid, was that it wouldn’t be a problem. She says she sent something saying she wasn’t capable of that kind of modification, and offers a refund if that’s a problem. I ask again to just point me where she said that, and after 24 hours of no response, I’m pretty fed up with the whole deal and agree to the refund. Fine, I just want to be done with this; I’ve seen scant evidence that my commission was even being worked on (nothing other than the eye backgrounds), and we’re now 5 months into what was promised in 5 weeks. Screenshot 16 And now things get really weird. Mitha wants me to sign some kind of contract – I was guessing a non-disparagement agreement – as part of the refund. But, instead of sending me something to sign and review, she sends me a contract that she signed, between herself and her dog breeder, over some dispute that they had. Real names redacted below, but they weren't in what she sent me: Screenshot 17 One, sending me this unredacted was probably a violation of her agreement with her breeder. Two, it’s really odd to send somebody a legal agreement that isn’t actually ready to be signed, and is in fact between her and another party, with all of those details. Because I've had some experience with contracts and NDAs, I’m going to get a lawyer to look at any contract I’m being asked to sign. I’m not trying to be aggressive here, and in most business environments when you say you need a lawyer to look at a legal document, that’s a sign of being sane and prudent, not that you're making a legal threat. Screenshot 18 The whole thing has taken a turn for the strange, and I’m asking her for options. I feel she’s had a really poor record of communicating with me, so I’m trying to be proactive about communication and expectations. Asking for a mailing address for legal communications is pretty standard business practice, and signing a non-disparagement clause is a lot different than a regular commercial transaction. As a registered business in the state of Alaska, she has to have a publicly-available mailing address, and it can be found very easily online at the Alaska Chamber of Commerce website (https://www.commerce.alaska.gov/cbp/main), so I'm not sure why it would be a problem. Screenshot 19 And then Mitha changes her mind, says she won’t be giving me a full refund, that only a 50% refund is on the table, and accuses me of threatening legal action, apparently because I uttered the word ‘lawyer’, after she asked me to sign a legally-binding document. Screenshot 20 I want to take some time to think about this, because none of my options here are good: I can lose $450, or I can maybe get a head that doesn’t have the features that I wanted, from a maker that I no longer trust. Since this is already months late, I didn’t think a few extra days would be an issue, especially over a weekend. July 14 was a Friday, July 17 is a Monday. Mitha feels differently, and by Monday evening is saying that she will give me a 50% refund whether I like it or not. Screenshot 21 I’m still not clear on what’s going on – do I still have to sign a document of some kind, even for the 50% refund? I’m not sure, and I don’t want to make a decision until we can hash this out. Mitha doesn’t want to wait though, and just after midnight on Monday she decides she’s going to keep half the money and not send me anything, no matter what I want. After 5 months of me waiting for her, she’s definitely not going to wait for me. Screenshot 22 To me, and to the lawyer that I had review all of this, this is a breach of contract on her part. What she’s saying here, as evidenced by all the previous tweets, is mostly false. She offered the refund first, I just took her up on it. She asked me to sign a legal document, I just wanted to do it safely by having a lawyer look at the contract. At this point, I’m pretty upset. I’d received nothing, no WIPs beyond the eye backdrop photos, no proof of work done, and no product, and was only going to get half of a refund after waiting 5 months for something that Mitha agreed to do but later decided she couldn't, or wouldn't. Finally, on July 30th, Mitha unblocked me long enough to tell me that she was going to sue me in small claims court. To date, Mitha hasn’t served me with anything for a lawsuit, and the credit card company finalized the chargeback in September, so I have 100% of my money back. As things go, this could have been worse, but I think Mitha is somebody to avoid doing business with.

