The husky tail matched a fursuit head I have currently and I expressed my interest in it. She was very quick to respond to me and I sent my payment, during that time I also won originally a fursuit tail but requested to switch it to paws since I was buying a tail from her. She was ok with the change and I sent my reference sheet for the character, I wasn't in a hurry for it so I agreed with shipping both items together assuming they would both be done by BLFC (which is in May). So I left it at that until April, I saw she was tweeting about bringing finished commissions to BLFC and I asked her if it'll be possible to have her bring the items to the con. Kay stated she would try to bring it with her, I didn't bring it up again until April 30th. She never responded to my messages since then, I messaged her after BLFC requesting her to mail out the tail on Jun 15th. Kay was tweeting about how she was in a car accident after the con and was in the process of moving, so I waited the 26th to ask her about a refund. I did get impatient about it and filed a dispute, but I've waited two months since her last response to my messages. I gave her until the 11th of July before escalating the dispute to Paypal. Right now the last message I sent her was requesting a refund since I know that disputes will ding your account and as someone who also takes commissions. I know how important it is to be able to access Paypal. I know she's activate on her main account and is ignoring my requests for a refund. I've been very patient giving her time to respond since I knew she was busy with moving, but I feel like I'm being ignored. I want to give her the benefit of the doubt but I feel she is very unprofessional. I commissioned Athena for a Perler bead badge on June 4, 2017 at BLFC. I paid somewhere near $130 in cash, so I have zero paper trail. (A stupid move on my part, I know) At this point I have accepted I will not be getting a refund, and at this point I don’t even know when or if I’ll be getting my badge. We never really had good contact, but I’m a relatively patient person. As you can see from my Telegram posts, I let months sometimes slide in-between contact with her before trying to get something from her. On November 16 on Telegram, she said that my badge would be completed by MFF, and then shipped to me after the show. On March 15, she starts replying to messages, saying that her PayPal was hacked, and she had a bunch of personal drama going on. I totally get that real life sometimes takes over, and she did show another batch of badges March 31 that were finished. I’m not good at being angry, and I haven’t been particularly vocal about her until recently, so apparently people on her queue have been shuffled around ahead of me. Of course, no one knows this because she has no public queue visible anywhere. I told her she should stick to her queue in order of who ordered first, and not jump around. Due to the insane wait I’ve already had (uninformed on wait due to no public queue) and her saying that she’s doing the badges out of order, I requested a refund. Instead of offering a solution for her to get my refund, she merely showed me the screenshots of her PayPal and bank statement a second time, telling me how she had bills coming up. In order for me to get my refund, she tells me that I have to find someone to take my spot, essentially advertise for her. I’m sorry, but finding my refund is not my job. I told her this, repeated that I wanted my refund, and said I would be taking my business elsewhere. I do not want the thing I paid for. I do not want to advertise for her. No artist is perfect, and surely no artist is bulletproof. I hope any fans of hers will see reason, and not an intent to do harm. This is my story. About a week ago from writing this (July 1) AshleyZombie canceled my commission because of con booth prep and "personal issues." I asked her to not do this, that I was willing to wait until con season was over and she was ready. But she did not want to hear any of it. She then kept half of the money I gave her for the commission and sent me a terribly done rough draft of the image, which is not what I was paying her for nor do I think it's worth half of the amount she charges for a fully rendered painting with cleaned lines and refined color work [see example here]. I expressly told her I don't agree to these new terms for a half payment, and that because she is the one canceling our project, that she is breaking our contract. She then slapped me with a bunch of horrible terms from her ToS page, which we never discussed beforehand. I initially contacted her on Tumblr after seeing a post about her being open for commissions — which was back in May, so over a month ago — and we hashed out the beginnings of what I thought would be an amazing commission project. Not once did she mention her ToS, and furthermore that because she was the one breaking our contract that she has no right to enforce her ToS onto me. It's already bad enough that to be on her commission list you have to pay 100% upfront. But now that she's able to cancel any commission she chooses, and is able to keep half the money for doing very little work, is a VERY BAD business practice. If all you are going to do is open for commissions, then cancel the commissions you just took while barely working on them just to keep half of the payment, then maybe you shouldn't be doing commissions in the first place if you do not plan to complete them. I understand bad things happen in life. I am completely forthcoming about personal issues, and I am willing to bend over backwards to help you out if I can. But this is something I feel she is doing to take advantage of clients, who will mostly remain silent and let these things go. I did not feel this was fair for her to do, and I was more than happy to negotiate a new settlement for the work she has done. However based on separate terms unrelated to the canceled commission. If you start a commission for a digital painting, and the end result is a rough doodle, then I am willing to pay you for a rough doodle. Just to put prices into perspective here, she was offering commissions for half-body and full-body paintings, at $100 and $180 respectively. I am glad I only purchased the $100 slot, because if she considers what she gave me to be worth half of $180 I would legitimately lose it. Either way, the practice of canceling someone's commission and charging them half for very little work is most unbecoming of her reputation. I haven't even mentioned the communication timeframe, usually taking weeks before getting a response. For the most part I was quite unassuming. After the first day of making payment, on May 16, she told me she would be able to send periodic WIPs. About 8 days later, on May 24, she sends me a rough sketch of my character which I absolutely adored, and told her to continue on after making some small fixes on the character. Again, another 8 days of waiting for a response, and on June 1 she informs me that there are no updates and to check her commissions queue. That didn't help clarify what was her situation was, but I reassured her that if she needs time to just let me know what's going on and keep me in the loop. At this point I ask her to let me know when she thinks she will be able to resume or get back to me about my commission, but no response. Twelve days later, on June 