I asked for advice back in June, and since the situation is more or less "resolved", it's time for me to put it all together and post this as a warning to others. I commissioned Jace at the end of November in 2014, the same day he put his commission post up. He's an art idol of mine and I'd wanted art from him for ages, so I jumped on the opportunity. He always seemed very professional to me, so a $150 commission seemed like a good idea at the time. The original commission post said they would be finished by Christmas (2014), and he sent me the sketch WIP on December 12th. http://i.imgur.com/Jy4btWg.png The WIP at this time: http://i.imgur.com/Vs5UUDe.jpg At that time, he said his plan was to send out more WIPs that weekend and have them finished the next week. http://i.imgur.com/TpYsWTe.png After that message claiming that WIPS would be sent out that weekend, I didn't hear from him again. In fact, he seemingly disappeared from the Internet altogether. Not too strange, possibly, considering it was the holidays. However, he had made a firm promise of a deadline, and with the commission being $150, I was a bit more wary than I normally might have been. I let the Christmas deadline come and go, but on January 10th I noted him asking for updates: http://i.imgur.com/keQ7LmU.png As it is still, it went unread and unopened. I continued not to see any activity on DA, Tumblr, or anywhere else. I was getting worried, mostly due to the $150 amount and the fact that I have been burned before. Since I hadn't seen him open my note, I decided to email him in hopes of getting an answer that way, on January 24th 2015: http://i.imgur.com/rvEROmB.png And I never got a response to that either. On January 30th, I sent Jace an email and a note on deviantArt telling him that I would be opening a Paypal claim. http://i.imgur.com/dDiUr7J.png As I say in the message, it was mostly to get the money back in case he was unable to access the computer as I didn't want to let Paypal's claim window come and go. Even with Paypal's claim window having been increased to 180 days, I felt uncomfortable enough to do it at this time given his complete lack of responsiveness. Jace must have seen the claim, for he mysteriously reappeared just a few days after I opened the claim. I received the next WIP on February 2nd, 2015. I cancelled the Paypal claim at this time, despite the fact that he made absolutely no note of it or that he had even seen it. http://i.imgur.com/S3umDjv.png The WIP he sent at this time: http://i.imgur.com/ZTqd2N0.jpg It was quite off putting to me that he made no mention of the claim or the wait much at all. But, then again, I felt a bit bad for filing the claim in the first place -- especially with his reasoning of mental illness. I figured, since he had given me an updated WIP, he would have the piece done pretty quickly. My response to him is here: http://i.imgur.com/kiuiFpu.png which he never responded to either. More radio silence. I sent him a note on May 15th, 2015: http://i.imgur.com/8gJHWmT.png to which I got no response. (I do believe he opened/read this note.) The next time I heard from him was in June of 2015, strangely and conveniently after I sent him a note telling him that I would be contacting my bank about the money (given that Paypal's claim window had then passed for me, by a few days) and posting an Artists Beware post about the situation. http://i.imgur.com/RXa81Ov.png (He was still active on tumblr during this time.) His response, with a slightly updated WIP: http://i.imgur.com/fwz0yd0.png The WIP at this stage: http://i.imgur.com/UHguQJN.jpg This was when I posted asking for advice on A_B. I was mostly just pleased to actually have him RESPONDING to me again, and at this point I assumed that if I went ahead and posted the A_B on him right then, I would NEVER get the piece. So I tried to get him to agree to a deadline. He then agreed to have the piece finished by the end of July, 2015. http://i.imgur.com/aIMFmDP.png http://i.imgur.com/YVLH7OX.png So, another month and it would be done. Obviously, that came and went. Surprisingly, he took the initiative to note me on his own on August 1st, telling me that his tablet had broken. (I had already seen him post about it on his Tumblr, which he was continuing to update regularly with paintings and posts.) Again, pleased that he was CONTACTING me and not ignoring me, I accepted his claim that he would have it done the next week. http://i.imgur.com/1Nk8ri2.png http://i.imgur.com/A3sUxI3.png Aaaand that didn't happen, either. He did not contact me again past that point, AT ALL. (I send him another note on September 3rd, 2015: http://i.imgur.com/BbhcdiY.png ) In fact, the only way I got him to contact me again was rather direct and annoying. On top of updating his Tumblr regularly while ignoring my messages, he had gotten into the habit of streaming quite regularly on his Twitch account. Sometimes games, sometimes painting personal works. I subscribed to the channel, and was receiving emails whenever he started streaming. At first I was just happy to see him working on something, and didn't interact with him. However, when he continued to ignore/"not see" my messages, I decided to bite the bullet and reach out to him during a Twitch stream. On October 25th, 2015, I entered his Twitch stream and inquired after my commission. He had his mic on, so I don't have a record of his responses, but here's the chat: http://i.imgur.com/jOrPowU.jpg Basically, he reassured me and told me a very long story about how he had gotten locked out of his DeviantART account AND the email account associated with it, so he hadn't been able to log in at all. He promised to email me after the stream. He sent me an email that night and he attached another WIP and claimed it was pretty much done, just needed to be cleaned up and tweaked. (Note: this was quite a small screenshot that didn't allow me to see closer details.) http://i.imgur.com/d7KZdbe.png My response: http://i.imgur.com/vW59uJl.png The WIP he sent at this stage: http://i.imgur.com/3kNQwSj.jpg And, again, that was the last I heard from him. I actually let him be for a while after that email, mostly due to how incredibly fed up I was at this point. Plus, he said it was close to being done, so I figured it wouldn't be long. Again, wrong. I emailed him on January 12th (3-4 months later) asking if he had any updates on the piece or on his situation. http://i.imgur.com/Lr2bYa6.png I got no response. He continued to be active on Tumblr, quite regularly posting text posts and art. So, on January 27th, I emailed him. http://i.imgur.com/1uUNoke.png Of course, I do realize asking for a refund at this point may seem out of line to some, but like I say in the email I figured it would be the easiest way to resolve it. I didn't want to wait around forever to get the finished piece and would have been satisfied with the file as-is and a partial refund, even 10% of 25%, ANYTHING so that I could FINALLY take it off my list and forget about the heartache. On January 28th, 2016, he emailed me and claimed the piece he had sent in October was the finished piece, minus the rendering of one hand. He then claimed he would send me the finished file as soon as he smoothed out the hand. As well as a quite P.A. comment about the fact that if this had been for a freelancing company, it would have cost me $2000. http://i.imgur.com/V2OP8si.png Half an hour later, he sent me the .psd of the 'finished piece'. It is almost entirely unchanged from the screenshot from October. And, to my dismay, it's quite rough and not as refined as the sample piece he used for his commission post. There's a part in one of the character's irises that bleeds into the eyelashes, really badly. The ear is a block of unrendered, unfinished painting. The male figure is very rough and untouched compared to the female figure. Overall, the entire thing is quite sketchy, quite unrefined, and quite unfinished -- when compared to his sample. At the very least, it is not what I would hope for after over a year of waiting for a $150 commission that had a much more refined example. I'm NOT happy with the piece, but I sincerely doubt he will ever give me any partial refund (the piece is, after all, 'finished' according to him) and I don't care to see how long it would take him to refine the piece more (I'd prefer not to wait another full year, really). And while I feel the end result is not in line with what he was offering, my complaint is about his unprofessionalism rather than the art itself. Art is subjective, and though I may not be happy with the piece, it is "finished" in his eyes. My gripe is his refusal to keep in touch, the constant ignoring of my messages, and the continuously broken deadlines. In the end, this is a beware to all other artists and commissioners out there. Do not commission Jace Wallace. I have no clue if he plans to ever open commissions again, but if he does, it's not worth it. This is hands down the most frustrating experience I have ever had with an artist. It's not even the year+ wait that bothers me -- I've waited that long before, I'll wait that long again. But EVERY time I attempted to contact him, I was ignored, unless I had made a direct claim that I would be pursuing action against him, or I approached him directly IN PUBLIC. (There were a few times when I commented on his submissions on DA or profile on DA, but he has hidden the comments at this point.) He set deadlines, and then he broke them with nary a word. He made excuses, avoided contact, and continued to be active on Tumblr regardless of the owed work. At least with other artists I've had this problem with, they disappeared entirely. With Jace, he was still active on Tumblr almost this entire time, just deliberately ignoring my messages on DA, Tumblr (where he was active, WHILE HE WAS ACTIVE) and via email. In the end, I feel disrespected, insulted, and disappointed - and I don't want anyone else to go through the same situation. EDIT: The final email he sent to me, after I submitted this A_B post and informed him I would be doing so.