I still have not received a single response from her. When I finally did, it was her sending me her address because I asked for it so I can send a piece of sample fur to her. She got the sample and told me it was wrong. I asked if she can send a picture of the right fur, but received no response. They paid, I sent them the file. This involves personal issues which do not relate to the transactions, but lead up to the paypal claims. SaltedDriftwood and one of my friends followed each other on twitter. My friend grew uncomfortable with them because of their own personal issues, and silently softblocked and unfollowed them. When SaltedDriftwood noticed, they messaged me, asking me why. I was not comfortable being put in that position, and declined telling them. They then liked a reply I had made to my friend, which upset him, on top of knowing SaltedDriftwood had tried to contact him through me, an unrelated party. I told them this upset both of us, and the reasons my friend wanted space between them. An argument broke out, SD removed me from discord, and I assumed that was the end of that. Today, I received notices from Paypal that SD wants refunds on the pre-made designs from August and January, citing that the "Items are not as described." I had missed a DM from them on Saturday, Nov 25th (I received the refund request Monday, Nov 27th)-- I do not conduct business on twitter, so I don't have a tab dedicated to my DMs on Tweetdeck, and didn't see the message. It was also filled with responses to the personal issues from the conversation on Discord. They are asking for a refund on items they received in January and August because of the personal disagreements, despite the fact the items were pre-made and they knew full well what they looked like before they bought them. At the time of writing I have responded to the claim offering a full refund provided they do not keep the design. I am waiting to hear back on that. They requested a partial refund on the design they bought from me in January. I told them I would give them a full refund on the condition they do not keep the adoptable, or no refund and let them keep the adoptable. I am waiting to hear back on this as well. I am aware I could refuse the refunds, but I do not feel it's worth it to prove the receipt of digital goods to Paypal, and would rather this be done with. As a note, I do allow for my designs to be traded and resold, and I do not need to be notified of any transfer. Paid in cash. It was like $15 or something of that sort. In person, she had told me she would have it done at con, which was part of why I had commissioned her (I have issues with the post so it’s easier that way.) She was very polite and had me send her my references on Telegram. The next day (June 4th) I came to her table sometime and she told me she hadn’t been able to work on it yet. I told her I understood since I’ve been a dealer many times before and got that things can pile up and you’re busy speaking with people all day. She said she would try to have it done by the end of the day. I told her I could be in den after hours and such on telegram, attempting to be accommodating for her. I stopped by a final time at the end of the day and she had no progress. She told me she would have it done within in a couple weeks after the con and ship it out right after. I assumed that meant she was getting to it soon and it’d be sent out soon as well. (Proof here.) Over a month passed, so I checked in on things. (July 25th) She replied days later, suddenly with the finished product, then offering to color it for free. I know sometimes artists will offer extra work to make up for things when they know they messed up on service somehow and I wanted her to have that chance to either a) feel like she was making things right, or b) enjoy the art more if that was the only actual reason. I was very clear I have worries about the post and needed communication to make sure that I didn’t miss the piece in the mail. She said she’d let me know, and even promised it would have tracking. (Proof here.) I contact her again. It’s now September 9th. No response. (Proof here.) September 17th she suddenly produces the colored image and explains her laptop issues and that she’d have things sorted next week. I complimented the artwork, thanked her, had small chitchat. She asked for my address again so she could send it after scanning it. (Proof here.) Another month passes. I’ve heard nothing. The post had just damaged an expensive item so I was extremely worried at this point. I contacted her with my concerns offering to pay tracking and all that stuff. I had forgotten she had promised this to me. This was on October 20th. I received no response. (Proof here.) In my worries, I had to go find her other contacts as I had only been given her telegram. I rarely check FA, but find her FA via a shout on my page with the link to the scanned upload. Went to find her other information. Saw on her twitters she had been making fursuits while ignoring me, which was very disheartening. My anxiety levels peaked, so I had to breathe and wait on things. After being ignored for over a month now, I’d resolved to put my foot down about things. This was on November 10th. (Proof here.) I was extremely firm now, because I knew this was unacceptable behavior and something had to be said. November 11th. She happens to suddenly be able to reply in a timely manner, mere hours after my message, and is just rude and unprofessional. I responded, calling her out on her poor behavior and business ethics. She states that it’s out of her hands, throws a “have a nice life” and states if I respond she likely won’t even read it. There is no tracking, as she promised originally, and as I requested multiple times. She makes it clear she has no concern if it gets to me unscathed, or at all. (Proof here.) I responded back to notify her I would be setting up a warning about her due to her final nasty message, informing her I was blocking her, and was no longer concerned about the art. During ALL this time I was given the same ''I will do it this upcoming week'' message over and over though NO sketches OR Work in progress were shown to me AT ALL. Once September arrived I gave her a final message asking for either a To-Do list, to see a WIP OR a Full Refund. Got a reply two days after that telling me they were doing the lineart. I got frustrated and asked why would they be doing the lineart already if I had not seen any work prior to that nor had I aproved it. Artist replied with a short message saying ''If you don't like it then it's not worth finishing it :)'' I got mad over this message and decided to ask for a full refund. She promised to do it 'next week'. I had to wait for a whole month until that happened. BUT I only got half of it refunded. They never once contacted me about my commission and suddenly disappeared from FA, leaving a giant list of waiting commissioners behind. I knew no other