12 she finally responds with an update asking me to confirm the color palette and eye color. I comply, and I confirm the things that are correct and things that aren't correct. However I expressed slight dismay at the fact that we never discussed the changes to the preliminary sketch that was first drafted almost four weeks ago, and that the changes needed were not reflected in the update. I even clearly stated the issues unaddressed at the end of the email, verbatim. She then reassures me that the corrections will be reflected in the final painting, but I was already having doubts — my trust in her to do what she says was really all I had left to rely on. I tried to press on a conversation about the initial changes to the first draft, however that was shut out with another 4 days of silence, and finally on June 17 I received a response comparing the first draft to the second with color. At this point I was somewhat troubled by the lack of progress on the commission. An entire month has gone by, we haven't discussed the details or how we should go about fixing said details, I am receiving updates arbitrarily which only address the artist's concerns and not mine, and I personally found myself frustrated and contemplative about the appearance of the initial draft. So I withdrew my responses for a time, as it seemed the artist was not interested in having a conversation about my commission. I had the intention of responding later, or looking forward to AZ keeping her word that she will make the changes I am asking for in the next update. That was not to be so, because a week later on June 23, she sends me an email. "Hi, i hate to be doing this but im send out refunds to clients that's waited over a month or so due to the fact that i have con prep to worry and i've been slowly burned out with work. I've got a lot going on irl too and I've been stressed about it I don't think im doing this character much justice and im not following the guild lines too well with whats shown on the page. This character's been sketched and colored already so i'll be giving you a partial refund. I Just need your paypal email and i'll send you the full image when i send the money back !" Basically she's decided to scrap the project for her own reasons, but also — by the way — she'll be keeping "part" of my funds as tribute for her efforts thus far. Under different conditions, as I stated before, I'd have been happy to compensate her for her efforts. But the way this was imposed upon me, with disregard for her own incompetence by not completing her end of the deal, seemed to have disingenuous intentions. I sit on this email for about a day, contemplating alternatives and then I arrive at a solution. I ask AshleyZombie to reconsider putting the project on hold until she is able to collect herself and is ready to continue, preferably after "con" season. I was open to a new timeframe, and expressed that I'd be happy to wait. She refused, twice, and it was basically a one-sided conversation. Actually, come to think of it, the entire conversation since day one was very one-sided. I'm not very aware of many one-sided business conversings, but they usually don't end well for the receiving party. A few more emails, and it seems she's actively pushing for me to just accept what she's saying. From her tone, I can tell she's frustrated with my noncompliance and pleading. And to be fair, I am just about as equally as frustrated with her unresponsiveness and authoritative diction. I grind our pleasantries to a halt and let her know my thoughts on what she is trying to do. Specifically that I do not agree at all with her new terms for a partial refund for an item I do not want in its current state, at a price of her choosing. I lay out the barebones of our contract and how she did not complete her end of the deal. As a result, I asked that she consider completing the piece at full price — or that I demand a full refund and that she keep her incomplete efforts. Perhaps to count it as practice work or something to stuff into a sketchbook. I tried my best to be reasonable and logical, also taking effort to acknowledge her "apparent" hardship. But even this was met with incompetence, as she accused me of trying to bully her into not paying. I told her I would consider paying, but under arguably different circumstances. Nonetheless, seeing as how negotiating with her has gone so far, I wasn't optimistic that she would agree to anything else. Then she slaps me with her ToS. Which states that if the client should ask for a refund, and if she is halfway finished with the piece, that her terms would apply as such and a partial refund of "half" of the original commission price. And that would make sense, if I were the one requesting the refund. I even told her if I initiated the refund, I would be okay with paying half. But that isn't the case by far, and the complete opposite is true. She has termination terms, but she's exempt from terminating herself? And because she's broken contract, I don't understand how her terms can still be enforced. That got cherry picked to mean what she wanted it to, and as such she says it doesn't matter who initiated the refund. That if the work itself is halfway done then she is entitled to half of the payment. No negotiations. Had she simply imposed a cancellation fee, she wouldn't be able to enforce it. Our situation wasn't any different. That out of the way, this argument continued for one additional response from her, basically telling me that I'm bullying her, that her ToS are to protect her, etc, and that she will be enforcing her terms regardless of how wrong she was for breaking our deal. So far, I am taking this up an echelon with PayPal. Hopefully they will be able to resolve this issue where I cannot. And if they can go no further, I'll take it to civil court if I have to. It's the principle that's going to cause more harm in the long run, in my opinion. And not just from AshleyZombie, but from other similar-minded people as well. This is what I expected to get. But instead of that, a new deal was shoehorned into this one, involuntarily, for a partially completed work for half the cost of the original price. Which I never agreed to. However it will be difficult for her prove what constitutes as a "half work," and what justifies "half payment" based on her ToS. Had this been a normal cancellation fee, I'd gladly pay it but... wouldn't you know it, I didn't cancel? Please beware of this artist, and others like her! UPDATE (July 11) PayPal has ruled in my favor. The case is now closed! Proof of decision (July 10) I also discovered that AshleyZombie reopened commissions not even a few days after canceling my commission! This means she lied about her reasons for needing to cancel, in stating that she needed time to de-stress, etc, yet just hours later she reopens extra fresh on Twitter. In other words, AshleyZombie is accepting commission slots, only to later cancel any commissions she doesn't want to do while keeping half of the money given to her by clients. Do take note she leaves that part out, as if a full refund was offered. This is beyond reprehensible. Please be VERY aware of this before commissioning her. I'd offer to help revise her refund policy, but for someone to scam their clients like this I cannot bring myself to want to help. WHERE: I met her at ANE 2018 at her table, who had a square