No artist is perfect, and surely no artist is bulletproof. I hope any fans of hers will see reason, and not an intent to do harm. This is my story. About a week ago from writing this (July 1) AshleyZombie canceled my commission because of con booth prep and "personal issues." I asked her to not do this, that I was willing to wait until con season was over and she was ready. But she did not want to hear any of it. She then kept half of the money I gave her for the commission and sent me a terribly done rough draft of the image, which is not what I was paying her for nor do I think it's worth half of the amount she charges for a fully rendered painting with cleaned lines and refined color work [see example here]. I expressly told her I don't agree to these new terms for a half payment, and that because she is the one canceling our project, that she is breaking our contract. She then slapped me with a bunch of horrible terms from her ToS page, which we never discussed beforehand. I initially contacted her on Tumblr after seeing a post about her being open for commissions — which was back in May, so over a month ago — and we hashed out the beginnings of what I thought would be an amazing commission project. Not once did she mention her ToS, and furthermore that because she was the one breaking our contract that she has no right to enforce her ToS onto me. It's already bad enough that to be on her commission list you have to pay 100% upfront. But now that she's able to cancel any commission she chooses, and is able to keep half the money for doing very little work, is a VERY BAD business practice. If all you are going to do is open for commissions, then cancel the commissions you just took while barely working on them just to keep half of the payment, then maybe you shouldn't be doing commissions in the first place if you do not plan to complete them. I understand bad things happen in life. I am completely forthcoming about personal issues, and I am willing to bend over backwards to help you out if I can. But this is something I feel she is doing to take advantage of clients, who will mostly remain silent and let these things go. I did not feel this was fair for her to do, and I was more than happy to negotiate a new settlement for the work she has done. However based on separate terms unrelated to the canceled commission. If you start a commission for a digital painting, and the end result is a rough doodle, then I am willing to pay you for a rough doodle. Just to put prices into perspective here, she was offering commissions for half-body and full-body paintings, at $100 and $180 respectively. I am glad I only purchased the $100 slot, because if she considers what she gave me to be worth half of $180 I would legitimately lose it. Either way, the practice of canceling someone's commission and charging them half for very little work is most unbecoming of her reputation. I haven't even mentioned the communication timeframe, usually taking weeks before getting a response. For the most part I was quite unassuming. After the first day of making payment, on May 16, she told me she would be able to send periodic WIPs. About 8 days later, on May 24, she sends me a rough sketch of my character which I absolutely adored, and told her to continue on after making some small fixes on the character. Again, another 8 days of waiting for a response, and on June 1 she informs me that there are no updates and to check her commissions queue. That didn't help clarify what was her situation was, but I reassured her that if she needs time to just let me know what's going on and keep me in the loop. At this point I ask her to let me know when she thinks she will be able to resume or get back to me about my commission, but no response. Twelve days later, on June 12 she finally responds with an update asking me to confirm the color palette and eye color. I comply, and I confirm the things that are correct and things that aren't correct. However I expressed slight dismay at the fact that we never discussed the changes to the preliminary sketch that was first drafted almost four weeks ago, and that the changes needed were not reflected in the update. I even clearly stated the issues unaddressed at the end of the email, verbatim. She then reassures me that the corrections will be reflected in the final painting, but I was already having doubts — my trust in her to do what she says was really all I had left to rely on. I tried to press on a conversation about the initial changes to the first draft, however that was shut out with another 4 days of silence, and finally on June 17 I received a response comparing the first draft to the second with color. At this point I was somewhat troubled by the lack of progress on the commission. An entire month has gone by, we haven't discussed the details or how we should go about fixing said details, I am receiving updates arbitrarily which only address the artist's concerns and not mine, and I personally found myself frustrated and contemplative about the appearance of the initial draft. So I withdrew my responses for a time, as it seemed the artist was not interested in having a conversation about my commission. I had the intention of responding later, or looking forward to AZ keeping her word that she will make the changes I am asking for in the next update. That was not to be so, because a week later on June 23, she sends me an email. "Hi, i hate to be doing this but im send out refunds to clients that's waited over a month or so due to the fact that i have con prep to worry and i've been slowly burned out with work. I've got a lot going on irl too and I've been stressed about it I don't think im doing this character much justice and im not following the guild lines too well with whats shown on the page. This character's been sketched and colored already so i'll be giving you a partial refund. I Just need your paypal email and i'll send you the full image when i send the money back !" Basically she's decided to scrap the project for her own reasons, but also — by the way — she'll be keeping "part" of my funds as tribute for her efforts thus far. Under different conditions, as I stated before, I'd have been happy to compensate her for her efforts. But the way this was imposed upon me, with disregard for her own incompetence by not completing her end of the deal, seemed to have disingenuous intentions. I sit on this email for about a day, contemplating alternatives and then I arrive at a solution. I ask AshleyZombie to reconsider putting the project on hold until she is able to collect herself and is ready to continue, preferably after "con" season. I was open to a new timeframe, and expressed that I'd be happy to wait. She refused, twice, and it was basically a one-sided conversation. Actually, come to think of it, the entire conversation since day one was very one-sided. I'm not very aware of many one-sided business conversings, but they usually don't end well for the receiving party. A few more emails, and it seems she's actively pushing for me to just accept what she's saying. From her tone, I can tell she's frustrated with my noncompliance and pleading. And to be fair, I am just about as equally as frustrated with her unresponsiveness and authoritative diction. I grind our pleasantries to a halt and let her know my thoughts on what she is trying to do. Specifically that I do not agree at all with her new terms for a partial refund for an item I do not want in its current state, at a price of her choosing. I lay out the barebones of our contract and how she did not complete her end of the deal. As a result, I asked that she consider completing the piece at full price — or that I demand a full refund and that she keep her incomplete efforts. Perhaps to count it as practice work or something to stuff into a sketchbook. I tried my best to be reasonable and logical, also taking effort to acknowledge her "apparent" hardship. But even this was met with incompetence, as she accused me of trying to bully her into not paying. I told her I would consider paying, but under arguably different circumstances. Nonetheless, seeing as how negotiating with her has gone so far, I wasn't optimistic that she would agree to anything else. Then she slaps me with her ToS. Which states that if the client should ask for a refund, and if she is halfway finished with the piece, that her terms would apply as such and a partial refund of "half" of the original commission price. And that would make sense, if I were the one requesting the refund. I even told her if I initiated the refund, I would be okay with paying half. But that isn't the case by far, and the complete opposite is true. She has termination terms, but she's exempt from terminating herself? And because she's broken contract, I don't understand how her terms can still be enforced. That got cherry picked to mean what she wanted it to, and as such she says it doesn't matter who initiated the refund. That if the work itself is halfway done then she is entitled to half of the payment. No negotiations. Had she simply imposed a cancellation fee, she wouldn't be able to enforce it. Our situation wasn't any different. That out of the way, this argument continued for one additional response from her, basically telling me that I'm bullying her, that her ToS are to protect her, etc, and that she will be enforcing her terms regardless of how wrong she was for breaking our deal. So far, I am taking this up an echelon with PayPal. Hopefully they will be able to resolve this issue where I cannot. And if they can go no further, I'll take it to civil court if I have to. It's the principle that's going to cause more harm in the long run, in my opinion. And not just from AshleyZombie, but from other similar-minded people as well. This is what I expected to get. [link] And this is what I got. [link] Still, the issue isn't about worth. It's that the original deal was not honored. We agreed on $100 for a finished digital painting. But instead of that, a new deal was shoehorned into this one, involuntarily, for a partially completed work for half the cost of the original price. Which I never agreed to. However it will be difficult for her prove what constitutes as a "half work," and what justifies "half payment" based on her ToS. Had this been a normal cancellation fee, I'd gladly pay it but... wouldn't you know it, I didn't cancel? Please beware of this artist, and others like her! UPDATE (July 11) PayPal has ruled in my favor. The case is now closed! Proof of decision (July 10) I also discovered that AshleyZombie reopened commissions not even a few days after canceling my commission! This means she lied about her reasons for needing to cancel, in stating that she needed time to de-stress, etc, yet just hours later she reopens extra fresh on Twitter. In other words, AshleyZombie is accepting commission slots, only to later cancel any commissions she doesn't want to do while keeping half of the money given to her by clients. Do take note she leaves that part out, as if a full refund was offered. This is beyond reprehensible. Please be VERY aware of this before commissioning her. I'd offer to help revise her refund policy, but for someone to scam their clients like this I cannot bring myself to want to help. A few more updates regarding soaru’s recovery and commission progress were posted between August 2014 until August 2015 (I will get into these in my explanation below). The final update on August 25th 2015 was about her recovery and any updates for commissioners, and since then the account has been dead. PROOF: commission note paypal transaction EXPLAIN: As stated above, soaru had been diagnosed with Carpal tunnel syndrome. She posted a journal about it on May 14th, 2014 and continued updates on her situation. When soaru had opened commissions, I sent her a note expressing my interest, and the agreement was made on July 17th. I sent the payment the same day. On July 26th 2014, soaru posted a new journal stating that she had unlimited pixel slots open for the summer, ( https://i.gyazo.com/ff5ccf459452bb685191edc39e486352.png Journal link: http://soaru.deviantart.com/journal/work-work-work-470968786 ). I didn’t think much of this at the time. She asks for our patience due to work and having to take breaks because of her carpal tunnel. I was in no rush for my commissions and only wished for her recovery, as I really couldn’t imagine how awful it must be to suffer from carpal tunnel as an artist.. She adds “I did not forget about your commission, don’t worry.” The next update was on October 6th 2014. Soaru states that commissions are now closed for a good year or so. She tells us that she is very busy with work, so commission progress is moving very slowly, and apologises for the wait. I can appreciate that she is going through hard times, so a few months isn’t much to wait given her situation. “I will not update you on how your commission if coming along because there are too many of you to note. I assure you I WILL complete the commission as soon as possible. So please be patient with me. You will receive your commission when you get it.” And no, I have no idea as to when you will receive it, and for that I'd like to apologize. I also won't be providing any refunds. You will get what you paid for.” I’m a patient person and I could appreciate that taking unlimited slots as there would be a lot of people on her to do list, but looking back now, not receiving any kind of progress report on how your commission is coming along is a pretty bad sign as well as stating that you have “no idea when a commissioner will receive their commission.” But again I was willing to wait and a few months wasn’t anything to complain about given her life situation. Apart from posting a journal in December asking if her commissioners would mind if she used her new base for their commissions or not. At the time, I simply thought she’s stated many times she is working hard to get these done so over the course of months hopefully her list will get shorter and shorter, and she will get through these and can look past this tough time in her life. She says she should be able to start commissions mid-September. She says she’ll be sure to post a journal update, as well as join.me streams of commission work, and finally that “You will also be provided with WIP's of your pixel so you know I'm actually doing your commission.” I cannot speak for everyone on her list but I have not received any kind of work in progress shots from soaru. Since then, soaru had provided no updates about surgery dates, delays, or any kind of work in progress to assure people that she was indeed trying to work on these commissions as she had been stating for the last year. Many of the comments on her page and in her journals talk about the lack of any kind of update given the situation and the wait for all of her commissioners. Soaru is even ignoring notes and comments from her clients. Many of the comments urged her to think about trying to refund even just a few commissioners to lessen her workload and to just resolve the situation as quickly as possible. Soaru also states that once her recovery is over she will be working her hardest to finish all of her commissions in response to another comment. However, in my sent notes it is marked as read. Around late February, a friend and I (who is also on soaru’s to do list) came across a deviantart account named dollrot, but recently changed to hatchimi. At the time there was no evidence that hatchimi and soaru are the same individual, however we did find her art style to bear very close similarities to soaru’s. For some time we just kept an eye out since there wasn’t much posted to hatchimi’s gallery at the time and it could just be a similar style. Now, the evidence we have found that positively links soaru and hatchimi as the same person was something I noticed when hatchimi posted her artvsartist meme. Another commenter then claimed that it is possible to run a test on images which will tell you if the image has been edited, and the screenshot came up as edited in photoshop, so this tells us that the note screenshot is fake. Now when I purchased the adopt they make it a requirement that we adhere to an agreement called the Ferrin Adopt Agreement. this agreement is updated regularly and I can not provide the version that I initially agreed to or the version of it that was enforced at the time I was blocked. The reason this is important is because in the version of the Adopt Agreement I was bound to it stated that if I wanted to sell an adopt I needed to inform Demu of it first, with me being blocked, I could not do so in any way shape or form. So this for me potentially dissolved our agreement as that can happen when one makes it impossible for one party makes it impossible for the other party to fulfil their part of said agreement. So by blocking me everywhere, Demu essentially nullified the Adopt Agreement between us meaning it did not apply to me any longer or the Ferrin I adopted. But the opposite could also be true as the full legal depth of it is rather tricky as it's essentially impossible to copyright a species based on a design and words alone, because of how copyright law works. So for me I was left in a sort of limbo, and wasn't exactly sure how to progress. So I settled on a compromise. I would bind myself to the majority of the Agreement as it was written on the date of me being blocked from contacting them via email, I would check Demu's account once a month to see if I'd been unblocked to establish that the Adopt Agreement would then be reestablished between us as the original issue was resolved, and in 1 year (October 2nd 2017) if I was not unblocked, I would check the new Agreement and decide if I wished to follow it, if not I would ask a friend to contact Demu and notify them of this and state I wish to sell the design to not cause a conflict of interest. i tried to illustate this ion the ferrin I adopted with the Artists Comment box that comes with everythign one uploads to FA and such sites (This screen shots were sent to me by Demu's staff as their evidence against me https://drive.google.com/file/d/0BzhBESqCaxDiUFhKQVg0M1RmN3hHNVZUcEhnNllseHJzWkpN/view?usp=sharing)That was the plan anyway. I once had further evidence that would support this claim entirely, but I have lost it since my laptop broke and my bookmarks did not import entirely when I used a temporary one. Anything else would be conjecture at this point and I'd rather we all deal with facts. I as an individual know my faults in this and can learn and grow from it, I can explain some of the issues Demu and his aid have with me but again that would be conjecture. Their original act of reclaiming the character was not a power they were granted by Elty and as such the official statement by Elty the Whitevale team is that it never should have been taken and that the act was more or less a type of theft on their part, caused by a singular member of the team (who has now lost their position). So the issue is resolved.

