    It might be a bit tough, but if you have a clear record of the money sent to them for your unfulfilled commission, I believe you'd be able to speak to your bank to get the charge reversed?

    Though that's a bit more legwork, but it's a possibility and not a bad idea to look for any avenue you can to get what you're owed either way.

    Dasker ended up contacting me a few hours after I sent the email. Apparently they tried to contact me via email on February 20th (4 days after our last conversation on Feb. 17th). It appears that I never received it and therefore was not notified. I am rather upset they never tried again and just let it sit, but there's not much to do about that now since it is in the past. We have since been in contact and are on good terms and I have decided to go further with the commission upon a lengthy discussion with them about the events that have unfolded. They do have a con coming up in the next week, so no work on my commission will be started until the following week.

    Despite all the has happened, I have decided to put my faith into Dasker once more. I am not closing/resolving this until I have the shipping number for my commission. I will update it again once more work has started and I receive more updates.

    Dasker has strung you along for three years and all you keep getting are fake deadlines to placate you. You have been scammed like a number of customers before yourself.

    You paid for a service which has not been rendered, and likely will never be! If they refuse a refund, that is theft of your money! A TOS is absolutely NOT legally binding ESPECIALLY when it benefits them to take money from others in the way that they have! 

    My percerption of your hang up on this fact makes me believe that you think this is 10000 percent legally binding and you cannot do anything, which is false. If someone runs off with your money and gives you squat for it, that is theft and no TOS in the world is going to cover their ass if you push for a refund for the product/service. Do not be scared to demand your money back, be firm in what you want; and the others bring up an excellent point. If you settle for your suit now, it’ll be rushed and left stained with the funk of this situation you were put through. It isn’t worth it to have that sitting on your mantle when you can reinvest your funds in to something else with a maker who is far more reliable and communicative with their customer base.

     

    Do not be afraid, ask for your money back. You have plenty of support for this option!

    I went ahead and talked with some friends who helped me write an email to Dasker regarding a refund on my commission at 11:35 AM today. I asked for my entire deposit of $287.16 back considering there is NO WAY they used it for materials for my suit. I have attached my entire email below and will attach their response if and when I get one.

    It is also very frustrating to read a beware like this.  I am upset that Fox is treating you poorly and that you can come here and tell us how you feel, but that you haven't been firmer with the artist.  I think you should tell the artist how much this situation bothers you.  I understand you are trying to be nice, but passive disappointment and just looking sadly at e-mails isn't going to resolve this!

    I feel like after all these years, I said what I needed to be said in the last email. At this point, I feel afraid to email them again because I think they are just giving me deadlines to satisfy me for the time being. I know If I email them again, they will continue to give me another deadline that won't be honored. I really don't know where to go from here.

    Due to their TOS (which HEAVILY BENEFITS THEM), I can't ask for a refund. I paid the non-refundable deposit but at this point I am 99% sure it was not used for materials to go towards my suit and more likely towards a con. Asking to cancel would forfeit my money in accordance to their TOS.

     

    Also an update. They said it would be done in March in the last email, and it is now May. As I said above, I fear emailing them due to them most likely giving me another false deadline to keep me quiet.