and her tablet with some works of art on the table. WHAT: Traditional art, a sketch of my character WHEN: From February 24th to June 2018 EXPLAIN: I met her at one of the artist alley tables at ANE. She looked professional and like most of the other artists there. She was kind and well mannered at first glance. I have her a reference of my character and had paid for the sketch via her square. She said it would be completed for the next day, Sunday. On Sunday I got a text saying she couldn't make it because she took a train up to Boston from RI and she couldn't get there in time, to which she said she would mail me the work and I was fine with that. She promised she would send me the work the next day and, nothing. March 2nd I asked if everything was okay and if stuff has been sent out, and she said it would ship next Monday. Nothing again, I contacted her again March 17th, and didn't get a reply until April 7th saying her phone broke, and she lost addresses presumably? I had filed a claim with the bank at this point and just wanted my money back. She had said she could offer a refund but I have not gotten a message back from her since April 8th. The bank would not refund me as of June 2018 since the money was given "willingly" even though it was for an item that I never received. I'm not sure if the art at the table was even hers with the amount of run arounds I was getting. I tried to remain positive and when I had gotten into contact with her again I felt bad and said once I was refunded my money, if she got her things together I would pay her in hopes she would do it this time. She responded pretty quickly and all conversation until September was quick, taking no more than a week for replies. She would send occasional WIP photos and I was happy [1]. My first payment via PayPal was on July 24th and the second one was on September 6th [2]. She was fine with how the payment plan was and there were no disputes whatsoever. But then, she just seemed to drop off the face of the Earth. I’d contact her about once a month to try and see what was going on [3]. Her Facebook page never updated and I had no other ways of contacting her. So, I sent a dispute into PayPal in December for both of my payments. She then responded to them fairly quickly, apologizing for her lack of communication. She then offered to give a partial refund, promised to improve her communication, and promised some extra goodies when I got the suit (Unfortunately, I do not have any screenshots of our conversation through PayPal, though I have tried to get them recently). I accepted and she sent a refund [4]. She also recommended I use her email, which she gave me, in order to contact her more efficiently. Unfortunately, I was naïve and dropped both cases, saying they were resolved (because at the time I thought they were). She sent one last set of WIP photos within a week, then disappeared again afterwards [5]. To this day, I’ve contacted her about once a month to try and get her back. I have contacted her through every form of media I could find, including FA and DA. I have threatened, though not followed through with demanding a refund and taking legal action. To be honest, I don’t know how I would go about doing all that, I just wanted to get her attention. I honestly just want my fursuit. Day one of the stream, I paid $75 to her for a full color commission and was told she would start it in that stream. However, the stream went late and she asked to work on it the day after. I agreed and tuned in for that stream and the same situation repeated again. So, in an effort to make things easier on her, I approached her and told her I would be okay with her working on it out of stream since I assumed there was a large number that wanted to watch her work on their commissions. About a month went by and I popped into another stream to ask about it and was told she had a draft done but couldn't stop her stream to show me. I said it was okay. Another two months went by after this and I had popped into streams and was ignored when I messaged her. Fast forward to the end of May, I went into a stream and told her I would like to see my commission, she said she hadn't even started it but would gladly stream it just for me on the following Saturday. I reluctantly agreed and Saturday came around with no stream. Unfortunately I didn't get any pictures of my stream correspondences. It was then I promptly opened a PayPal claim and sent her an email asking for her discord so that I could have an ability to directly speak with her. But to sum it up, I approached her and told her that I'd rather have the art than have the PayPal claim give me my money back and I worked out with her a 7 piece sketch page that would be equivalent in cost but at a lower amount of work for Codeine. After 8 days out of the 10 that would have resulted in an instant decision, I approached her and she said she had not worked on it and tried to convince me to drop the claim before giving up and saying to let it go and I will have my money back on the date of expiration. I'm VERY disappointed with the outcome of this and I feel her professionalism was horrible and unfitting of someone who wants to be a member of the community. I am going to post artists bewares everywhere now that it is confirmed that they are avoiding all contact even though it was already expected/confirmed this just pushed it. They blocked me on their new deviantART 6/6/2018. If they see this I do apologize for my friend they get very protective of me and I assure you, I did not want them to message you with the creation of my beware. I simply did not want anyone to get scammed by you again. Another thing I thought I would mention is someone else was attempting to contact them as they were going to make this person a fursuit but yet again they ran with the money. If they put out a beware I will link it in the comments. Everything occured on facebook but after mutliple declines due to it I'm just going to leave that out upon request of the moderator! Feel free to contact me for any more information if needed I don't have everything I may need (initial comment for commission) but I do have our conversation which I will include in the folder. Back in 2016 on December 17th he had posted about making felt plush commissions I decided to commission them as I had seen them posting stuff and I had previously bought adopts from them so I assumed they were trust worthy. Since then they have given excuses and no updates. I have had to contact them for any information and even then they would not give a WIP even though they said they had previously worked on it. They later deactivated their facebook and did not notify me of this nor given any form of communication. I had to look through google to find any contact other than their paypal email which may or may not be active still. I have seen they are active (see below) and have been multiple times so they cannot say they were not online. They have not messaged me, replied, or any form of contact since March 26th 2017. Paypal will not help me get my money back so if anyone has any suggestions please let me know. This is posted in order of the explanation and can be read alongside for clarification. Explain: I had recently followed TEIL for their work, already impressed with their coloring, poses and scenery (where applicable). I eventually found a YCH from them that