May. 23rd, 2011 at 4:22 PM jakejynx It's ridiculous that I have to make this post over something so simple, but this person has stopped responding to my emails, and has ignored the Paypal claim that I filed. On May 5, I posted a journal asking if anyone had some sparkle furs on hand that they would be willing to sell. Evilalcarne responded saying she could sell me some lime green fur. I paid $10 for the half yard of fur and $10 for shipping on May 7. She responded the same day, saying the fur would be shipped out on Monday. On Tuesday, May 10, I sent an email asking for the tracking number. She told me that she had stopped by the post office that day, but that her mother had the tracking number, since she was the one who went to the post office. On May 13, I sent an email asking for the tracking number again so that I could be home to receive the package. I received no response. On Monday, May 16, I sent another email telling her I was getting worried. Shipping from FL to GA takes two days at most. Even parcel post is a quick ship. I once again asked for the tracking number. She responded with "it's around here somewhere." And that was the last message I received from her. I sent a final stern email on Friday, May 20 telling her that I expected either the tracking number or a refund by the end of the day on Saturday, or I would be filing a Paypal claim. I received no response. A Paypal claim was filed late Saturday night, and it was not responded to. Today I escalated it to a claim, and I'm fairly confident that I will receive a refund, given that she is apparently unable to show proof that the fur was shipped. Please avoid transactions with this person. Communication is spotty, and she apparently can't be bothered to give you the tracking code on packages. Update: The fur actually arrived today via UPS. However, according to the tracking number on the package, it wasn't mailed off until May 20. That's 10 days after she claimed it had been mailed. Though I sincerely doubt it was $10 to ship, considering it weighs only 11 ounces, the UPS shipping calculator is apparently down right now, so I'm unable to get a price estimate. As if that weren't bad enough, when I opened the box, I quickly realized that it was not the half yard that I had bought. She sent me an 18x18 piece of fur (a half yard would have been an 18x65" piece). That's something like 1/8 of a yard, not 1/2. I know it was not a misunderstanding, since she included a note in the box saying "here is the 1/2 yard of fur." I can't help but think that she purposely sent me ~1/8 yard, and just assumed I wouldn't know what 1/2 a yard looks like. ? Fur 1 Fur 2 And this may be nitpicky, but on her site she has a picture posted of her dog lying in the exact same fur that she sent to me. Though I'm not allergic to dogs, the fur was going to be used on tails that could be sold to people who are allergic. I don't use furs that have been used as animal beds. I've attached a screenshot showing my initial win as well as the paypal transaction. Unfortunately, I nuked all of my Furaffinity notes, but Ghosting and I went to Discord for awhile. I have some screencaps of that. The "we" I'm referring to is my now-deceased fiance. As I understand that art can take time to complete and the year has been completely insane, I decided to be patient. Not to mention I had to deal with my fiance's passing in August. You can see in the screenshots that months went by. In the meantime, Ghosting was semi-active on their FA and more active on their Instagram: https://www.instagram.com/sinscitys/. On November 6, I expressed concern for Ghosting's health as well as how long the commission was taking. I've been ripped off for almost $300 this year, and between Ghosting's active posting and lack of progress, I was afraid that I was dealing with yet another "push things past the dispute window and then disappear forever" artist. It became one of those awful situations where you don't want to yank money out of someone's pocket, but you also can't be a doormat. You'll also notice that Ghosting offered me a refund, which I preferred, but suddenly they weren't able to provide one. Now knowing that Ghosting was more active on Insta and FA, I sent messages to each, which went unread for two days. At this point, I was fed up. I opened a dispute and escalated it. You can see in the Paypal screenshot that there was an active dispute associated with that transaction. The FA note was just to let me know the IG note was responded to, so I am only including the IG screenshot. The custom's quality is lower than many of Ghosting's other designs. But after some consideration, I decided I did like what I received for the most part and closed the dispute. Juice just needs sprucing up and a clearer ref sheet. Ghosting has offered to draw a little extra art as an apology, but based on my experience overall, I'll consider any extras like a scratch ticket win. In summary? Ghosting's designs have a definite charm to them. They are generally colorful and lively. If you like them and can get your hands on a premade, I wholly suggest it! Ghosting as a person seems to be very friendly. But until this artist can communicate and work more effectively, I would hesitate to commission them.

On April 20th, I opened a PayPal dispute to reinitiate contact. The refund was refused, and the dispute was elevated to a claim. On April 24th, the claim was resolved in the Buyer's (mine) favor. On May 1st, the Seller/Artist, Fr0stbit3, reopened the claim to appeal to PayPal. On May 4th, the appeal was denied by PayPal. Fr0stbit3 proceeded to post an unauthorized image of my character, using the title and description to insult and defame me. I decided to create an Artists Beware entry. EXPLAIN: This began when I asked for a pre-posed commission slot Fr0stbit3 was opening in February. When I tried to navigate to the page from my note inbox, I got the error "user has voluntarily disabled access to their userpage", which was a big red flag for me. He has since reactivated his page. Worried that an artist had taken my money and run, I tried using his paypal address to email him, and to my relief he responded the next day. Paypal's first step of the dispute process is simply the Buyer (me) contacting the Seller (Fr0stbit3). I explained what had already happened and informed him I had opened a dispute for this reason. He responded with "I told you to be patient with me" while simultaneously denying he had received any previous email from me. I found this surprising, as he'd never even mentioned the possibility of him actually completing the commission, he'd only spoken about refunds. I made it clear that he had communicated to me that the image was not going to be completed, and that I had been waiting for a refund. At this point, I had no interest in the completed image, as this commission had proved to be an extremely frustrating experience. However, I was very much looking forward for this experience to be over, so I made it clear that if he wanted the dispute to be resolved, he could just send me the image and I'd call it even. He responded as you can see above, with a pixelated/censored version, insisted that he could not trust me, and that he would only send me the file after I dropped the dispute, reiterating it with two emails in a row, making sure to mention in both that I could not be trusted. I was honestly surprised to see that he had done the image, but he still had not sent it to me, only a blurred version, so his part of the transaction was still incomplete. https://imgur.com/WnHAltB I did my best to clarify my position and made it clear that the Paypal claim existed because he had failed to provide what I had paid for, and that if he fulfilled the transaction, the claim would be dropped. I provided a shout back asking him not to contact me unless it was with the image or a refund, via Paypal or email. I was content to drop this particularly frustrating experience and move on, but I then received another email from Fr0stbit3 informing me that he would be appealing the claim and providing screenshots to PayPal, and also threatened to write a Buyer Beware against me. Fr0stbit3 responded by posting the image to his FA scrap gallery, which includes a depiction of my character and my character's name, with the title "Scumbag Wall", claiming I had cheated him. I reported him on FA for harassment. At this point, the situation has concluded. I have received my refund and am happy to leave it at that, though I hope the submission he posted is taken down after my ticket is reviewed on FA. I hope this Artist Beware entry will help provide context for this transaction and help warn other commissioners from attempting to do business with this individual.   9. Foreword The Beware is labelled NSFW since some attached external links contain NSFW material, but no NSFW pictures will be directly embedded in the post itself. This Beware will be very long, so I decided to organize it into paragraphs to make it easier to understand what happened and how I uncovered the culprit since it's a crucial part of the required proof. Summary One of my Patrons has been re-uploading exclusive content from my Patreon page to the pirate site https://kemono.party/. He didn't have my consent, ne never asked for it nor did he ever tell me. When confronted he declared his act was deliberate. I am writing down this Beware to show, with all evidence I have, what happened to protect other artists like me from this user. Background I've been working with Castore93 for almost three years between Patreon rewards and commissions; I can say we've always been in good terms. He began supporting me through Patreon in November 2019 and as far as I know we never had any issue. (Proof screenshot below.) Kemono.party On January 13th, 2022 I came to know through a friend of mine the existance of kemono.party, an infamous pirate site collecting exclusive material from Patreon and other pay-to-view platforms like SubscribeStar. I sadly discovered my Patreon material was uploaded there too. I was determined to uncover who re-uploaded the material, but to do so I first needed to understand how kemono.party works and how they were able to get it in the first place. Kemono.party works by using a scraper, a piece of software which automatically parses webpages to collect data from them. In order to access protected content, the scraper needs some kind of access key. In the case of kemono.party, the scraper uses the session key from a Patreon account. This means that the user either volountarely gives the scraper access to their account's session key or the account is compromised. The upload happens automatically. Thus, the person responsible must have a Patreon account with access to my exclusive posts; either my account has been hacked or one of my Patrons has, volountarily or not, shared their session key. Finding the culprit My account couldn't have been hacked since I was able to see posts which weren't uploaded to kemono.party. I was fortunate enough to have exaclty three Patrons, all belonging to different tiers. The only way to identify the culprit would be posting a series of artworks limiting access to some specific tiers and seeing which of them would get reposted on kemono.party. I have three different tiers called "A precious gift", "Treasure" and "Jewel's waterfall". When posting a content on Patreon you can choose between some visibility options: You can make your post public so everyone can see it. You can make your post visible to "All patrons" regardless of their tier. You can make a post visible to one or more specific tiers. Selecting a lower tier only does not make the post visible to higher tiers. My three Patrons are Patron 1, Castore93 (Castore Devon on Patreon) and Patron 2. Patron 1 didn't join any tier, so they can only see "Public" and "All patrons" posts. Castore93 (Castore Devon) would be able to see "Public", "All patrons" and "Treasure" tier's posts. Patron 2 can see "Public", "All Patrons" and "Jewel's Waterfall" posts. After uploading each bait post I waited until I saw some of them appear on kemono.party. I made four bait posts: All Patron: it was a check to see if my content was stil being stolen. Selecting "A precious gift", "Treasure" and "Jewel's waterfall" tiers altogether. "Treasure" tier. "Jewel's waterfall" tier. Since nobody was part of the "A precious gift" tier it was no use testing it separately. Test no.1: all Patrons. It has been re-posted. Notice how the posts from the "Jewel's waterfall" tier were shared in between "Treasure" posts in order to exclude any time factor. The confrontation It was clear from all the data collected the culprit was the Patron from the "Treasure" tier, Catore93 aka Castore Devon. It was still possible his account had been hacked and he wasn't aware of the situation. So I opted for a neutral approach and he himself confirmed this wasn't the case... On January 20th, 2022 I confronted him. Translation from Italian: Me: Do you know this site? https://kemono.party/ Castore93: I go there sometimes. Me: You do realize this material comes from your account, right? Castore93: But theoretically I think the site uploads content only when you add it, not by itself. I did add some stuff in the past. Me: Do you knwo this is copyright infringment and illegal, right? Castore93: I am curious to understand how it shows it has taken the material without me uploading it. About uploading stuff from Patreon (when I did it some time ago) about that I would have a certain personal point of view, you're not wrong obviously. (SIC) Me: The site connects to your account's session cookie, uploading does not depend from you. In any case you can keep whatever point of view you want as long as my pay-to-view material remains visible only to those who paid for it. Castore93: Ok so one time is all it takes. Later that day I posted a public Patreon journal explaining the situation and how I will be sharing my contents from now on to avoid similar theft. This post too appeared on kemono.party (as you can see from the previous screenshots), meaning Castore93's session cookie was still active on kemono.party. Taking down the material I wish to add this part to show what kind of assholes arise from such events. After contacting Patreon to ask for advice, they suggested me to send a DMCA takedown request to the site which is the typical course of action. However, the criminals running the site ever so smugly responded with... excuses... even if the site has a "DMCA" page with instructios on how to send a DMCA takedown notice. I don't feel like letting them win. I am now in the process of researching my options to deal with the situation. I will try to give updates in the comments about this if I find anything which might be useful to everyone. Conclusion I lost a considerable amout of time dealing with the whole situation, which is amounted to a lot of frustration not to mention the damage of having copyrighted material posted around without authorization. Please be aware of this user.