way to contact them, so I waited and gave them the benefit of the doubt. At some point they returned, saying they were sorry and they would pick up the outstanding commissions but then they disappeared again. They had at least 2 people trying to manage their commissions as kind of a 'secretary' so far as far as I know but this also did not work out. 2 years ago they returned to FA again, asking for commissioners to contact them, so I did - here is the note I sent and their reply . I was hoping they'd work through their old list then but as far as I know not much progress has been made. They were inactive again for some time after that. In March this year I sent a mail to the mail address they left on their Journal, asking for a refund (I assumed it had been 4 years when it had been 6 to 7 years of a wait already). I never got a reply. They took (and keep taking) new commissions via Twitter and at cons, some of which have been completed and some that seem to have been added to their list. A dispute between me and the artist occurred sometime in October 2016 that got me blocked by them everywhere, including emails after an email exchange with the artist. The adopt was "reclaimed" on August 24th 2017 and after a brief attempt at an email exchange I was dismissed, and ignored. (Please note that I live in the UK which will cause time zone differences between me and the artist as they don't live in the UK) EXPLAIN & PROOF: On January 10th 2016 me and the artist entered an exchange via notes that displays my interest in buying the adopt in question. The artist accepted and I sent them the payment without delay within the space of an hour. I posted some comments on this journal and Demu took offence with them and blocked me, on every platform they knew or could discover I was on. Now when I purchased the adopt they make it a requirement that we adhere to an agreement called the Ferrin Adopt Agreement. this agreement is updated regularly and I can not provide the version that I initially agreed to or the version of it that was enforced at the time I was blocked. The reason this is relevant is because it was last updated on November 2016, after October 2nd 2016 when this incident be tween us took place. The reason this is important is because in the version of the Adopt Agreement I was bound to it stated that if I wanted to sell an adopt I needed to inform Demu of it first, with me being blocked, I could not do so in any way shape or form. So this for me potentially dissolved our agreement as that can happen when one makes it impossible for one party makes it impossible for the other party to fulfil their part of said agreement. So by blocking me everywhere, Demu essentially nullified the Adopt Agreement between us meaning it did not apply to me any longer or the Ferrin I adopted. But the opposite could also be true as the full legal depth of it is rather tricky as it's essentially impossible to copyright a species based on a design and words alone, because of how copyright law works. So for me I was left in a sort of limbo, and wasn't exactly sure how to progress. So I settled on a compromise. I would bind myself to the majority of the Agreement as it was written on the date of me being blocked from contacting them via email, I would check Demu's account once a month to see if I'd been unblocked to establish that the Adopt Agreement would then be reestablished between us as the original issue was resolved, and in 1 year (October 2nd 2017) if I was not unblocked, I would check the new Agreement and decide if I wished to follow it, if not I would ask a friend to contact Demu and notify them of this and state I wish to sell the design to not cause a conflict of interest. i tried to illustate this ion the ferrin I adopted with the Artists Comment box that comes with everythign one uploads to FA and such sites (This screen shots were sent to me by Demu's staff as their evidence against me https://drive.google.com/file/d/0BzhBESqCaxDiUFhKQVg0M1RmN3hHNVZUcEhnNllseHJzWkpN/view?usp=sharing)That was the plan anyway. Throughout the exchange since being blocked Demu and their associate has made personal attacks against me as an individual, which for me adds insult to the injury of being left $250 worse off. I once had further evidence that would support this claim entirely, but I have lost it since my laptop broke and my bookmarks did not import entirely when I used a temporary one. Anything else would be conjecture at this point and I'd rather we all deal with facts. I as an individual know my faults in this and can learn and grow from it, I can explain some of the issues Demu and his aid have with me but again that would be conjecture. We were able to come to an understanding and an agreement of what I wanted done, and they sent me their PayPal email and I sent payment. ( Screenshot 1) (My username on Deviantart is Nigou.) I hadn’t heard anything from them so in December I asked for an update to which they told me they were working on and were having a lot of life problems. Totally cool, it was only two months since they accepted my commission no big. (Screenshot 2) Now we fast forward to June, which is the first time since December they’ve responded to me. They now are saying they lost all the files because their computer crashed and they won’t be able to finish my commission and they won’t be able to refund my money. I wasn’t allowed to request a refund because they had no money. (Screenshot 3) Now at this point I am getting increasingly upset, because it had nine months since I commissioned them, and seven months since I last heard from them, so I demanded either the commission or my refund. (Screenshot 4) After that they sent me another message saying they don’t draw females, even though that was the same characters I sent a year ago. (Screenshot 5) If you refer back to the original post they draw both MxM and MxF. Then they sent yet another message stating they would refund me in point, and I responded saying I didn’t want point, I wanted the cash that I had sent. (Screenshot 6) Then they told me they couldn’t send money on PayPal because I ‘blocked them’ and they no longer had PayPal and kept insisting on Point. (Screenshot 7 & 8) And that brings me to the most recent exchange. I basically told them I would dispute the transaction on PayPal because it wasn’t fair they kept dodging my request of a refund. They basically told me I was irrational for not thinking about what they are going through in life and why they can’t refund me. UPDATE : So they messaged me again on a different account this time, basically giving me an excuse for why their friends came after me, also telling me why they no longer draw women, despite accepting my commission last year. UPDATE TWO : So I just recevied a refund some a different paypal email adress, so I suppose this has been resolved, but I am rather disapointed they lied to be about not having paypal. All of this could have been avoided.