interested me enough that I wanted to get of my OC. Details were exchanged, and I was put on the queue. The queue had an expected two month turnaround, which was super understandable because despite how fast they seemed to work from the daily output of art, there was a fair amount of people on the list. During this time they also had outfit chibis that were same day, in stream commissions. I got one of those as well, of the same OC, and got the art the next day (as it was late and I was one of the last on the list. Still super prompt!) Happy with the result, I couldn't wait to see a WIP of the YCH. A little while later, at the very start of November, I noticed there was a slight mixup with mine and another person's spot on TEIL's trello, so I sent them a note about it (I was apologizing for the nudging because I had pointed things about my character out in the outfit chibi stream and I felt bad for coming off as pushy). About two months later I sent a note, asking if there was any progress to my commission. I should point out that, despite the journals having since been deleted, TEIL and her partner had some medical/personal issues and had let people know by means of a journal. The timing of my note was really abysmal because I had pressed send, then noticed that maybe a few minutes ago there was a new journal about a family issue. Of course I apologized for the bad timing and didn't mean to add stress to it, I had just wanted an update. Another month, another note, this time with concern because I noticed YCHs being done out of order. I saw the note read, but not replied to, so I bumped it and got a response. Two months later (no WIP given), there was a Refund list put out. This was something that TEIL and her partner had been talking about, and I had been under the impression that, with no WIP or conversation from TEIL, I'd be on that refund list. I wasn't, but the person who had bought the other YCH in the submission was. Curious, I asked about it. I sort of bungled up my words and confused TEIL, so I clarified what I meant. They replied with a WIP of my character, but...except for the general features, the design was incredibly off. Even after I pointed the mistakes out, they had told me I never mentioned key details when I did and this frustrated me. Needless to say I was not entirely impressed with the lack of reading comprehension, and coupled with the trello mixup I felt like I wasn't being listened to. I should have asked to been put on the refund list at this point, but I was given a revised WIP with (mostly) correct features after and left it alone. When the Paypal's 180 claim was coming up I had decided to send another note, asking about an update. A few weeks earlier, TEIL mentioned the threat of eviction and had been doing emergency commissions to make up the rent they needed. I had specifically waited until things died down to ask them, so as not to create another new year's note incident, but it was implied my asking was stressful. They did promise another WIP would be offered "soon." A month later I ask for a refund. I never mention this to them but between the last note to them and the note asking for a refund, I had lost my job. Outside of the paypal window officially, I wouldn't be able to file a claim and had to rely on faith that they would deliver, especially because things seemed to have turned around for TEIL money-wise and they were earning a lot of clients, both repeat and new, from their in-stream same-day commissions. This is just clarification for where I say previously I would rather wait for the art, then ask for a refund later. After a while, TEIL's journals are all deleted, including the one with the link to the google doc of refunds. I ask about it, and they tell me they didn't see my name on the refund list, but they've added me. This doesn't prove to reassure me about the status of my refund or if I'll ever see it. I didn't respond to it, and even mulled over whether or not I should post this beware, but I'm overall frustrated with everything that's happened so far. I still love TEIL's art but I can't say the same about their work ethic. I don't have record of the advice they were given because of the many journal deletions, but I recall someone suggesting they try to make their debt up through selling bases and adopts, so they aren't constantly adding to their commission queue. TIMELINE: 18 October 2017: Purchased a custom adopt commission from an auction for 200 USD. Paid, artist confirms commission, and details are exchanged. (Proof 1. Proof 2. Proof 3. Proof 4. Proof 5. Proof 6.) No further communication from artist until December 2017. 6 December 2017: Artist provides a rough sketch of the design plan. I request some changes and the artist agrees. (Proof 7. Proof 8.) No further communication from artist until March 2018. 17 March 2018: After not hearing from the artist for roughly three months now, I request an update. The artist responds and claims she is still working on it, but shows no visual WIP. (Proof 9.) No further communication from artist since. Posts an adoptable on 1 May 2018. 21 May 2018: The artist is incredibly active on Twitter throughout this duration from March to May, responding to tweets, tweeting, retweeting, producing and sending out merchandise, etc. I send a note on 21 May 2018 requesting an update with a visual WIP. Unread. (Proof 10. Proof 11.) After 21 May 2018: The artist tweets very often on Twitter and continues to be extremely active there. No response on DeviantArt. I've sent a Twitter DM on 25 May 2018 and it has yet to be read/responded to despite the artist logging on and retweeting something on the 26th. (Proof 12. Proof 13. Proof 14.) WHEN: Initial contact was February 3rd, 2018 when the commission was accepted. Payment details were provided on February 4th, and payment was also sent on February 4th. On March 19th, email communication began inquiring about the commission, and then a month's deadline for a refund was communicated and accepted. On April 20th, I opened a PayPal dispute to reinitiate contact. The refund was refused, and the dispute was elevated to a claim. On April 24th, the claim was resolved in the Buyer's (mine) favor. On May 1st, the Seller/Artist, Fr0stbit3, reopened the claim to appeal to PayPal. On May 4th, the appeal was denied by PayPal. Fr0stbit3 proceeded to post an unauthorized image of my character, using the title and description to insult and defame me. I decided to create an Artists Beware entry. EXPLAIN: This began when I asked for a pre-posed commission slot Fr0stbit3 was opening in February. The idea was a line of dragon characters in pre-made poses would be completed individually for the buyers and then posted in a group pic at the conclusion. https://imgur.com/m6Yru9V This is my initial comment on the submission page inquiring for a slot. Page is still available as of 5/4/2018. I inquired after a slot for the "Dragon Wall", pre-posed pictures for dragon characters to be lined up in a group picture. When I tried to navigate to the page from my note inbox, I got the error "user has voluntarily disabled access to their userpage", which was a big red flag for me. He has since reactivated his page. Worried that an artist had taken my money and run, I tried using his paypal address to email him, and to my relief he responded the next day. He assured me he would be providing a refund as