In the end we ended up having the call. It was positive and I was supportive and understanding of personal issues they were going through at the time. They continued to promise to work on and deliver my commissions. Dec 11th, 2023 - She contacted me to work on my commission December 12th, 2024 - I am shown an early in progress sketch. This is the only art I ever saw related to the art I was owed. I am offered a gift which I never received Jan. 15th, 2024 - I check in to inquire about my commission At this point, she added several more people to her queue in her sever. It was quite large and backed up. (Some more evidence of this can be added if required) Unfortunately, this does not have a date but Creamii posted in her server that people are able to request a refund if desired. Several more slots are being opened on her Discord server for art despite art not being delivered Dec 06, 2023 - the Danger Den discord server sent out this concerning her queue. Jan 30th, 2024 - My partner messaged Creamii on PayPal as this was of growing concern. There was never a reply. Feb 5th, 2024 - My friend contacted Creamii on my behalf. LimaBean was still in Creamii's server at this point and had noticed that she changed her commission queue and that it no longer included me on it and so they reached out. A refund was again promised and never received. ----------------------------------------------------------------------------------------------------------------- March 10th, 2024 I attempted to contact them again for a refund but they are not accepting messages from people who are not their friends and are not responding to contact outside of Discord. ----------------------------------------------------------------------------------------------------------------- March 11th, 2024 An official refund was requested via Email with a reasonable week long deadline. WHAT: 2 Sided Digital (Open Species) Bat Dragon Reference $40 WHEN: 5/6/16 May 6th 2016 to present day (ongoing) EXPLAIN: I specifically commissioned bird because they did the reference sheet of a character that I liked and I wanted something done of the same species. I had found the character through youtube, then found out they were purchased by someone, and actually stumbled on their FA page finally finding the artist behind the reference. I messaged them asking them to help me make a character of the same species. I asked for some basics for the character, it would wear a skull on its head, neck fluff like a bat, a long tail like a dragon, and big ears like a bat. They told me they didn't feel comfortable doing that because it would be copying their friend's character. Whatever I understand that though it is quite disappointing when generally most bat characters have all these characteristics. I was just thankful someone was actually going to be able to help make me a character from scratch with no images at all. The dates came and went, and I sat wondering what happened. I don’t feel like dragging their personal life through the mud, or trying to locate every single journal they posted about art delays, needing money or any other kind of inconvenience because there are many. I remained understanding and considerate during this time because it is the human thing to do. I am aware things can be delayed and people have home life and personal issues to deal with and it's fine because at the time the art was only a month late. Sometime in June or July of 2016 they did a stream on picarto and I saw the line art for the character they would be making for me. I saw them open the file of the old bat dragon reference they made for their friend, and they just edited the lines, as in directly opened the line art file for an older commission, and shorted the ears, changed the tail, the nose, the mouth, everything. The character didn’t look like a bat at that point, it just looked like a dog with wings. I do not have a copy of the line art because their queue/trello is no longer available. I didn’t feel like fighting them so I said the lines were fine but I really felt cheated. June came and went, July came and went, August was coming to an end so I decided to message Bird about the commission mostly to get an update if they finished or if I was able to get some things changed (https://imgur.com/A89OtmH ) this was mostly a message to remind them they had a commission due to me. Months go by with no update to their trello (which was available at the time,) I at one point in time they whispered me on picarto in October 2016 saying they hadn’t forgotten about the commission and they’ll work on it soon. Another time they said they would start working on owed reference sheets during a stream, and ended the stream earlier never touching any art. I sadly have no proof of these things because I never saved the messages and it was all on picarto so there's no actual saved evidence. I was never contacted again, nor did I contact them until they messaged me on my twitter in July of 2017 accusing me of sending my friends after them. (For the lazy, I don’t know who this person was, I never sent anyone after Bird, I solve problems on my own.) Whether or not they were actually about me I still made the notion to call them out for it since they previously accused me of sending people to harass them. Probably unprofessional on my side, but I also found it unprofessional to come after someone and accuse something they did not do. Since the final message I had not received any kind of update about my commission being "85%" finished. I never received the line art and there were no updates to a queue, a trello or message to me. All updates from Bird of any kind seem to be journals about their personal financial issues. Their journals seem like a general place for them to ask for them to ask for money for overdue bills and vet trips or uber money. I had quit following their FA over a year ago because I was tired of seeing them open for emergency commissions and in stream commissions every other day but never actually show up with anything completed. If you just delve into their journals on FA you can see how chaotic and ridiculous it has been as a commissioner trying to get any kind of information from them. They have constantly locked, unlocked and deleted their twitter and since these previous messages from @pb_willow, they made a new one. I had to actually find their twitter from their fursuit business account in order to get ahold of them a year after they said the art would be completed in a week. They said I need to wait Saturday to find someone to give them the time to use their friends’ laptop to plug their external hard drive into. I don’t know how long their computer has been broke, but why they didn’t get this done this as soon as they could makes me really skeptical of everything they’ve told me. If I delved deeper I feel like I would have been met with a ton of excuses. I told them I want either the art or the money whichever comes first, which sounds really rude, but it has been over two years. I do not trust this person to get me either the art or the refund.   12. I contacted Deermoonstudios on Etsy for a fursuit head for $750 (which totalled $804 with taxes). This was paid in full immediately, followed by them stating they had just ordered fur colors needed for the suit after my approval. All on the same day. I waited a little over a month before asking them about progress, to which they said the fur had just arrived and they were waiting on more pieces to arrive in the mail. In Sep I asked for another update, no response, I asked again on the 20th and got told a day later that the head was ready for taping and sorry for the delay. On Nov 2nd 2021 I asked again for a picture, since I never got one. No response, I sent another message on the 14th asking if they saw the previous message, no response. In Dec, I got a little upset and messages them again asking for a picture, still no response. After this I looked for their Twitter, to see if they were busy with life or something. I learned they were pretty active on Twitter and I created an account to message them. Still no response, but they did post a tweet about how they have a hard time responding to messages and complaining that people need to stop guilt tripping them. I'm unsure if this was directed at me, but I took note of it and messaged them on etsy one last time to apologize if I had ever made them uncomfortable, and that I would no longer message them. I've given up and am assuming I'll never get the product I paid for. They had finished one (provable here) fursuit head in the meantime, fairly quickly. I agree. - He receives the items and expresses his happiness with them. - He acknowledges multiple times that he owes me work. - Of a certain quality. - Yet he forgets about me 3 times. - Inundates me with angst and lies, such as not having a working computer when uploading digital work or saying he's too busy when uploading gift art. - Lies, i.e. about being threatened to swindle money out of his viewers. - Currently claims he no longer has the items and says I will never get the art he owes me. Once upon a time, I was cleaning up and decided to give away of a pile of plushies and a few meters of fur fabric. The plushies and fur were really nice so I thought some local furries might enjoy them, so rather than give them to a local thrift store like I usually do, I put up a "free to a good home, first come first serve" post here. Enter Luvythicus. He said he knew someone locally who could pick up a large portion of the fur and the plushies the next day, but that didn't work out. Afraid someone else might come for the items before he/his friends could he said "I know you said no reserving, but..." and offered to trade artwork in exchange for me holding on to 13 plushies and several meters of fur fabric. He used this and this image as a sample to show the quality of work he would give me. I agreed and at this point it became a trade; the items for art. June 5 2010 he received the items and let me know how happy he was with them. June 7 2010 I give him the information he needs to draw his half of the trade. The link I sent him was this one, which is fairly clear reference I think. He complains about the complexity, but if you give her clothes you only have to do the stripes on her face, so. *shrug* September 7 2010 I remind him of our agreement. September 22 2010 he forgot who I am. After clarification I send him the reference link again and he says "Imma doodle her today fer sure x3" November 2010 I leave a shout on his FA page (no screenshot as it had since scrolled off) and again, he forgot who I am. November 26 2010 I remind him again, send reference link for third time. Eventually, on November 28 2010, I get a sketch. You might notice a discrepancy between the quality of that and the quality he promised. I hemmed and hawed, already pretty fed up with having to wait half a year for even a preliminary and being inundated with false promises and angst whenever I ask him about it. But I confront him and tell him this is not the quality of work we agreed on. Same day, he agrees and says he'll draw more. which is followed by another note in which he explains, apologizes and promise to "draw something proper". That's the last I heard from him for months. In the meantime he has and continues to take commissions, ask people for ideas to draw, does a lottery, draws gifts, does trades and offers free art and draws numerous pictures of his character doing the horizontal mambo with other people's characters. I understand people having a hard time, and I understand that paying customers come first. But in this case, I have no clue as to what the hold up is supposed to be. If anything I thought the fact he was uploading work would mean he'd definitely get around to mine, but either he has a 1.5 year backlog or he's taken commissions AND trades after mine and just skipped over the work he owes me. March 5 2011, I send him a link to the original LJ post as a reminder, he says I am not a priority and can't even draw for himself. But uploads gift art 10 days later. April 19 2011 rolls around and I'm fed up. I send him a a deadline, provide me with a preliminary within a month or return the items because I don't think he should get something for breaking his promise. Because he lives on the other side of the country and both he and I have spotty transport at best (depending mostly on public, which costs an arm and a leg), I asked (mutual!) friends more local to him and with transport, if they'd be willing to drop by and pick up the items, so it'd be easy for Luvy to bow out of the trade. He responds by saying he feels threatened and anyway his computer is broken so unless I can teach him to draw out of thin air.. He then makes an FA journal about the fact he's being threatened. Notice how, after a year of admitting he promised to make me art of a certain quality and that he was definitely going to get 'round to it, he goes to saying how he just offered a sketch out of the kindness of his heart. At least he's being honest when he says "I don't care if you feel cheated or anything". My response, also explaining that it wasn't a threat because well, it wasn't. I figured that if it was a misunderstanding, he'd delete or at least amend the post. However, in response to my statement that I was not threatening him, he says that the post is just a warning for anyone else who might suddenly demand art from him. So he knew he was not being threatened, but the post is still there, without even amending the information he knew to be false and he got at least 50 dollars out of lying to his viewers! The obvious falsehood of his post also casts a new light on this one: Silly customers. And makes me wonder how many more people he might owe work to. ? I tell him that, while he claims to only be able to use the internet via his phone and not draw digitally, he had uploaded digital work. I'm not angry, I just want what he promised me. May 8 2011 he's suddenly all cutesy and pleasant again, and asks for my real life address for a "surprise". I am suspicious, and ask him for a phone pic of the traditional media doodles. I remember seeing it, but didn't save it, it was the corner of a piece of paper with some doodles. He said there was a second sheet but the cat puked on it or something. By this time I was getting pretty exasperated with and tired of this person. Can you tell? ? Notice how he asks for the character's personal info AFTER I send him the link for the fourth time. Said link has a full bio, which is part of the reason I didn't respond. The other being that unlike him, I was busy-busy (end of the semester, commissions etc.) and didn't feel like telling him about my hobbies. The link I gave him 4 times had plenty of information he needed for some doodles. Needless to say I didn't hear from him after. Sent a note today, asking for an update, he complains he had to wait 5 months for information he already had and apparently couldn't do a single headshot since and he lost the sketches he already had. Despite the fact that I carefully stored my items and they were fine when I gave them to him, the fur was suddenly "riddled with bugs" and he threw it away; good time to mention he claimed the fur was for his then-girlfriend and he just never gave it to her, even though they were still together for at least a month after receiving the fur. He claims to have given the plushies to charity which I sincerely doubt. Considering his track record of lying to me, I heavily suspect he's just trying to brush me off and get me to leave him alone because he supposedly doesn't have the items anymore. And I'm confident that he will never, ever live up to his promise, leaving his post to be forever unresolved. I would definitely recommend people never give him anything again, money or otherwise. Sure he seems to do some commissions and trades, but why chance it?