soon as he could, but couldn't due to issues in his personal life. https://imgur.com/LHNOaEr I expressed my sympathy and asked for a deadline for a refund, and he said it could be up to a month, but he'd try to get it to me earlier. After a month of no contact and no refund, I reinitiated contact via Paypal by opening a dispute. Paypal's first step of the dispute process is simply the Buyer (me) contacting the Seller (Fr0stbit3). I explained what had already happened and informed him I had opened a dispute for this reason. He responded with "I told you to be patient with me" while simultaneously denying he had received any previous email from me. After that I realized that he was not going to be willingly provide any refund to me, was providing no revised deadlines, so I escalated the dispute to a Claim in order to have the transaction refunded. https://imgur.com/qkgo9uV He proceeded to send me several messages on FA, urging me to check my email. I did, and saw nothing, until I thought to check the email address I use as my Paypal. He also seemed to be confusing me for someone else named "Matt". https://imgur.com/YKjhrvO I checked my alternate email and found this from him, finding out that he'd gone back on his promise of a refund and went ahead and completed the image. I found this surprising, as he'd never even mentioned the possibility of him actually completing the commission, he'd only spoken about refunds. I also found it surprising that rather than actually send me the completed image to complete the commission, he'd chosen to hold it hostage instead. https://imgur.com/yBjpVIW For organization and clarity's sake, I forwarded the email he sent to my own email address, that I'd used to initially contact him, forwarded it again to him and then reopened our email thread, so that he could easily see my prior messages and stop having me confused for whoever Matt is. https://imgur.com/gK4yCmt I used slightly sterner language in response to his decision to hold the image hostage rather than fulfill his end of the transaction. I made it clear that he had communicated to me that the image was not going to be completed, and that I had been waiting for a refund. At this point, I had no interest in the completed image, as this commission had proved to be an extremely frustrating experience. However, I was very much looking forward for this experience to be over, so I made it clear that if he wanted the dispute to be resolved, he could just send me the image and I'd call it even. He responded as you can see above, with a pixelated/censored version, insisted that he could not trust me, and that he would only send me the file after I dropped the dispute, reiterating it with two emails in a row, making sure to mention in both that I could not be trusted. I was honestly surprised to see that he had done the image, but he still had not sent it to me, only a blurred version, so his part of the transaction was still incomplete. https://imgur.com/WnHAltB I did my best to clarify my position and made it clear that the Paypal claim existed because he had failed to provide what I had paid for, and that if he fulfilled the transaction, the claim would be dropped. But he doubled down, refusing to provide the image, and also claiming he never provided refunds. https://imgur.com/qqWOPKn Despite my better judgement, I tried to make the situation crystal clear about how the ball was in his court, and that he could either let PayPal settle the dispute or provide the full image to satisfy the claim. I did not have much hope for the results, and I was tired of arguing, and made it clear that it was my final communication. https://imgur.com/GTO96pO He then proceeded to be far more public, filling my shoutbox with messages. I provided a shout back asking him not to contact me unless it was with the image or a refund, via Paypal or email. I then blocked his Furaffinity account. https://imgur.com/KwZcvIF PayPal resolved the dispute in my favor, and they forced the refund. I was content to drop this particularly frustrating experience and move on, but I then received another email from Fr0stbit3 informing me that he would be appealing the claim and providing screenshots to PayPal, and also threatened to write a Buyer Beware against me. I was not overly concerned, as the screenshots demonstrate several times that he refused to provide the image he was paid for. https://imgur.com/7AfpLsB A few days passed and the PayPal dispute was closed, again, in my favor. Fr0stbit3 responded by posting the image to his FA scrap gallery, which includes a depiction of my character and my character's name, with the title "Scumbag Wall", claiming I had cheated him. I reported him on FA for harassment. At this point, the situation has concluded. I have received my refund and am happy to leave it at that, though I hope the submission he posted is taken down after my ticket is reviewed on FA. I hope this Artist Beware entry will help provide context for this transaction and help warn other commissioners from attempting to do business with this individual. In addition, a design sketch for the fursuit. When: Payment in May 2014 — issues ongoing Explain: The issues I have experienced with OneFurAll (OFA) are twofold: an inability to manage expectations and meet contractual obligations, and lack of communication. April 2014 saw conversations with OFA regarding a commission, with estimate of an “18-24+ month queue” given. In May, I indicated my willingness to commission, and asked for confirmation of the wait time; I was told that there would be a more concrete “18-24 month wait. Our wait times shift minimally…” (see email 1); this was the final estimate given prior to payment, and with the qualifier of minimal shift, suggested that I could reasonably expect the fursuit to be completed at, or close to, 18-24 months. No further communication was made at this stage regarding the fursuit, only payment. Paid in-full via an invoice from OneFurAll in May 2014 (see Paypal Invoice). On 24th June 2015, in reply to an email from me, OFA restated the timeline to build to be "around the 24 month mark from your deposit" (see email 2). In September 2016, replying to another email from me, they stated it would be "a few more months" before work started, but that it was a good time to take measurements, which I supplied; while the time estimate had run-over, I expected work to start soon so chose not to raise a dispute. In June 2017, following my enquiry as to the expected timeframe, OFA said it would be "later this year when we'd be able to fit your character in" (see email 3). My reply to this stated that I would consider the end of the year to be an “agreement between us that this deadline will be met; if further events beyond your control mean the ‘suit won’t be finished by this estimate, please can you inform me as soon as you become aware of this?” I wished to make clear that I considered the end of 2017 a hard deadline. In January 2018, in reply to my chase email, they stated they still had not reached my position in the queue (see email 4). I therefore began the process of cancelling my commission. I requested a full refund, due to the unreasonable and excessive degree by which the build estimate had been missed (almost 2 years), and the poor communication received. I cited a clause I was sent in their Terms of Service during my preliminary discussions, which