  15. I commissioned Fen for a Vtuber bust model with Live2D rigging and 4 "emotions." I was originally quoted for $350, but I tipped enough to make it $500 because they'd just raised their prices after my initial sketch and I was impressed. After I paid the $100 deposit, it took more than the one week promised to get a sketch back, but progress was coming along in a relatively timely manner. Fen was initially good at getting back to me on Discord with WIPs and letting me know they were working on my model. The turnaround from sketch to full-color was surprisingly quick, but I was extremely happy with how everything was looking. My commission was essentially ready for Live2D rigging by the end of May, so I figured the whole thing could be ready at some point later that summer. Unfortunately, that quick pace did not carry over to the rest of the commission. After that May 31st WIP, I didn't get a single update for nearly 5 months. I knew they took commissions on other types of art and streaming assets, so I didn't mind at first. Eventually though, things just didn't seem right. I'd check their Trello regularly to see if gears were turning in the commission queue, and while there'd be new sketched here and there, the Finished Rigs list went stagnant through this whole time. The next update I got from Fen was at the end of October. I was afraid to ask for updates through Discord because their status was always Do Not Disturb, but I decided it had been more than long enough and I sucked it up. About a week and a half after I sent my message, I got WIPs back of the expressions I asked for. I actually hadn't noticed that the expression designs hadn't been done yet, but I was still pleased to get an update and know that my commission was still on the table. After that, it was back to radio silence for a month. By then, it had been 6 months since I paid off my invoice and I was still in "Ready to Rig" status. Especially being a Twitch streamer trying to plan overlays et al to fit with the model, I was growing even more impatient. I consulted a few friends on the matter and decided to ask for an estimated completion date. I was told December 15th at the latest. That didn't happen. In the meantime, it was apparent that Fen was doing Live2D work, just on other "quick completion" commissions that seemed to pop up out of nowhere. What added insult to injury was that they were promoting these simpler rigs with very little wait while I was still actively waiting for what I paid off in June. Then, when December 15th rolled around, they tweeted out that they were finishing a rig in just 24 hours. The next day, they were showing off a brand new rig for their partner. I lost my patience and asked to just take their PSD/CSP file so I could get someone else to rig it. No response. What happened after was a sticky situation. On December 21st, Fen's cat suddenly got sick and they had to take him to the emergency vet. The bill was steep and they said they couldn't afford it, so they needed donations and emergency commissions to cover the necessary treatments. Between this and the holidays, I knew I was in no position to ask for a refund, full or partial, even if I was still out $500 with nothing to show on my end. I again offered to just take my file as it was and go, eating my extra cost, but still no reply. Around New Year's, while all this was going on, Fen suddenly announced on Twitter that they'd finished two standard rigs that had been in the queue behind me. If it wasn't already, the writing was on the wall that I was being ghosted, so I gave them an ultimatum. As much as I didn't want to be the villain, if I couldn't get at least a basic reply, I threatened to file a chargeback. Within hours that same day, I finally got the CSP file with a lengthy apology. I thanked them and that was the last contact we've had with each other. I've since been in contact with a different artist who does Live2D rigging and I commissioned them to finish the model. They've been able to work the the Clip Studio file just fine. While I'm still happy with the design Fen was able to make for me, but between the uneven progress, lack of communication, confusing management of the commission queue, broken promises, and uncertainty that I'd get what I paid for, I certainly won't be working with them again and I can't recommend them to another streamer in good faith.
  16. Update to the Paypal case, I called them and they told me they are siding with me on both cases. They told me the buyer can make an attempt to appeal, but they will have to bring forth entirely new information for their claims. I will update this post if need be. I converted my Paypal account to a business account due to advice I received (thank you). I added an updated window for the claim so that you can see the updated status. Now I only need to wait for the funds to be rereleased to me.

Initial suspicion that things were not progressing as planned began in June 2018, especially moving into July 2018. EXPLAIN: I commissioned Faris after seeing her gallery on FA and seeing a couple suiters at Megaplex 2017 wearing her suits. Initial contact was good, and she was pretty responsive to messages. I was assured that Megaplex 2018 was more than enough time to complete this order, and told that paying in full sooner would assure me an even higher place in the queue. (1) After I paid communication began to go south. There were days, even weeks in between responses in gmail. Faris claimed several times that messages were not arriving from me, or that she had sent something I had not received. I thought this odd, but we agreed to move off-site for communication to Twitter DMs, and shortly thereafter to Discord. Communication problems continued throughout the beginning of 2018, although I always (eventually) received a response after prodding her several times. I was given a "100% guaranteed" completion of the suit by July of 2018. After this passed she told me she been handling her Anthrocon rush, but I would definitely have a fullsuit in time for Megaplex. On June 04 I was promised WIPs "this week" which never materialized until July 22nd, after a LOT of prodding, multiple failed promises of delivery on various dates and times, and eventually having to get pretty harsh with her and threatening chargebacks/legal action. As this date drew nearer with no updates - despite me asking several times - things definitely started to seem amiss. The bodysuit turned into a maybe, but the partial was "100% guaranteed." I did receive photos of a completed head, hands, and tail, and a tracking number only hours before she had to get it shipped out. I paid a premium for Priority Express shipping, but had no updates on tracking past "Pre-Shipment" until I left for the convention on August 02, 2018. (2 - collage of missed deadlines) After I got back from the con I dove into this with Faris, trying to figure out what happened. After an excessive amount of prodding I finally got a screenshot proving she had actually purchased a label - for a Priority package only, that wasn't destined to arrive at my location until August 02. I called her out on it and she had an extremely implausible excuse - I decided it was best to move on from that since I was still out over $2000 at this point with nothing to show for it, the shipping costs only being a fraction of it. (4, 5) During August and September I brought up numerous complaints from other customers to her. They were always "lying" or "not telling the whole story," or "out to ruin her," but she was never at fault for any of it, according to her. On the 31st things came to a head and I had a discussion with her about the poor communication, repeated failures to deliver WIPs as promised, and other issues. I gave her a 30-day ultimatum - if I had nothing in hand by September 30th, I would be moving on to expecting a refund - voluntary or otherwise. I made it very clear then, and at several other points throughout September, that chargebacks and small claims court were absolutely on the table. In the meantime I attempted to treat the unshipped package as a USPS issue, although I'd never heard of the USPS losing a Priority package without so much as an acceptance scan - it seemed extremely implausible. I did almost all of the legwork to initiate claims/seaches with the USPS, including talking to my local office on September 4th. My postmaster wanted to talk to Faris. Faris told me on September 6th that she had called in and given him all the info he requested. I called back on the 7th to verify as I was at a point where I was no longer able to take Faris' word for granted. My postmaster remembered specific details of my conversation with him on the 4th, but had no memory of talking to anybody about the case on the 6th, just a day before. After confronting Faris about this I was basically just given the same story: she had really called. My postmaster said they get at most 5-6 calls a day and that he definitely would have remembered a call about that. (3) I had no choice but to just move on from this point. Dealing with the original package and the constant delays and excuses over the bodysuit was taking a lot of energy from me. On the 22nd of September she was still claiming "100% guarantee" of delivery by month's end. I was also told on this day that the only thing remaining was to sew the front and back together, and sew in the padding. On the 25th she told me she may have to work out Friday shipping with her. I let her know I was not happy about this but as long as I had a tracking number that showed movement before the 30th (an acceptance scan or more) I would consider that acceptable. On the 30th was my last message from her - she contacted me to let me know the back had to be sewn together, and then the front and back had to be sewn together. Somehow in the span of eight days /backwards/ progress had been made, according to her. I was told proof would be sent later that day and that she would be willing to work with me on a refund. I told her that a refund would be best. I contacted her again Monday morning, Monday afternoon, and Tuesday morning to let her know I was expecting her to work with me on setting up a refund, and that Tuesday afternoon was her last chance to get in touch with me. While I normally would allow more time than this for a response, her past track record with communication and near countless other clients waiting on suits, partials, and premades from her, I decided it was best to move on to legal options. At the current time I have a claim in progress with PayPal for a payment made for shipping & indoor sockpaws, and a chargeback with Discover for 50% of the commission price (she has a chance to attempt to refute both of these, currently). The other 50% was unfortunately paid via my PayPal balance which I have no easy recourse to outside of small claims court. Currently I have started that process and am awaiting small claims papers to be mailed to me. I will update this posting as more happens. I just felt it prudent to warn people that Faris is not a trustworthy person to work with. I don't believe she does anything maliciously - she's not trying to run a scam, but she is disorganized and doesn't have the integrity to tell her clients the truth when she gets behind or misses a deadline. For the most part she was polite and pleasant to talk to - but ultimately, I paid a four-digit sum of money for a product that never arrived, with suspiciously similar circumstances to multiple other clients of hers. I would feel remiss if I did not do my part to warn others in the community to avoid making the mistake I did. ~ 06 October 2018: I submitted a claim to the USPS earlier in September regarding the supposedly lost package. An initial payout was approved of $60.15. I thought that an odd number, so I appealed (Faris insisted she had purchased insurance for it, but never procured it when asked). Today I got a letter back with the results of the appeal — it was again denied, and as requested, they explained the $60.15 payout. No additional insurance was purchased to cover the value of the item at time of mailing. The baked-in insurance is $50 plus the amount of postage — meaning she spent $10.15 on the label for this, after I had sent her $107.30 for Priority Express. (6, 7) Faris made no mention of this when I confronted her with this evidence (I already knew she had spent less to do Priority vs Priority Express, via evidence she sent me, I just didn't know the actual amount). She is still insisting she purchased insurance, however, she says she doesn't have a receipt or any other evidence to prove it. She did say she was going to start making regular repayments later this month. At the current time she still owes me $839.85, pending the PayPal chargeback cases resolving in my favor. I am not holding her responsible for the $60.15 the USPS paid me. ~ 18 October 2018: Since posting this I've gotten in contact with multiple other people dealing with undelivered fursuits from Faris, conflicting stories and accounts, etc. I have evidence that Faris submitted, as approval images, the exact same fursuit parts for both hands and feet for both me and another client — and in the case of the hands, she even sent us both the EXACT same image, down to the pixel. I found this artist via a group chat on Telegram that was made for advertising art advertisements, and decided to commission this artist for having an art style I considered to be appealing as well as having affordable prices. I agreed and paid the artist, expecting to have my commission eventually completed. However months passed and I never got any kind of update. The only communication I got from them was me asking if I could update a reference. November comes, and I'm getting concerned. I also look over their Trello queue and TOS and realise something is very off. First thing that comes to mind is that my queue placement is not labelled with 'paid' As well as still accepting commissions despite having already a large backlog. Their TOS was extremely sketchy and unfair, rules such as being able to keep your commission in waiting status as long as they'd like, and once started, a max up to five months. I contact the artist about an update, and an estimated waiting time. I decide then to file a dispute on Paypal and explain my grievances as politely and honestly as I could. Something that caught my mind was that the artist said that they would only finish my art if I closed the dispute. If I ended up following with this, I would've never been able to reopen it again, and there's no guarantee I'll have my sketch started by then. They claim that if I win the dispute my money would not be refunded anyways and ultimately be a waste of time, which sounds sketchy to me, however I cannot find a official Paypal source claiming otherwise so I cannot say for definite if this is true or not. Lilpinkghost claims they have done nothing wrong, as I have agreed to their TOS. Their TOS is not legally binding, as well as having numerous issues with it. here is a link to the PDF they submitted. My experience with Lilpinkghost has been overwhelmingly negative. Please do not commission this artist.