stated 30% of the commission price would be forfeit except in “extreme cases” (see TOS). I considered my case “extreme” due to time the process had overshot by, the exceptional and unforeseeable circumstances the studio had claimed to be going through which slowed production, and my communication issues. In response, OFA outlined that they would not offer me a full refund and said that the entire fursuit building industry has adopted a firm non-refundable clause, and also apologized for the communication issues I had experienced. They offered the opportunity to keep my fursuit in the queue (see email 5), with a promise to improve communication, which I refused. When they replied in February, they stated that their policy has “always been that we never contractually promise a start date” and that “we are still technically at 24+ months” (see email 6). They went on to say that their non-refundable clause was "firm" and they would not refund me in full; they said the “extreme circumstances” condition was intended to allow them to be sympathetic to someone who found themselves “in a genuine state of need...” citing customers who had encountered “…dire life circumstances and we helped as we could”. They found it “problematic” that I was referring to this term, and they felt that I had attempted to “reinterpret that outdated phrase against us” (see email 6 cont.). They went on to say in their February email that they would "no longer offer waiving that clause for any reason", and offered to refund my payment beyond the 30% refund penalty in 3 instalments (see email 6 cont.). I did not take this offer as I felt it unjust that they should retain the 30% penalty, and because I paid the entire commission price up-front and would feel more confident receiving a refund as one payment. They also restated that non-refundable percentages are a prevalent feature across the fursuit building industry and cited the TOS of 7 well-known makers (see email 6 cont.). Email discussion continued over refund amount, with little progress. Given the log-jam on both sides, I emailed OFA on 7th February 2018 offering a compromise: OFA get 10% retention on the full commission price (see email 7). Apart from acknowledging receipt of this on 5th March, I have yet to receive a substantial response despite regular chase emails. It now appears the process has broken down, and I am unlikely to receive any refund soon due to our lack of ability to agree over this dispute and the lack of response from OFA. As resolution to this issue, I would like OFA to issue a full refund. I do not believe they have upheld their contractual obligations to me, nor do I feel they have provided the level of service one would expect from a company I have paid almost $3000 to. I feel that attempting to withhold a 30% penalty constitutes an unfair term of contract given they have not indicated that they have spent anything on or worked towards my commission, and are likely to make up the entire amount very quickly in new commissions. In addition, I feel the application of a ‘no full refunds’ policy should have common-sense boundaries with protections for the customer laid out explicitly on the face of the contract. I can understand a refund penalty if a commissioner pulls-out within the given timeframe and simply does not wish to continue the process. However, taking $2950 up-front, providing a timeframe estimate and then missing this by two years should surely warrant the return of the full amount paid, especially when the customer is told that their wait will be 18-24 months with a “minimal” shift of wait times. I do not claim to know how other makers apply their no-refunds clauses, though if it is an industry-wide practice to do this, I feel it’s a sad reflection on how we are doing business with eachother. I regret that it has come to a point where I have needed to post this; as I have outlined to OFA, I sympathise with their position, the studio having been through many unexpected events of some gravity over the past few years. However, I cannot recommend the studio based on my experience, having been left disappointed with ephemeral time estimates and difficult communication on many occasions. [Top note.]) Unread. 3 May 2018: I leave the artist a courtesy message on the artist's DA profile stating my intentions to write a PSA on Artists Beware. (Proof 23.) There is still no response. I also have not seen any of the YCH sales completed and posted, but cannot verify that they were never done. Given the circumstances, I am aware that if the artist's main income is through art, then regular output of sales and adopts is to be expected while the artist works on a commission. This was never the problem. The problem was the lack of communication and continued lack of communication. As it stands, I have no finished product and the artist either refuses to get in touch or has neglected to for whatever reason. The real lesson here is to never let an artist drag you past PayPal's 6-month buyer protection period, regardless of their reasoning, unless they have solid communication and steady visual updates. Basic Overview: I commissioned BigBlueDragon on August 19th 2017 at Furrydelphia in the Dealers Den. The commission was of an led headshot badge of my fursona and the expected date to be finished was September 4th. My badge was fully completed February 18th 2018, and the last date of contact I had with BigBlueDragon was on March 11th 2018. (Hence this post) The Detailed Answer: August 19th 2017: Commissioned the artist in the dealers den at Furrydelphia and paid $21.20 in cash, upfront. Was informed that the commission wouldn’t take long to finish, and I requested a finish date for September 4th. I was informed that the artist worked from Artnab.net and that all updates and communication could easily be done through that website. Pictures of my fursona were taken from my badge before I left the table. August 21st 2017: Furrydelphia ended and I uploaded a brief description of my fursona as well as corresponding images on Artnab. August 30th 2017: Posted my name and address through Artnab. September 16th 2017: BigBlueDragon responds and has a sketch of my sona after the requested due date of my commission, communication becomes fairly consistent through the month of September and October and then becomes spotty in November. December 2nd, 2017: I reach out to BigBlueDragon using the email provided through Artnab and communication slows down but is still consistent. Progress on the commission continues through email due to difficulties through Artnab. By the middle of January the digital headshot has been finished. February 1st 2018: I reached back out to see the progress on my commission and received an email on the 18th with an image of my completed commission, printed, cut, laminated, and led, all done. I ask when to expect her within the mail, and I receive no response. March 3rd 2018: I email BigBlueDragon about an update about my badge being mailed. I receive a response on March 11th asking for my address again. I respond with my name and address hoping for my badge to arrive in the mail in about a week. March 26th 2018: I reach out again to BigBlueDragon about my badge and express my concern as the badge has been completed, and yet hasn’t been mailed out. At this point in time it has taken over 7 months to complete. April 26th 2018: I sent out another email to BigBlueDragon asking about an update on my badge being sent out. I have yet to receive a response. It has been 8 months and 3 weeks since this badge was commissioned, and it has been 8 weeks since I last had contact with BigBlueDragon. I have even tried to reach out through the website which they and their partner co-run, and haven’t gotten a response to that either. I believe my timeline and images provide a good chunk of information about the main problem, communication issues. In the beginning things were great through Artnab, I was posting stuff, I could see that they were looking at my posts and responding to it. I believe the issue in communication started when my references for my fursona seemed to be overlooked. The process dramatically slowed down as I had to point out issues one at a time and work them out until it met my approval. Once Artnab was giving us trouble, we switched over to email where our communication became slowed down further to hearing from BigBlueDragon after a few weeks at a time. Currently, the main source of frustration is that my badge has been completed, and I have yet to receive it. They originally asked me to send as Friends and family, but I said I was uncomfortable with that and offered to pay the fees for them. They sent me an invoice, which I was comfortable with because invoices are more secure. They gave me the image files and all was fine after. About a month in, I was contacted by a user, who I won’t mention, stating that their longthing looked eerily similar to one of mine. I agreed and sent Glider a note about it. (I later learned Glider isn’t as active where I contacted them, so that’s not an issue). I then contacted Guro and they stated it was a custom. I was still very wary, but I accepted it and just kept things quiet while I did some research. Things got busy, IRL, so I dropped the thing to take care of my life. Glider posted a journal to FA today, April 11th, 2018. And stated there was a tracing issue. I asked in the thread, for someone to note me the name of the user. I was noted, by SEVERAL people, that it was guro-boy. This prompted me to message glider, who was active on the site, for confirmation. They confirmed my suspicions and stated I was sold two altered long things. As of currently, I have filed a dispute asking for them to VERIFY the legitimacy of these longthings, but I will be escalating it to an immediate claim. One near the front-most ear and on her dress (link 2 and link 3). So, I logged into my OLD account and proceeded to message them at my earliest convenience that I have received the badge but displeased with the fact there was two hairs inside my badge that were noticeable to the point of unable to enjoy my badge (link 4). They asked to see the images which I happily obliged. An issue occurred and imgur didn't want to link the two images together to be sent. There I sent them separately for them to be able to see (link 5). They acknowledge the first hair and apologized for it. However, what next threw me for a loop. They only offered a $4 USD refund or a $5 OFF next commission purchase. I was shocked and a bit almost upset as I didn't want a refund or a discount. Just wanted my badge fixed (link 6). I sent another image with the second hair with a zoom (link 7). So, understanding that markers cost money I offered with a bit more of a discount to have them just re-draw the image or if they could re-do the lamination. I wasn't expecting anything free just a bit more in the way of compensation for artist error this can be seen in link 6 of our discussion. Instead they tell me that they cannot offer more and I have the scanned version and just to print it out myself and links of this discussion can be seen in link 6 and link 7 as well. I don't own a printer and if I printed it out I would have to pay for it via a store. I explained to them that not only would it cost me money to print it out but to laminate it. As well I wouldn't be able to get the holographic version as I do not have the means to do so. That a $4 refund was not enough for damages made to my card. As well the quality of a print out version was not what I paid $22 dollars for. I made it a note that I feel this is not fair to me (link 8). Their reply was more that beware worthy on my end. They told me I have the artwork (ruined by animal hair, mind you) and the digital file. That my $22 paid was enough to cover that and to be happy as it was a good deal. As well they just blew me off and says just not to work with them again. They also made a comment of "feel free to do the work I had to do to find the overlay and make the work to your own standards" (link 8). I was devastated and with that attitude I felt they were not going to give me any sort of compensation. Luckily, I was able to go to paypal and force a partial refund of $8 USD as my friend told me I should have pushed for half all I wanted was my picture redone. EXPLAIN: In 2016 I ordered a 2 character sketch from Hornedfreak totally $40. Payment was sent via Paypal on September 3rd 2015 PROOF: Number 2 in screencap. In March 2016 I asked for the characters to be changed, since they had not even shown me a sketch, as I had changed my idea. (they said they had a sketch of a sketch but what even is that?) In it I describe that if they didnt want to do the old sketch (I still thought it was one character missing at the time, so my bad!) that they could just sketch a single different character and all would be good. I did say feel free to ignore the request though, not the note! They then noted me again saying that they did find the note they had ignored months before, which was before their journal they linked me. I waited a week, and they said it would be done. Then a month later I heard it would be done by the end of August. In late September I asked for a refund and they said they would give me one, as over two months had passed at this point and I was entering school again. Since then I periodically checked in with them to see how it was going and heard things about them working on, but never answers that were too specific. They opened comms multiple times, and made promises that art would be completed but they've barely posted anything on their FA or Twitter since then. Now 8 months after my original comm they haven't read any of my messages in over a month, but are still active on Twitter. Additionally they seem to owe a good number of other people, and have no publicly posted queue anywhere to track just how many it is. As it's been over 180 days I'm no longer protected by PayPal or eligible for a chargeback, so I'm left without options. When someone in stream asked what this was about, she responded "someones trying to be a D-bag and if they do it ill ruin them and no one will ever draw for them again". These were posted publicly for all in her stream to see. (Pictures below) This is the first time I have ever decided to go through a charge back. I would have liked to work things out with the artist, but at this time the artist is refusing to speak with me. I have no way of contacting them myself, and at this point I just want to post this and be done with it. I am currently in the process of trying to get my money back, and writing this due to it being a bad experience. From my understanding, this is not the first time something like this has been written about the artist. I