  19. TL;DR at the bottom. Hey everyone! This is Sugarbabie, formerly known as CherishArts. I was put in touch with her through a mutual friend. She said that Sugar had opened up emergency comms to pay for her baby, I liked her style, so I said sure. It seemed like a win win. I ordered two pieces, a ref sheet and a bust, totalling $70 + a $30 tip because I was in a giving mood. This was on January 27th, 2020. (Censored name is the mutual friend) What followed was 6 months of radio silence for the most part. No updates, no WIPs, mostly ignoring my requests for updates. There were a lot of excuses regarding health and real life complications. I was more than happy to oblige. I know life is tough right now, and I am patient. Suddenly in May it dawned on me I hadn't seen her discord updated in a long time. I went and checked and it had ceased to exist. Naturally this sent alarm bells ringing. I went and checked her FA, no updates there for a month, but someone mentioned a second page. Sure enough, Cherish was now SugarBabie. All her socials, Ko-Fi, and Patreon were all new as of March. Suspecting she rebranded to avoid fulfilling her queue, I added her on her new discord and told her how bad this looked. She profusely apologized. 2020 sucks, life is hard, apology accepted. She offered to rush the art overnight, or give me a refund. I stated I wasn't interested in the art anymore, and I would like a refund. However with the ghosting, I didn't trust her to follow through, so I told her I would start a chargeback with my bank. She agreed. I called Paypal, they told me to call my bank. My bank told me that since the transaction was over 90 days old, they couldn't initiate a chargeback, and I would have to go through the artist for a refund. I message Sugar back, explain the situation, and am hit with a flat out refusal. Apparently her offer of a refund was off the table when I said I would do it. When I explained what the bank had told me, she dug in, taking personal offense to me messaging after I "couldn't get it done on my own." I was shocked. Frustrated, I went to her FA and left a shout that explained the situation. Essentially a 1 star yelp review, it was rapidly removed and I was blocked. I messaged her back and asked for a refund on the service she failed to provide. She continued to claim she fulfilled her TOS though nothing was delivered, stating I voided the contract by initiating a refund. She somehow thinks she can keep the money though nothing was given aside from random free art that isn't of my character nor is it what I asked for. Apparently that qualifies as fulfilling the order, just throwing something random at the client. To top it all off, she threatened to sue if I "slandered her business" with bad reviews or "harassed" her by asking for the refund she said I was entitled to, and apparently I'm being reported to law enforcement, though I guarantee that's just a bluff. TL;DR: Artist attempts to avoid fulfilling order by rebranding, refuses to refund me after I went to handle it on my own, claims she fulfilled her TOS by throwing random art at me, threatens to sue if I keep leaving bad reviews.

There is a possibility of recourse, the wording on that article may refer to different types of scams and not a merchant transaction that may be disputed according to this article from the platform. There does not seem to be any generalized windows for dispute like paypal has, only that the platform can charge back a transaction from over 30 days.

Is the item old or new (if old, how long have you had it/when was it made?) This was made sometime at the end of 2009 but I did not receive it until February 2010. (again this will all be explained below.) --Grade each below aspect on a scale of 1 (worst) to 5 (best)-- Visual Aspect (does it match the concept art? Is it consistent with other items the maker has produced? Is it visually pleasing overall?): 1 Okay first, let me say, this wasn't my first fursuit commission, this was my 5th or 6th fursuit commission so I had had a lot of experience with this at this point. The product did not match the concept art to the degree I had hoped for (to me it doesn't match at all other than colors really), it's not consistent with the other items this person has made, and it came out looking pretty bad overall. Why? I was promised something I did not receive. This commission was originally going to be made by Luskwood and when they stopped taking commissions and I saw Sophie, who used to work for Luskwood had parted off and started her own company I approached her asking if she could do that quality of work for me. I had seen the work she did at Luskwood and it looked good and I had seen the suits she had made on her own at that point and I thought they looked pretty nice! She promised me this quality, she promised me leg padding, eyes that light up, glowing fur, and that she would match my concept art... you know what? here is that part of the original e-mail, no better way of putting it: First E-mail: Ooh. Awesome character. I can totally play around with some glow in the dark effects. I could hopefully even find some transparent glow airbrush paints I could highlight the fur with. The problem would be finding one that went on completely transparent. But I would love to play around with that and experiment beforehand and to see if I could get it to work for your fur. ? Anyhoo, before Luskwood disbanded, I worked with Arito, so I can do the same leg/foot padding system and whatnot. I think for the whole thing (supplies, labor, shipping) I'm going to say $1650." I was excited to hear that she liked the character because usually that means the maker will make a better product when they like the character as well! I was also excited that she promised me all of these things and that she was going to do the glow in the dark stuff as well! Sounded like a dream right? The price was the highest I had ever had at the time but I was willing to pay that much for the promised quality. (All my previous commissions at this time were a lot cheaper, were much higher quality when received and were from big names like B3/Joecifur, JillCostumes, Midori, and Rose Quoll.) Man, thanks for responding so fast, I asked for quotes from a couple other people and it's been months and no one has responded! Then you finished that Roo head recently and I was like OH DUH everything you made with Arito and the stuff you've made alone seemed to be the best work that came out of Luskwood/in the style I want! I was all emo there for a week about loosing my quote. I got a good price on it, but I don't mind paying more if I am still going to get the same quality. (It wasn't THAT far off from yours. :P) I wouldn't "need" the suit until FC 2010 so anywhere you want to put me in is fine, I am patient. XD Just tell me where to send the money and I'll snag my space! ? Thank you so much!" Well pretty much none of these promised things came out right. The bodysuit didn't fit at all (we made a duct tape dummy), most of the claws on the feet had fallen off, I couldn't see out of the head and it flopped around, it didn't look right, the "glow in the dark" fur was yellow, uneven, and atrocious. There was absolutely no body padding, the eyes didn't glow (there is more on this though, I'll explain this in the service section), there were no teeth, there was black eyebrows on it (character does not have eyebrows), the mouth and nose were uneven, the ears were uneven. There was pretty much flaws with every part of the suit. More on this in the workmanship section with pictures. Service Aspect (Deadlines. Communication. Little extras.):0 I have actually been afraid to post this part because it DID start off wonderful and she was a pleasure to talk to for months of this transaction! Everything seemed to be going great but then several major flaws we're made towards the end. She is also a well known person in the furry fandom and has a lot of friends so saying anything negative about her seemed "awful".. but these are facts, and this is what happened to me. This is long, so I am going to put it under a cut. Most of this was typed last year in April as well. Communication/Deadlines/Shipping: The suit was originally supposed to be done for Halloween or in October. I asked to have WIP photos because I am very particular with how my characters are represented and I never got any WIP pictures, then suddenly I got finished pictures of the suit the week of Halloween but it just didn't look right in the picture and the eyes looked awful to me. It looked wall-eyed and she had worn the bodysuit. I had sent her a duct tape dummy so that the suit would fit me and I was aware Sophie is bigger than me, so it made me kind of irked to see that she had worn the suit because she said it was hard to get into and I was hoping she hadn't stretched it or something like that. She told me she sent it and I waited. On January 11th I realized the suit really should have been there at that point so I asked her if she had tracking info. She evaded the question and said the post office said it would be there by Wednesday. I waited. I e-mailed her on the 14th saying it still wasn't here. She said she'd call the post office on the 15th if it still wasn't there. I told her on the 15th it still wasn't there. She never responded so I waited some more. On the 20th I e-mailed her asking if she had ever contacted the post office. She said: "I called them, got the run around, was told to email them with the receipt number. There's not record of damage, insufficient postage costs, etc. They gave me some BS about being slow after the holidays and this past federal holiday weekend, blah blah blah. I'm calling them again. They filed it as missing as transit, so from what I hear that puts a fire in their asses if it's just sitting around in some office somewhere. It really should be there today. God, I hope. If it is lost, I'd say we allow until the end of Feb to come back and after that I can either remake the costume or begin issuing you a full refund. I am terribly sorry and infuriated this is happening. Let me know if I can do anything else." I said thanks for calling and everything she had done and continued to wait for it.. Throughout all these e-mails I had asked her multiple times if she gotten insurance and tracking info on it and she kept evading my question. On the 25th I still did not have the suit so I sent her this: "Yeah I think it's gone. ? I hope you got a large amount of money claimed for insurance on that. ? I'd feel bad getting a full refund now if you didn't, but I think now I need the money more than a suit. I lost my job on the 15th. X.x GUhhhhh stupid mail!!!! I swear this character is bad luck. The badge that ****** made of her got lost too! >.