paid for work, the work was never finished, and now I want my money back. That's the short of it. Please note, all commission details were worked out in voice in Discord. Adiago and I had a good business relationship, and this is how most of our transactions took place. In this situation, Adiago had not started my commission at this point, and had me blocked on all her places of contact. I have purchased more in the past, but throughout 2017 alone I had sent Adiago a total of $555, not including the $195 chargeback. This also shows that this is the only refund I have had to request from Paypal against this artist. As stated above, I originally wasn't even going to make this post, even with the way she was treating me. The Paypal claim was resolved, and I would have liked to wash my hands of it. Adiago has taken this issue out of the realm of professionalism and made it into something personal. I would like to make the community aware of this unprofessional behavior, and ask to please take caution when considering purchasing art from Adiago. This is the first issue I have ever had with the artist when it comes to buying art, but the situation has quickly escalated into something I would like to be no part of. I ordered a pre-made head that came with a tail and custom paws, the maker was very eager for the sale and replied very quickly on FA notes until I payed via PayPal. [FA Notes screenshot] A couple of days later something happened in my personal life that meant I had a large bill to pay for, as things hadn’t been shipped yet and I hadn’t been told that the paws had started being made or received other notes so I tried to cancel the order. To which I didn’t receive a response for another few days, and was ultimately told that they had spent all of the money on new equipment as soon as they received it and don’t have any money to refund me. [FA Notes screenshots] We went back and forth in notes a few times before I was told that the paws couldn’t be refunded since they were custom and so was the tail, even though the tail was in the listing to begin with and there had been no photos of the paws sent to me to show they have been completed. There were no photos taken of paws that were sent to me at all, additionally I was told that they had been sent by priority mail. [Telegram screenshots] Up to this point I had been told a few times that they were having bad weather pretty much seemed to be on a daily basis that didn’t allow them to check emails/telegram/notes etc. I had also been told to contact them on Telegram as it was their preferred method and then after not replying to me for a long time they said they preferred email and would definitely respond within 48 hours which they didn’t unless it affected them monetarily later on in the year. [Telegram screenshots] I originally bought the partial, and ultimately just the paws, for CFZ17, but they never showed even after the delivery time frame was weeks in the past, remember it was supposed to be priority mail. I asked the maker to contact the delivery company about it and the maker waited weeks until they eventually did and told me that we had to wait until half way through July before a claim could be made for a lost parcel. [Telegram screenshots] July came and went after I sent a number of messages to no response, which is around about the time they changed their mind and said to email them since they no longer like Telegram. Time passes and I still hadn’t received a response from the maker so I filed a PayPal case on them since they wouldn’t refund me or respond to me after numerous attempts to reach out to them. [Telegram screenshots] I had an message effectively calling me a scammer and saying I was damaging the business and she couldn’t pay me anyways even if I won the case [Telegram screenshots] After a few messages they eventually agreed to pay part of the money owed to me, but not the full amount. A few minutes or so after the message was sent, the hateful journal appeared, which proposed false information about contacting her mate about her own art commissions. We’ve arranged the details and he established a time frame of when I expect to be added onto his queue of commissions, which was timed for roughly 1-3 months due to school. If I accepted this, all I had to do was send the info and money to his paypal and that would be it. I personally didn’t care about that brief waiting time and agreed. I saw how frequently he posted his commissioned art in the past shortly after posting an opening via journal posts so I assumed his working was swift. So, I sent the commission information and transaction on Feb, 18, 2016 and the transaction is below. Keep this date in mind. Proof of Payment Since that date, I have not received a single word or update from him to this day. I’ve sent several attempts of contact to him through this time frame throughout his various ways of reaching him. He has not responded to any of my future notes, neither did he read them. I thought something bad happened to the artist due to their inactivity on FA, but I have found their Twitter during the time and saw they were doing just fine. In fact, they were showing their current works in progress to their other projects, and socialized quite often on other people’s profiles... So I assumed he left FA and did his activities on the other platforms, being Twitter and I tried contacting him on there and, surprise, no response. These few attempts were spread out over the long time frame as professional as possible. I would’ve assumed he was heavily busy with emergencies, but after being on his other platforms and seeing his activity on there, that was far from the case. They’re all in the unread gold icons on FA. As for the DMs on Twitter, I’m sure they’re unread as well but here are all of the attempts, dates, and screenshots below. This also includes the final attempt. Attempt #2 · The third reach out was on FA was November 25th, 2016. Attempt #3 · The fourth reach out was via personal email on January 2nd, 2017. Attempt #4 · The final reachout was on November 11th, 2017 and for both his FA and Twitter that mentions a refund if he didn’t get around to the work. Final Attempt It’s almost been two years with NO word from his end while he continued doing his own business and artworks for both himself and other people along with socializing, and by that, I mean commenting on posts, quick scribbles and art trades for others, etc. while not acknowledging my attempts to contact him. I have no idea if my work has been started, forgotten, or if it’s even sitting there completed. The only exception was some minor tweet he posted about trying to get back on work for people in which I made clear for him on that post not to forget and he gave a small apology. That was last year. In the end, I learned he was not only working on other projects, but he was also posting current artwork and opening up for MORE commissions on FA and Twitter at some point. So this was blatantly ignoring my requests upon asking for some kind—ANY kind of update to the work I paid for. RossCiaco’s lack of communication to his clients and poor management of work gave a horrible experience for me and I’ve possibly lost my money with nothing in return. The professionalism is not handled at all with no attempts from him to contact me about why he was taking so long or had no alternative to compensate for such.