<" I censored out that artist's name just in case! Yes, a badge of this character got lost as well. We both had been completely friendly with each other up to this point and there had been no problems with each other. I already didn't completely like the suit she had made just from the pictures in the first place so getting her to remake it again seemed pointless (I would've rather just had the money at this point and commissioned the suit from another maker at a later date, especially because I had also just lost my job, and on top of that someone had stolen my identity so I couldn't get my unemployment money either.) She responded: "Went to the post office today with my delivery confirmation and receipt and in person they told me that as far as their records say, it's been delivered. o.o What the post man says he believes this means is that either one of your housemates (if any) accepted the package and never told you, or got a package notice (due to you not being home or it being too big to deliver) in the mail and forgot to give it to you, or the package notice may have gotten lost. Their advice was to have you check with anyone in your house, as well as head to your local post office ASAP. If it's been been sitting in the local USPS for a while, then that's why it's just been lost in transit without response. After a few weeks they will sent it back to me, which the post man told me can take quite a while. If you can check any roommates as well as your local post office as soon as you can, that would be the next best course of action. Please let me know!" I sent back this: "Hi ----, I don't have any housemates and nothing has ever gotten lost in the mail here at all in the past. ? I have received numerous LARGE boxes in the past, too. I just live with my boyfriend and we would've seen it if it got here. I will check the post office tomorrow I guess... ? We haven't gotten any notices. You sent it to *****ADDRESSS****** Right? I'll let you know ASAP what I hear from my post office." I wanted to double check my address because people spell it wrong all the time. Sophie responded: "Yeah, I didn't know if you had any, so I was just passing along info. Anyhoo, try the post office and see. That is the address I sent it to, so hopefully the post office was just being stupid and it's sitting with them." This is when I went to the post office on the 29th of January and e-mailed her this: "The post office says they didn't receive anything at all for me. I had them look all over in the back. Are you sure it was confirmed received?? Was it at a different post office? If you got insurance on the package, you should have a tracking number (according to the person at my post office.) I have a feeling it's lost or... at a different post office? My post office definitely doesn't have it. x.x I don't know why it would be confirmed received if it wasn't in ******." I spent a lot of time down there and they had nothing... This is also where I found out that she DID NOT get insurance or tracking on the suit. On the 30th I was upset so I sent her an e-mail explaining to her why I'd rather have the money than another suit because it seemed to me that it was definitely lost. I spilled my guts, I was stupid, I TOLD HER EVERYTHING that had happened to me up to that point because I was stressing out and so that she wouldn't think I was BSing about wanting the full refund that she had promised instead of another suit. I also asked her if she had actually sent it because it was just too weird that the post office had absolutely no record of it and that I was upset with her for not getting insurance and tracking. I was nice about everything I said in the e-mail. I asked to see the receipt so that if there was any tracking at all I could find it from the receipt. I got back an angry e-mail from her... in which she refused to refund me, but she scanned the receipt. She accused me of receiving the package and not telling her. We both basically got unreasonably mad at each other about the stupid USPS losing the package of the suit I was promised was of good quality. These e-mails are really long and tl;dr so I will leave them out and just put these summaries here. x.x I told her that I would wait 2 months for it to show up, but if it didn't I would still expect a refund to be an option if I didn't want her to remake the suit. On the 31st she e-mailed me back and said she could do the refund.. I'll just copy paste that e-mail, I can't summarize it well. "I firstly want to apologize for accusing you of lying. I was on the defense for being accused as well of something I would never do to a customer. I believe we are both just running a bit of a temper due to a regretful situation that is out of our hands. We both don't know each other personally, so it's easy to assume. It's stressful, but I think we both got any suspicions under the bridge and we can work to fix it. I do think you misunderstood me about the refund. Perhaps I worded it poorly, but I meant that I could not offer you a full refund right this minute. Firstly I really believe that we should wait the two months, and I am grateful you agree. But also I meant that I could not offer the full refund all at once. It would have to be paid back in installments, much like how I accept payment for costumes. As for it showing up in the hopeful case it will, I said in my previous email that I would be glad to change the design a bit so you could sell it without selling your character. I have no problem with offering you that at all. I encourage you, should it come to that, to allow me to do so, since I know my own work more than anyone else would. If it's truly just the head that's the problem, I can remake the head if the costume resurfaces. I still believe that I followed the concept to the best of my ability. But I also understand that the way we all see and interpret art can vary. I don't know if this would be a solution for you, but one thing I've done with previous customers is to sketch their character in my own style and render it out as such. It has been a very successful exercise in the past and I think it might work for you. Basically I would email you a bunch of sketches and you can pick and choose what you'd like. Anyways, I believe patience is our biggest ally right now and all we can do is hope it shows up. I am still going to be hawking around on the USPS phonelines until I've gotten an answer. Despite not having on-site tracking, USPS does track all packages in their own system, all I have to do is find someone on the phone that is willing to let me know what their systems are saying. I do not know why they would have told me it's delivered if it was not, but I know that I can find out somehow. It's a government agency and it is a bureaucratic mess to navigate. I will get answers, however, and I will pass them along to you as soon as I have some. Hope you are well and at ease at least a little bit," I explained to her all the things I would want changed if she wanted to remake the suit head (this was before I knew of the actual quality I would receive in the mail.) I thought only the head was a problem at this point, so it all seemed reasonable. Lots of time passed. On February 6th the suit miraculously shows up. The suit was the most terribly crafted suit I have ever had in my own possession. NONE of those things I was promised were on it. The whole suit was crammed into a huge box with no packing material at all as well... I told her my honest opinion on everything including pictures like I have posted here. Her response: "All right, send it back to me. Once I get it in hand I'll start issuing a refund in installments to be completed by Aug 1st. I will sell the costume off myself." On top of this I was told she was writing snarky posts about me on her LJ this whole time! I did not see them myself but people told had me about them. ? I never had any "buyer's remorse" for the suit I EXPECTED to get, the product I received was just NOT WHAT I BOUGHT AT ALL. There was no body padding, the eyes didn't glow, it didn't match my art, it was not Luskwood quality..etc.etc.etc. I'd be perfectly happy if I had gotten what I had commissioned. Anyways, you can see why I was not pleased with the amount of money I paid. Manda did not cost anywhere near that much and is MUCH MUCH higher quality..and she fits me, I also never sent Joe a duct tape dummy either, he just did it right with nothing but measurements and she still fit me. Licorice and Cricket were even cheaper and are just as high of a quality as Manda. Pierah was cheap as hell and much better quality, my "secret" suit is obviously higher quality and extremely cheap, same goes for Sync and none of them cost anywhere near this much. I was expecting the quality I had gotten in the past from other makers but with everything promised. I sent it back to her as soon as I could after getting back and asked her to tell me when she got it. I paid an extra $65 total to ship it and to get tracking and insurance on it (I will never get that back, but I knew that!) I just wanted to send it back to her right. It got back in a timely manor. I expected installments of payment like I was promised because she had said she didn't have the money so I agreed to have it by August 1st. I sent this to her on March 2nd because she hadn't told me she got it yet: "Hi, ----! I am just checking in, did you receive the suit yet? I sent it with insurance and tracking on the 18th, but the USPS website is giving me errors when I put the tracking number in. (Can anything with them ever work right?) Anyways, if you didn't get it yet, I am going to go down to the post office and figure out if they messed up their system or something. Thanks!" She never responded to it. So I sent this on March 18th. "Hey, just checking again since I never got a response back before. I just want to make sure everything gets there. Thanks," She responded: "Hey, I got your box. No worries." I never got any payment installments as promised but I randomly got most of it back on April 18th. This suit or.. lack there of.. THIS EXPERIENCE cost me: $584 + the money I spent to send it back to her.. and whatever I paid to send her a duct tape dummy which I doubt she used. I e-mailed her about this remaining money and she never responded. I e-mailed her again last month giving her an ultimatum, she sends the money back but the end of March or I go to court. I am hoping I won't have to go to court, but what's done is done. TL;DR: She didn't meet the deadline, the eyes never looked right, she promised me she could do something she obviously couldn't (make glowing eyes like my art), it got lost in the mail, she didn't put tracking on it, I asked for a refund when I got a bad product, she refused, she finally paid me back most of it, she still owes me money a year later and has about a week to pay me back before I go to small claims court. (A lot of friends were over when this came in the mail, my excitement quickly died when I opened the box.) Describe your Experience. Pros, Cons, Comments: Well I pretty much described it all already. This was an extremely negative experience for me. I have waited almost an entire year for this thing to be resolved and she has made no attempt to refund me the remaining money, next month it'd be a year, and I am tired of waiting in silence. By law, because I have absolutely NO PRODUCT, and I DID NOT cancel on her while she was in process, she owes me ALL of my money. On top of this, I have not seen her resell the suit.. so I assume it's still at her house or.. possibly in the trash? I don't know. I have put off posting anything "publicly" about this because I didn't want to start a bunch of e-drama and because I was hoping keeping it out of the light would help to keep a nice neutral relationship between me and Sophie so that we could solve things in a calm and fair fashion but now that she isn't responding to me at all, it's public. Final Grade (out of 5): 0 EDIT: Figured out how to upload videos to youtube so that they can only be seen when linked or something! So, I hope these work. These were filmed last year in February right after getting the suit. This is the "glow". Impossible to photograph, hard to video tape, but this is as good as it gets to convey the issues with it. Show media This one speaks for itself. ----REVIEW END---- An update on what has happened since then: I have received no response whatsoever from her and am in the process of settling this legally now. She has failed to respond to me in any way through all the conventional methods I have tried. Yesterday I noticed she had been active on Furaffinity so I attempted to contact her through the website (which I had never tried before) and received the response that I had been blocked. The fact that she has blocked me on a website where I have never once been rude to her or attempted to contact her before on leads me to believe that she is refusing to cooperate with me instead of just neglecting to check her e-mail addresses. I had a "demand letter" written up which is being sent on Monday. (I waited until Monday because April 1st is well.. April 1st and I wanted this to be taken seriously.) I have been researching and talking to people for the last month or two about small claims suits and finding out everything I need to do. I have asked her to explain her side of the story with no response. If there is something I missed, or am doing wrong, I want to hear it because I will admit my faults if there is some valid reason or something I missed. With nothing work off of on her end, I can only go with what I know and have on my own end. I saved every e-mail and record of transaction with her and have all the evidence I need for court however. EXPLAIN: In April, I came into contact with Edalie. She had been posting her art in a discord server I frequent at a steady pace. After noting her quality and ability to draw different styles, I asked her for a commission. A character design sheet, with three total drawings, all shaded, and 6 total facial expressions. She charged me $290 USD for the transaction. It was pricey, but I could afford it at the time. On May 21st, I received lineart for the first pose. Simple enough. It was colored the next day. We would go about a week's worth of silence, before more contact on June 6th. She promised that she would get me a sketch of the second pose by the next day. It did not come by the next day. In fact, it wouldn't arrive for two whole months, during which contact was very scarce and was almost always initiated by me engaging in small talk every now and then. In early August, I finally received the sketches promised. And then more silence. On August 23rd, I was told that she would be streaming this commission on her Twitch channel, and she asked me if she was okay to begin working on lineart. To the best of my knowledge, this stream did not happen. I tuned in briefly and she was not working on my commission at all. However, she has past broadcasts turned off, so I have no real way of verifying this. I have reason to believe she did not work on my commission at all, however, because the next update I received from her would just be a revised sketch and not the lineart I was promised. A full month passed, and on September 24th, I messaged her again, this time with a pretty passive aggressive message. She responded and apologized, stating that she had accepted other commissions, and had given them priority. Her reasoning for this was because I didn't ask for a deadline. She asked for a chance to make it up by working on the commission all day. At the time, I accepted it. However, I sought counsel from friends, some of whom are also artists, and they understood my concerns. Mainly that I felt like it was unfair for my commission to just not be worked on even though I paid for a spot in the queue. Following our exchange, she finally got the lineart to me (mind you, this was supposed to be completed in August). I began to ask her for revisions, but instead I decided that it was best we called it off. I felt like it would be enabling that kind of behavior if I let her continue to work on the commission with no accountability, as she had already shown me that she was likely not going to give my commission priority if other commissions came in, despite the fact that it had been five months since I paid for it. After asking for a refund, she became very combative, initially saying that 2 months is the average turnaround for a commission based on what other artists have told her. She also tried to insinuate that because I was patient, that I was okay with being pushed back constantly due to her prioritizing other commissions paid for after mine. I told her I felt that the art I was going to be given in only hours would not match the quality I would expect for a $290 payment, and also due to how long it took for us to get to that point. She seemed to think that my issue was with the quality of the art and the price, not with how long it took for me to get lineart for the sketch. After a little bit more of back and forth (screenshots of the full discord conversation from the time of payment to the end will be provided) she agreed to calculate the refund price. I reasoned that the refund would be around $170 to $190 due to the fact that only one out of 3 poses had been colored, lineart for the other two poses had been finished that day, and nothing had been shaded. Her refund amount was $80. She tried to justify it saying that her prices at the time were $70 for lineart ($100 now, apparently). I agreed without thinking about it at the time, but upon further review of our logs, there was no such price specified at all. She also mentions a discount on cell shaded fullbodies. That was also not in our agreement. We go back and forth a little more, and our logs end with her telling me that after our conversation, she will be instating a no refunds policy and that it's based on her own kindness not to enforce that on me. I have since attempted to go through PayPal for a chargeback, and am currently trying to get half of the agreed amount back, as I do not feel like she should keep $210 for less than half of the work. Following this situation, she has since blocked me on Discord, and banned me from her server. The mod message states the following (a friend joined the server and sent the screenshot, which will be provided below): "Hi @everyone! This post is a warning of a recent commissioner. When doing business with someone, it's never wise to be fickle and change things unless the other party agrees. It can cause confusion, and a hassle for both sides. When you give money to someone for a service, you are forming a business relationship. A successful business is all about the satisfaction of both ends, and the responsibility of the commissioner matters just as much as the Artist's. Feelings must be mutual so the Artist can happily receive their payment, while the commissioner can happily receive their product. The safety of the Artist is just as important as well, so the commissioners that disrespect, and mistreat the Artist will result in being Blacklisted. The commissioner that will be Blacklisted is @yung nero, and will now be banned from the server. With research and from recent events, he's had a history of disrespecting creators for his own satisfaction and unrealistic views upon forming a business. So please, be cautious if he makes contact with you." This post makes me feel like 1) she told her mods false information about me to slander me ("With research and from recent events, he's had a history of disrespecting creators for his own satisfaction and unrealistic views upon forming a business" despite the fact that said research and history doesn't exist) and 2) it feels like an attempt to sweep everything under the rug. This could prove problematic in the future, as if there are any artists that accept commissions in her server, that could potentially prevent me from trying to commission other artists in the future. I commissioned him 2 separate times before all this with no problems. I was very surprised at the time but glad that he had worked on it and was farther along than the last picture. Like I said at the beginning, I have a lot of patience and didn’t want to stress him out. 2014 No notes were found for this year and any skype logs I had died with my last computer. No data available for this year. 2015 Every year after this point I would ask for an update on the commission in late February as sort of the anniversary of when I commissioned him. Once again he asked if I would agree to change the subject of the commission again, something league related. I thought this might be just the last motivation he needed to finish the commission so I approved the subject change. If he wasn’t liking the old subject then hopefully this new one would motivate him to finish it. At the time, were we both starting to get into league of legends so it seemed like a good idea. Originally it was something along the lines of us working together to fight Baron Nashor, my character as Rugged Garen (DEMACIA). He was accepting more commissions and opening his patreon pages with his personal projects and commission rewards (Reward tier where you get the equivalent of a commission). I knew the adopts that he did every few month were to cover his rent and a bit more for food but still hurt that he was doing new stuff rather than old commissions. He did two separate days of it but I missed most of the second day sadly since I passed out mid-stream. When I asked for an update in late February, he let me know that he still planned to finish it and wanted to give me a refund as well. Also he wanted me to refrain from asking for updates on the image part of the commission as well after he had sent me my money back. The image would be considered a giftart apology for waiting or interest for such a long wait. At that time I mentioned my intention to eventually go to Artist Beware with the issue which he was understandably irritated about. I would be too if someone was going to make a post on here about me. Probably he wanted to get the commissions done that were newer and of people where were bugging him more to get them done. This month so far he has made work on his patreon rewards but seems behind on those as well. I don’t really know what his situation is as far as his commissions and patreon rewards but I do wish he would talk about it and be a bit more open. It really sucks that it’s come to this but I don’t quite feel like my commission is going to get finished without this and it would probably be a few more months before I get my refund too. Posting this here probably burns what bit of friendship we still had but seems like this is my only option. It has been over 4 years since I commissioned him. Each time he gets past half way done before scrapping it and starting over because his style changed, to do more for the picture as an apology for taking so long, or because he lost his motivation to finish the image before this one. His art has improved but his work ethics hasn’t quite kept up with the demand he has gotten for his art. I know I’m not the only person he owes art to. There are others that have commissions from him in the year 2013 (Some done others not). Plus he has been having a bundle of (NSFW) patreon commission rewards pile up every month. Occasionally he will take a simple sketch commission or do in (NSFW)stream commission he announces on twitter. He also has his own patreon for his personal comic art that he used to do but hasn't touched for a while. (I could probably fill out a long list of different times he has taken commissions over the years but that would be very long a bit more work that needed. If requested though, I can add them later.) I’m probably not his first priority to do at the moment and that’s fine. Unfortunately my patience has essentially ran out now and a more aggressive approach is needed. This will be held here as unresolved until his promise is fulfilled back in February. Refund of $60 and the commission image. I think that's fair since that's what was offered. Update: Kanel finally sent the refund. That was fast.

Just as a final update on the matter (hopefully): ex-client stopped harassing us with new accounts and so far we didn’t receive any extra updates on their stories (seems like they set it to private and that’s totally fine by us; in their safe space with the people they trust they can share anything they want. Our problem was with the open-public harassment they were doing). For future reference, as for this specific situation we had never terminated a commission on this stage of development before. We try our best to provide a good experience for our clients, but we’re very strict with our TOS. Since the beginning this negotiation was walking the line of us being too soft with our own terms (trying to be sensible with the client and at the moment thinking the project would be good portfolio material so it was worth being more flexible), and in the end we got the raw side of the deal. Since we’re a new studio not much can be found of us online at the moment, sadly. As the brand our opinions on the matter might be taken less earnestly by people who do’t know us or our service, and for that we welcome anyone to ask our clients directly how the experience of working with us was. Most of them are tagged on our IG posts (of course, respecting their privacy and space). We thank you all for your time and attention on this matter and from this entire situation we plan on changing a few things on our TOS and procedures from Artistic Liberty in the future to prevent this kind of stuff from happening again [we’ll share here so other makers can have this testimonial to refer to if they want]: ▫️We’ll add a more detailed clause on cancellations // terminations on these designs made by us to prevent further claim discussions about this. ▫️The cancellation from our side will be more explained since for us Artistic Liberty slots are pick with the main objective of being a fun project and a good portfolio material. If during negotiations the client requests changes that make the project less interesting from production we’ll reserve ourselves to terminate the quote. We’ll also make it clear that on Regular Commissions the client has all the freedom in the world to request any changes desired, to request a character to be created from 0 and pay for that kind of service accordingly (our Artist Liberty services are way cheaper than regular commissions for that reason, and we plan on letting this more clear on the TOS too). ▫️We’ll stop being way too reasonable with clients that send a quote request for this kind of project without having the money to pay upfront the initial nonrefundable 30% of the commission price. Most of the cases of clients that stole our art were from people who didn’t have the money upfront to pay but wanted to move forward with the commission anyway, under their word of paying us in the future. We trust our clients until being scammed, and for that reason we plan on protecting ourselves more from that kind of situation. ▫️We will request an ID from now on after the quote is analyzed and approved. Working overseas might making check those IDs more difficult but it’s better than having this kind of headache again in the future. ▫️Clarify even more that designs created during quote or during commission process are property of the studio until payment is complete and no designs can be claimed on cancellations // terminations. We’ll be stricter with also the use of unpaid claimed designs to be made into fursuits by other makers (that didn’t happen before, but better safe than sorry). ▫️Making sure to attach a PDF version of our TOS in the quote confirmation email and ask the client to read and confirm agreement again before sending the invoice for the project. ▫️Proofreading all the TOS with English native speakers to make the terms as clear as possible for future clients (as it is right now it was only proofread by Brazilian translators).
